Pension Protection Act of 2006
Years of negotiations, lobbying efforts, and political posturing have finally culminated in comprehensive pension reform, as the House of Representatives and the Senate passed H.R. 4, the "Pension Protection Act of 2006", on July 28th and August 3rd, respectively. The President is expected to sign the bill into law on August 17th. We attach detailed summary comparisons of current law and the principal provisions of H.R. 4, the Pension Protection Act – in separate packages focusing on defined benefit and defined contribution plans. We also attach a separate side-by-side that focuses on the many ERISA fiduciary changes in the legislation.

We are currently forming various coalitions for identifying and drafting technical corrections to the bill. We also have identified a number of regulation projects that the Treasury Department and the Department of Labor have been directed to undertake and intend to work closely with these agencies to not only assist them in their drafting efforts, but to craft the new rules in ways that are most favorable.

Jeffrey A. Wurst, Esq. Named President of the New York Institute of Credit
Ruskin Moscou Faltischek, P.C. announced today that Jeffrey Wurst, partner and chair of the firm’s Financial Services, Banking, & Bankruptcy Department, has been named President of the New York Institute of Credit (NYIC).

Founded in 1918, the New York Institute of Credit is a non-profit educational organization that sponsors topical seminars addressing the intricate profession of credit granting or bank lending during the year, provides students with the opportunity to take specialized workshops and presents day programs consisting of workshops in various parts of the United States.

In addition to his responsibilities for the business of the Institute, Wurst will oversee educational programs presented to the financial services and credit industries. He plans to place special emphasis on activity in the Long Island marketplace. Wurst previously served as the NYIC’s Vice President of Finance and has also served on the Board of Directors for a number of years.

“We are facing challenging times in the credit industry,” said Wurst. “I feel it is important, especially here in Long Island, to have a strong grasp of the credit issues so as to avoid potential injury to our businesses as the credit market tightens up.”

In addition to the NYIC, Wurst also serves on the Executive Committee of Turnaround Management Association International, chairing its Chapter Resource & Response Council. He also serves on the Board of Directors of the Association of Commercial Finance Attorneys, and from 2000-2005 he served on the Board of Directors of Harvey Electronics, Inc., a public company, after having represented the group acquiring a majority interest through its Chapter 11 proceedings.

Federal Judge Exempts Liggett From Remedies In DOJ Action
Federal District Judge Gladys Kessler issued a Final Judgment and Remedial Order, accompanied by a 1,700-page opinion, in the Department of Justice's lawsuit against the major cigarette manufactures. Judge Kessler's order requires that all of the manufacturers, with the exception of KBT&F's client Liggett Group, are subject to various forms of injunctive relief and must pay the government's costs for pursuing the lawsuit. As to Liggett, Judge Kessler credited the company for cooperating with state and federal officials in their investigations of the tobacco industry and for having "changed the face of tobacco litigation in this country and....distanc[ing] itself from the other Defendants." Liggett's defense during this seven-year case (and nine-month trial) was led by KBT&F partners Aaron Marks and Leonard Feiwus and associates Nancy Straub and Michael Rosenstein.

Greenberg Traurig Expands its Tax Practice in New York with the Addition of Robert M. Miller
The international law firm Greenberg Traurig, LLP announced today that Robert M. Miller has joined the firm as a shareholder in the Tax practice in the New York office. Mr. Miller previously served as Tax Counsel for Intel Corporation. Prior to working at Intel, he was a Tax/Corporate attorney at Davies Ward Phillips & Vineberg, LLP. He has experience with clients in industries including investment/commercial banks and financial services, media and entertainment, hi-tech, telecommunications, pharmaceuticals, medical equipment, chemicals, mining, paper, and packaging, as well as tax-exempt entities.

“Bringing Robert to Greenberg Traurig will add significant talent to our already extensive national and local tax capabilities,” said Richard A. Rosenbaum, Managing Shareholder of the New York office and National Operating Shareholder.

“Robert’s extensive experience serving clients in a variety of industries makes him an excellent addition to our existing tax practice,” said Barbara T. Kaplan, who chairs the New York Tax Practice. “His comprehensive knowledge garnered from working in the financial institutions and services, hi-tech, and telecommunications sectors, among others, will further augment our ability to serve clients and their specialized tax needs in a collaborative and business-oriented style.”

Mr. Miller earned his LL.M. from New York University School of Law, his J.D. from University of Texas School of Law, and his B.A., with high honors, from the State University of New York at Stony Brook where he was Phi Beta Kappa.

Calfee Welcomes 2006 Fall Class
Calfee is proud to announce the 2006 fall class of associates who have joined the firm:

Trevor Alexander joins the Litigation group in our Columbus office. He is a graduate of The Ohio State University College of Law and received his undergraduate degree from Capital University.

Mark McDougall, formerly a mechanical engineer with General Motors and an IT consultant with Accenture, joins Calfee as an associate in the Intellectual Property group in Cleveland. He is a graduate of Case Western Reserve University School of Law and earned his B.S. in mechanical engineering from The Ohio State University.

Michael Olshavsky also joins our Intellectual Property group in Cleveland. He previously was a research associate with International Paper Co. and a senior scientist with Procter and Gamble. Michael received his law degree from Northern Kentucky University, Chase School of Law; his Ph.D in polymer chemistry from Penn State University; his M.S. in inorganic chemistry from University of California, Berkeley; and his B.S. in chemistry and physics from University of Toledo.

"When the Economy Is Good, Law Firms Do Better"
Jaroslaw Grzesiak, managing partner of the Warsaw office, was interviewed for a report on the legal market in Poland, looking at the improved financial results resulting from the recent upturn in the business. Mr. Grzesiak points out the difference between local and international law firms in Poland and how the latter benefit from their reputation on international markets. As far as referrals and recommendations are concerned, he sees that a law firm's best recommendation is a job well done. The opinion of the client's financial advisers, auditors and bankers play an important role, as well as referrals made by the other offices in a firm's network. With regard to public tenders, Mr. Grzesiak observes that few law firms are eager to participate in such tenders due to the time consuming process and the low chances of winning - Dewey Ballantine participates in tenders where the price is not the only criterion. Key mandates are won by those who have the ability to talk about the business aspects of a transaction, with an understanding of client needs. In his opinion the Polish legal market remains very competitive, but adds that there has been more work in the past two years than in 2001-2004. He argues that the competition is keenest among the ten largest international law firms, and that the efforts of individual partners to attract work are the key to success, with marketing activity being an important tool in helping shape a law firm's image.
