Kathleen Cloherty Henry Among the Ten Outstanding Young Leaders of 2006
Kathleen (Kathy) Cloherty Henry, an attorney at Choate has been selected to receive one of the 2006 Ten Outstanding Young Leader Awards presented by the Boston Junior Chamber of Commerce. The TOYL award has been given each year since 1952 to 10 individuals between the ages of 21 and 40 who have demonstrated outstanding community leadership and commitment. Previous recipients of this distinguished award include John F. Kennedy (1952), Leonard Bernstein (1954), Sumner Redstone (1959), Leonard Zakim (1984), Macey Russell Esq. (1995 and a partner at Choate), and Heather Kahn (1999).

Kathy was singled out for this prestigious award because of the remarkable life, both professionally and personally, that she has led.

“In 33 years, Kathy Henry has given back more than some people do in a whole lifetime,” said William Gelnaw and John Nadas, co-managing partners of Choate. “She is truly deserving of this award and we are very proud of her. Her passion, commitment, and dedication to social justice and people in need is inspiring.”

After graduating from BU magna cum laude in 1995 (with a full academic scholarship), Kathy spent one year as a volunteer with the Jesuit Volunteer Corps in Brooklyn, NY, where she worked in a storefront soup kitchen helping people in the Brownsville section of Brooklyn (one of the poorest Congressional district in the country) navigate the complexities of applying for public assistance, Social Security, Medicare, Medicaid, and housing. Many of her clients were HIV positive, so Kathy joined the Brooklyn Aids Task Force to become more educated about the disease. Through that organization, Kathy got involved with the Birch Family Camp, which runs a program for families who have a child with HIV. For eight straight years, Kathy spent her summer vacations volunteering for 10 days as a camp counselor at the camp.

Kathy then spent another year volunteering for Network: A National Catholic Social Justice Lobby in Washington, D.C., where she lobbied Congress to increase spending on social safety net programs such as Welfare and Medicaid – programs that she saw firsthand were important to people living in poverty.

After working her way through law school at Northeastern University (where she was an active volunteer with the Co-operative Income Sharing Program and the Law Clinic Advisory Council), Kathy joined Choate, Hall & Stewart in 2000. Now a sixth year senior litigation associate in the firm’s nationally known insurance and reinsurance litigation practice, Kathy works on major litigation for some of Choate’s biggest clients. And she continues to play a strong civic leadership role in the community.

After joining Choate, Kathy immediately got involved with the firm’s extensive pro-bono program for the Political Asylum/Immigration Representation Project, a not-for-profit organization that provides pro bono services to asylum-seekers and immigrants in detention. When Choate received the Pro Bono Law Firm of the Year Award in 2004 from PAIR, Kathy was the attorney chosen to accept the award on Choate’s behalf. She also handles pro-bono cases for the Women’s Bar Foundation Family Law Project for Battered Women.

In 2004, Kathy was one of 10 leaders from across the state to be nominated to the Boston Bar Association’s first Public Interest Leadership Program. The goal of the group was to steer development of a program to foster peer involvement in public interest, civic, and pro-bono work. Choate donated 250 hours of Kathy’s time during the one-year program. One of Kathy’s big projects was collaborating with the Boston Medical Center to study the adverse health impact on children caused by cuts in legal funding. In 2005, Kathy became a member of a new BBA Public Service Committee, which was created to evaluate the different programs that get BBA funding.

Kathy will receive her TOYL award at the Boston Jaycees annual black tie gala on September 21, 2006. The TOYL awards program is successful because it not only recognizes the superior accomplishments of its honorees, but also challenges those winners to maintain their high standards of professional and civic dedication.

The Boston Jaycees is a volunteer organization of young professionals, between the ages 21 to 40, dedicated to developing leadership skills and individual growth through the management of and participation in community service and educational programs. The Boston Jaycees are the local chapter of the United States Jaycees, consisting of 64,000 members nationwide, and affiliated with Junior Chamber International in over 110 countries.

Miller Nash partner Tamara Russell appointed to Oregon Department Of Employment Advisory Council
Tamara Russell, a partner at Miller Nash LLP, has been appointed by Governor Ted Kulongoski to serve as a management/employer representative on the Oregon Employment Department Advisory Council.

According to Tom Sand, Miller Nash’s managing partner, “We’re proud of Tamara’s recent appointment to the Employment Advisory Council. Her knowledge of employment law will be a great asset to the Council and the Governor’s office.”

While serving a two-year term on the Council, Russell will work with private and public-sector businesspeople as well as union representatives and members of the public. The Council provides assistance to the Director of the Employment Department by analyzing various policy and legislative matters involving unemployment benefits and employment in general throughout the state.

“I’m excited about working alongside professionals from all aspects of the employment field to address important issues surrounding employment in Oregon,” said Russell.

Russell became a partner at Miller Nash in 2006. She focuses her practice on representing management in employment law and labor relations matters. Before joining Miller Nash, Russell worked in the Washington, D.C., office of Senator Edward M. Kennedy and at the law firms of Bogle & Gates, PLLC, and Druckman & Blatt, PC. She received her bachelor’s degree in international relations and communications from Simmons College in Boston, Massachusetts and her law degree from Boston University School of Law.

Firm Advises on $1.3 Billion Merger of US LEC and PAETEC
On August 14, it was announced that US LEC Corp., a full-service provider of IP, data and voice solutions and PAETEC Corp., a privately-held supplier of communications solutions, have signed a definitive merger agreement, which will result in a combined company with an enterprise value of $1.3 billion. The equity value of the transaction is $450 million. Willkie represented Merrill Lynch & Co., financial adviser to PAETEC. Under the terms of the agreement, PAETEC and US LEC will become wholly-owned subsidiaries of a new publicly owned holding company. The combined company will continue to trade under US LEC's existing Nasdaq Global Market symbol, but will be called PAETEC Communications Corp. It will have over 45,000 customers and operate in 52 of the top 100 Metropolitan Service Areas (MSAs) in the United States. The deal was handled by partner Steven Seidman and associate Kelly Sutherland.

Real Estate Department Assists Mills Corp. in $981 Million Property Sale
On August 14, Willkie client The Mills Corporation announced that it has signed a binding letter of intent to sell its interest in three retail malls -- Vaughan Mills (Ontario, Canada), St. Enoch Centre (Glasgow, Scotland) and Madrid Xanadú (Madrid, Spain) -- to Ivanhoe Cambridge, Inc. for approximately $981 million. Mills and Ivanhoe each currently own 50% of Vaughan Mills and St. Enoch Centre while Madrid Xanadú is wholly owned by Mills. Mills plans to apply proceeds from the sale to pay down a portion of its Senior Term Loan with Goldman Sachs Mortgage Company as Administrative Agent. Based in Chevy Chase, MD, The Mills Corporation is a developer, owner and manager of a diversified global portfolio of retail destinations. It currently owns 42 properties in the U.S., Canada and Europe, totaling 51 million square feet. The transaction was handled by partners Eugene Pinover, and Douglas Ulene; and associates Thomas Henry and Mal Serure.

David M. Schwartz Appointed to United States NAFTA Chapter 19 Roster
David M. Schwartz, of Thompson Hine LLP, has been named to the United States North American Free Trade Agreement (""NAFTA"") Chapter 19 roster. David is of counsel in the firm's International Trade & Customs practice group. The United States Trade Representative maintains a roster of approximately 60 international trade lawyers to serve on binational panels established by Chapter 19 of the NAFTA. The panels are convened to review final government agency determinations in antidumping or countervailing duty (""AD/CVD"") proceedings and amendments to AD/CVD statutes of a NAFTA Party – Canada, Mexico or the United States.

On the appointment, David said, ""I am honored. The roster is an important part of the international trade regulatory regime, and I'm glad to be a part of it.""

David will serve a one-year term, from April 1, 2006 through March 31, 2007. Chapter 19 roster members must be citizens of a NAFTA party, of good character, of high standing and repute, and are selected on the basis of their objectivity, reliability, sound judgment, and general familiarity with international trade law.

David focuses his practice on import and export compliance, trade remedy litigation and trade policy. He has over ten years of experience practicing international trade law. He counsels clients on international trade issues arising under U.S., NAFTA and WTO laws and regulations. He represents clients in administrative litigation proceedings before the U.S. International Trade Commission, the U.S. Department of Commerce, U.S. Customs and Border Protection and the U.S. Department of State. He also represents them in legislative matters before the U.S. Congress. Prior to private practice, David served as a judicial clerk to the Honorable A. Joe Fish, U.S. District Court for the Northern District of Texas.

David received his J.D. from Harvard Law School in 1991. He earned his Master of Arts in Law and Diplomacy from the Fletcher School of Law and Diplomacy in 1987. He was a Rotary International Foundation Scholar at Victoria University from 1987 to 1988. He received his B.A. with highest honors from the University of Texas at Austin in 1984.

David is a member of the American Bar Association, the District of Columbia Bar, and the Texas State Bar. He is also a past president of the Fletcher School of Law and Diplomacy Alumni Association. David is admitted to practice in the state of Texas and the District of Columbia.

Mayor of Albany Appoints Nixon Peabody Attorney to “Re-Capitalize Albany Advisory Committee”; John E. Higgins Selected to Join Albany Strategic Planning Group
Albany, New York. John E. Higgins, a labor and employment attorney with Nixon Peabody LLP, has been appointed to the “Re-Capitalize Albany Advisory Committee” by Mayor Jerry Jennings. The committee, which is comprised of a distinguished group of business, education, economic development and community leaders, is to craft a new vision for education, economic growth and neighborhood revitalization throughout the Albany capital region.

A former adjunct professor at Albany Law School, where he graduated in 1989, a past vice president of the board of directors of the Child’s Hospital in Albany, and a 1983 graduate of Hamilton College, John devotes a significant amount of time promoting and educating employers, law firms and attorneys, and others about local, statewide, and national diversity initiatives. He is president of the Capital District Black and Hispanic Bar Association, co-chair of the New York State Bar Association Committee on Minorities in the Profession, and a member of the New York State Bar Association’s (NYSBA) statewide Committee on Diversity and Leadership Development. John is also a member of the NYSBA’s House of Delegates and a member of the American Bar Association’s Presidential Advisory Council on Diversity.
