Farrell Fritz Represents Manufacturers in Significant Real Estate Acquisitions
Farrell Fritz, P.C. has represented manufacturers in the pharmaceutical and specialty food products industries in expanding the manufacturing operations on Long Island. Bucking the trend of relocating manufacturing outside of New York State, these companies have determined to make significant capital expenditures in Suffolk County to purchase, renovate and retrofit existing buildings to allow them to produce a greater number of sophisticated product lines and grow their businesses.

On July 25, 2006, Peter Curry and Wendy Forrest of Farrell Fritz assisted an affiliate of A&Z Pharmaceutical Inc. in acquiring 75 North Industry Court, Deer Park, New York, an approximately 78,000 square foot facility on a three acre parcel, for use for the manufacture of premium-quality overthe- counter pharmaceutical products and nutritional supplements. A&Z's relocation from its existing Hauppauge premises became necessary due to the explosive growth of its sales in its domestic and international markets, and the need to increase its workforce. The Deer Park building will house the head office, research & development, and manufacturing operations of the company. To enable A&Z to acquire the facility and undertake the necessary renovations, The Town of Babylon Industrial Development Agency provided economic development incentives in the form of real estate tax, mortgage tax and sales tax abatements. Tom Attivissimo of Greiner Maltz of Long Island and Bob Desmond of AIRECO Real Estate Corp. acted as the brokers for the transaction.

On the following day, Mr. Curry and Ms. Forrest represented an affiliate of Kangadis Food Inc. d/b/a The Gourmet Factory in the purchase of 55 Corporate Drive, Hauppauge, New York. This 75,000 square foot building, located on more than four acres, will serve as the manufacturing facility for the production and packaging of high quality olive oil and other specialty food products for distribution throughout the United States. Approximately 100 employees will eventually work in the building. The Gourmet Factory is relocating from Queens County due to the lack of comparable affordable space, and will make significant renovations to the premises. Newmark Knight Frank's Ralph Perna brokered the transaction on behalf of the seller.

In each case, the new owners will bring the underutilized buildings up to current standards of operation, greatly increase the amount of employment, and bring Long Island a leader in its field. Mr. Curry stated, "It was an enormous pleasure working with each of these companies. I believe that they are on the Island to stay, that they will continue to grow, and that they will bring new recognition to our prowess in the areas of specialty manufacturing. I welcome A&Z and The Gourmet Factory to their new facilities, and look forward to working with them in the future.

Fleming Appointed to Two New Positions Within the ABA
Michael Fleming, attorney with the firm's Intellectual Property, Technology and Internet practice group, was appointed to two new positions within the American Bar Association. Both positions key in on using technology to deliver legal services.

Commission on Second Season Service: The incoming president of the ABA, Karen Mathis, appointed Fleming to the Second Season of Service Commission (SSS). SSS is an effort that focuses on lawyers who are trying to transition into the 'second season' of their careers by helping them connect with those they want to serve. Second service may include pro-bono work, public service, lower-key private practice and other strategies lawyers might be able to use. Fleming is a member of the technology subcommittee of the SSS, which is looking into developing systems that will help deliver the messages and make connections.

Standing Committee on Technology & Information Systems: Fleming was also appointed as the Business Section's liaison to the Standing Committee on Technology and Information Systems (SCOTIS). SCOTIS is in charge of the entire IT system for the ABA and Fleming will represent the Business Section's interests in the ABA's investments and management of its systems.

Greenberg Traurig Law Firm and Judge Caroline Baker Team with Aspiring Youth and Comets to Host Inaugural “From One Court to Another Court” Event
The international law firm Greenberg Traurig is teaming up with Aspiring Youth of Houston’s T.A.S.T.E.™ (Take A Student To Your Employment) program and the Houston Comets to host the “From One Court to Another Court” event on Thursday, August 17, 2006. This is the first time that this “Court to Court” event has taken place.

This event provides an opportunity for up to 25 Houston-area Aspiring Youth students to tour the new Harris County Civil Courthouse and later enjoy the Comets’ Playoff game on a different type of court. The students are from B.C. Elmore Middle School in North Forest ISD, an underserved area of Houston.

The evening will begin with a tour of the courthouse and an opportunity to meet with Judge Caroline Baker of the 151st District Court. Judge Baker will meet with the students to discuss the importance of education and hard work. Following the tour, the students will go back to the Greenberg Traurig offices for dinner and a discussion with the firm’s attorneys. Greenberg Traurig Shareholder Shari Heyen, Associates Dianna Jones and Mark Correro, and Business Director and Founder of Aspiring Youth John Meredith will address the group before going to the Houston Comets’ game.

“This is a wonderful opportunity for us to get involved in the Aspiring Youth T.A.S.T.E. program and allow the students a glimpse of what it’s like to be an attorney. The students have the opportunity to hear attorneys talk about how hard work, an education and determination lead to a successful future. I know that this experience will be as beneficial for the attorneys as it is for the students,” stated Shari Heyen.

Diamond Sawblades’ Manufacturers Coalition Launches Federal Appeal of ITC Decision
The Diamond Sawblades Manufacturers’ Coalition (DSMC) filed a complaint today at the U.S. Court of International Trade against the International Trade Commission’s determination that American diamond sawblade manufacturers were not injured by dumped imports from China and Korea.

The DSMC originally filed petitions for trade relief against unfairly priced imports of diamond sawblades (and parts thereof) from China and Korea in June 2005. Subsequently, the International Trade Commission preliminarily found a reasonable indication of material injury due to imports to domestic producers of diamond sawblades, and the Department of Commerce preliminarily and finally determined that imports were entering the country at unfair prices. However, the International Trade Commission determined in June 2006 that the domestic manufacturers were not injured by the unfairly priced imports. Had the Commission made an affirmative final determination, antidumping duty orders would have been issued and U.S. Customs and Border Protection instructed to collect cash deposits on imports of subject merchandise.

“The International Trade Commission’s decision surprised and disappointed the domestic industry,” said Daniel B. Pickard, a partner in Wiley Rein & Fielding LLP’s International Trade Practice and counsel to the DSMC. “While the Commission stated that there is a lack of competition between domestic sawblades and imports, the record of the case clearly does not support such a decision.”

The lawsuit filed by the DSMC will proceed in the U.S. Court of International Trade. The case against the International Trade Commission focuses on the agency’s finding of a lack of competition between imported and domestically produced sawblades. Complaints also have been filed against the Department of Commerce’s determination that resulted in lower dumping margins against Korean and Chinese imports than were merited.

Court Upholds Constitutionality of Subway Bag Inspections
The firm recently represented a variety of organizations and individuals on a pro bono basis in connection with MacWade v. Kelly, et al., 05 Civ. 6921 (RMB) (S.D.N.Y. Dec. 5, 2005), aff'd, --- F.3d ---, No. 05-6754-cv (2d Cir. Aug. 11, 2006), a case with significant national security implications that has received widespread media attention. The case involved a challenge to the NYPD bag inspection program, instituted shortly after the July 2005 London underground bombings. Shortly after the program was instituted, five plaintiffs challenged the program on Fourth Amendment grounds. We argued, on behalf of amici curiae in pre-trial and post-trial submissions at the district court level and before the United States Court of Appeals for the Second Circuit, that that there is a significant terrorist threat to urban mass transportation systems, that plaintiffs’ proposed analysis was unduly restrictive and inconsistent with established Fourth Amendment precedent and that, if accepted, it would unduly hamper law enforcement efforts to combat terrorism. The district court upheld the program and, on August 11, 2006, the Second Circuit affirmed on grounds that were in accord with each of the arguments asserted by amici.

The amici included the Washington Legal Foundation (public-interest law and policy organization based in Washington, D.C.), Families of September 11, Inc. (a nonprofit organization founded in October 2001 by families of those who died in the September 11 terrorist attacks), Rep. Peter T. King (chairman of the House Committee on Homeland Security), Rep. Ginny Brown-Waite (member of the House Committee on Homeland Security), New York State Senator Marty Golden (member of the New York Senate’s Committees on Veterans, Homeland Security, and Military Affairs), New York Assemblymen Vincent Ignizio and Matthew Mirones, Minority City Council Leader James Oddo, the Allied Educational Foundation (a non-profit charitable foundation founded in 1964), and Steven M. Flatow, (a resident of New Jersey whose daughter was killed by the Palestinian Islamic Jihad on a bus bombing while studying abroad in Israel through Brandeis University).
