Business of the Year
St. Louis Mayor Francis G. Slay and city development officials presented the city’s annual business awards at the City of St. Louis Business Celebration Luncheon. Blackwell Sanders was named one of the “Businesses of the Year” for demonstrating its commitment to Downtown St. Louis and extending its lease at the Laclede Gas Building.

Blackwell Sanders was one of 11 business recognized as “Business of the Year.” Also under this category, 28 long-time neighborhood businesses were honored for their commitment to “enhancing the quality of life of the neighboring residents and customers.”

Partner Craig Biesterfeld accepted the award on the firm's behalf at the September luncheon.

Thacher Proffitt Re-elected Paul Tvetenstrand as Chairman and Managing Partner
Thacher Proffitt announced today that the Partnership has re-elected 47-year-old Paul D. Tvetenstrand to the position of Chairman and Managing Partner of the Firm. Mr. Tvetenstrand was elected in February 2003 to this position, succeeding Omer S.J. “Jack” Williams, who had been Chairman and Managing Partner of the Firm for the previous 12 years.

In the last four years, Thacher Proffitt has increased its lawyer headcount by 75% or 133 attorneys – from 182 attorneys at the end of 2002 to 315 attorneys today. Over the same period, revenues have increased 125% to $190 million and profits per partner have more than doubled to $1.3 million.

“I am proud of the success we have had over the past several years,” said Mr. Tvetenstrand. “We have grown every practice group, and we will continue to focus on further strengthening our Firm while remaining committed to bringing legal services of the highest quality to our clients.”

About Paul D. Tvetenstrand

Mr. Tvetenstrand is a partner in the Structured Finance Practice Group, concentrating in mortgage-backed securities. He has represented several investment banking firms as issuers or underwriters in public offerings and private placements of mortgage pass-through certificates. These securitizations have employed a wide variety of credit support and tax structures, and have resulted in the issuance of a broad range of securities with simple to complex payment characteristics. In addition, he has represented several of the nation's largest residential mortgage loan conduits in connection with numerous public offerings of multiple class mortgage pass-through certificates. He also advises servicers and insurers in connection with public and private securitizations. He received both his law degree and his B.S. in chemical engineering from Columbia University – his B.S. in 1982 and his J.D. in 1983.

STB Represents Underwriters in Global Notes Offering By POSCO
The Firm recently represented the underwriters in a US$300,000,000 offering of 5.875% Notes due 2016 issued by POSCO (the ""Notes""). POSCO is the largest and the only fully integrated steel producer in Korea, and one of the largest steel producers in the world. This global offering was underwritten by a group of international managers consisted of ABN AMRO, HSBC and UBS, and the Notes were sold outside the US in reliance on Regulation S. The Notes are listed on the Singapore Stock Exchange.

Simpson Thacher has in the past represented the underwriters in several global offerings by POSCO, including its exchangeable bonds in 2003 and American depositary shares.

The Simpson Thacher team included Jin Hyuk Park, Anthony Choi, Kristina Kang, Changsu Oh and Woojae Kim in Hong Kong.

Lewis and Roca Ranked in Trademark Filings
A recent survey conducted by Trademark Insider ranked Lewis and Roca partner Michael McCue as the top Las Vegas trademark attorney in number of United States trademark applications submitted for both the second quarter and year-to-date in 2006. Nationwide, Mr. McCue ranked as the thirteenth top trademark attorney during the second quarter of 2006 and 22nd in year-to-date filings. The quarterly survey recognizes the top 50 trademark attorneys, determined by the number of United States trademark applications submitted, in which the attorney was listed as the legal representative. McCue received his J.D. from the University of Virginia School of Law and his B.A. in Economics and Psychology from the University of Virginia.

Lewis Joins JS&H as Partner
Jones, Skelton & Hochuli is pleased to announce that Gordon Lewis has joined the firm as a partner. Mr. Lewis will concentrate his practice on employment and education law.

Mr. Lewis received his J.D., summa cum laude, from the University of Arizona College of Law in 1993. Prior to joining the firm, Mr. Lewis practiced employment, education, and health care administrative law at Jennings Strouss & Salmon. He is licensed to practice in Arizona, Nevada, the U.S. District Court, District of Arizona and the U.S. Court of Appeals, Ninth Circuit.

Mr. Lewis currently serves as Vice President of the Community Legal Services Board of Directors. Amicus Brief Opposes Mandatory Deportation of Non-Citizens For Low-Level Simple Possession
Mere possession of illegal drugs does not constitute “trafficking” and should not trigger deportation proceedings under the Immigration and Nationality Act (INA), according to an amicus brief recently filed by Jenner & Block Partner David W. DeBruin and Associate Iris E. Bennett in the U.S. Supreme Court case Jose Antonio Lopez v. Alberto Gonzales, on behalf of the American Bar Association.

At issue in the case is whether the Petitioner, a permanent U.S. resident, should face mandatory deportation to Mexico for the aiding and abetting of cocaine possession in South Dakota, which is a felony under that state’s law. The Court is reviewing conflicting interpretations by federal courts of the Act’s application to illegal drug felonies under state law.

According the brief, some courts have held that low-level possession offenses like the Petitioner’s, which do not involve the trafficking of illegal drugs and are misdemeanors under federal law, are illicit trafficking aggravated felonies under the INA provision because the offenses are state-law felonies.

Other courts have held that similar offenses which do not involve trafficking and are misdemeanors under state law are illicit trafficking aggravated felonies under the INA merely because repeat misdemeanors may be prosecuted as federal-law felonies.

Under these decisions, a permanent resident will face the severe consequence of mandatory deportation for “illicit trafficking” even when convicted only of a low-level simple possession offense.

The brief argues that the statutory text, structure, and legislative history compel a narrow reading limited to felonies that actually involve trafficking. “Congress knew how to, and did, distinguish between felons and misdemeanants,” wrote the authors. In addition, simple possession does not as a matter of statutory construction constitute “illicit trafficking.”

The brief further analyses, reflecting the perspective of legal actors in the criminal justice system, how imposing mandatory deportation for low-level possession offenses results in a drastic disparity between the direct and collateral consequences of such convictions, with the collateral immigration consequence typically being by far the most severe. The authors conclude that such disparity adversely affects the integrity of the criminal justice system and its administration, and is one of several reasons why, even if the statute were ambiguous, it should be interpreted leniently.
