Cozen O’Connor Sues to Halt Anti-Immigrant Law
Cozen O'Connor, an AmLaw top-100 law firm with more than 500 lawyers in 23 offices, along with various legal aid organizations, filed suit today against the City of Hazleton, seeking to enjoin and declare unconstitutional the City’s Illegal Immigration Relief Act. Cozen O'Connor is acting as co-lead counsel along with attorneys from the Puerto Rican Legal Defense and Educational Fund.

The ordinance contains a wide range of prohibitions involving persons defined as “illegal aliens.” It also establishes English as the official language for the City, and requires that all official city business forms, documents and signage be written in English only, unless federal, state or local law otherwise provides. The ordinance was enacted July 13, 2006 and is effective in 60 days.

The lawsuit was filed on behalf of several local business owners and residents of Hazleton, and three non-profit organizations that serve the business and local community. The named plaintiffs are Pedro Lozano, Humberto Hernandez, Rosa Lechuga and Brenda Le Mieles. Several “John” and “Jane” Doe individuals and two unnamed minor children are also plaintiffs in the action. The plaintiff organizations include Casa Dominicana of Hazelton, Inc., Hazleton Hispanic Business Association and the Pennsylvania Statewide Latino Coalition.

The Complaint alleges that the ordinance violates the U.S. Constitution’s Supremacy Clause and violates plaintiffs’ 14th Amendment due process and equal protection rights. Violations of the First Amendment, the Pennsylvania State Constitution and several statutes are also alleged in the filed Complaint. In addition to a permanent injunction and declaratory relief, the Complaint also seeks monetary damages.

A team of Cozen O'Connor attorneys, led by Thomas G. Wilkinson, Jr., a member in Cozen O'Connor’s Philadelphia office, will be handling the case. Cozen O'Connor was selected as lead litigation counsel because of its established reputation for handling significant pro bono litigation. “Pro bono legal service is and always has been an integral part of Cozen O'Connor and its culture,” said Wilkinson. “The firm feels very strongly about representing those who cannot otherwise obtain the legal assistance necessary to defend their basic constitutional rights.”

Co-counsel in the case include the Puerto Rican Legal Defense and Education Fund, American Civil Liberties Union, the Community Justice Project and attorneys George Barron, David Vaida and Barry Dyller.
