Background checks part 2: The Fair Credit Reporting Act

Before requiring criminal background, credit history, and driver's license checks as part of the hiring process, employers must be aware of and comply with the federal Fair Credit Reporting Act (FCRA), which places limits on the use of background checks and creates rights for employees and others subject to the checks. Although the statute's name suggests that it governs credit reports, the FCRA covers what is defined as a ""consumer report."" In their weekly Boca Raton News column, Hodgson Russ partners Larry Corman and Glenn Rissman discuss steps employers can take to reduce the likelihood of being held liable for misuse of consumer reports during the hiring process.

Day, Berry & Howard Welcomes Ken Shulman To Its Boston Office
Day, Berry & Howard LLP announced today that Attorney Ken Shulman has joined its Boston office as Counsel, practicing in the Firm’s Individual Clients Department.

Shulman, who comes to Day, Berry & Howard from private practice in the Boston area, focuses his practice on estate planning and related issues for elders and families with disabled children.

Shulman is a frequent contributor to the publications sponsored by Massachusetts Continuing Legal Education, Inc. Most recently he has co-authored the book, Special Needs Trust Administration Manual, A Guide for Trustees. He is also the principal author of the chapter, “Planning for the Incapacitated Child” in Estate Planning for the Aging or Incapacitated Client in Massachusetts (MCLE, revised 2004) as well as “Financial, Estate and Trust Planning” in the book Legal Rights of Individuals with Disabilities (MCLE, 2002).

Shulman, who has thirty years of experience practicing law, recently completed a term as Director of the Massachusetts Chapter of the National Academy of Elder Law Attorneys. He received his B.A. in 1971 from Northwestern University and his J.D. in 1974 from Boston University.
