Miller Johnson is West Michigan’s top estate planning law firm
Miller Johnson captured the number one spot for the fourth year in a row on the Grand Rapids Business Journal’s “Top Area Estate Planning Law Firms” list, published in the Oct. 23 issue. Firms are ranked by the number of new estate planning clients, based on 2005 numbers.

Miller Johnson, with eight attorneys dedicated to estate planning in 2005 and 16 staff, added 724 new estate planning clients last year and billed nearly 19,000 hours.

“It is really nice to be recognized by the Grand Rapids Business Journal for our hard work, but our measure of success is really based on client satisfaction rather than on numbers,” said Carol Karr, chair of the firm’s Probate and Estate Planning practice group. “Making sure our clients get what they need and are content with their estate plans is our goal.”

Court of Appeals Holds That Landlord Cannot Be Held Liable And Has No Duty To Provide Radiator Covers
Congratulations to Steven B. Prystowsky and Harry Steinberg on winning a Court of Appeals ruling that a residential landlord has no duty to provide radiator covers and cannot be held liable for not doing so even where the apartment tenants had requested such covers. Aaron Rivera, the child of the tenants, was injured when he climbed onto an uncovered radiator in his parents' bedroom where he was playing, unsupervised. Aaron, by his parents, sued the landlord claiming it breached its duty to maintain the premises in a safe condition. The Court of Appeals rejected both plaintiff's common-law and statutory arguments. First, the Court of Appeals held that plaintiff could not state a common-law negligence claim because the radiator was not defective and no duty was imposed by Multiple Dwelling Law Section 78 which requires that premises be maintained in safe condition. Second, the Court of Appeals rejected plaintiff's claim that Administrative Code Section 27-809, which requires pipes and risers to be insulated, applied. The court held that a radiator was not a pipe or a riser and that a radiator cover was not insulation. The court also held that while people might not be on notice that a pipe was hot, they are on notice that radiators are hot so the rationale that requires pipes to be insulated did not apply to radiators.

Timothy R. Pomeroy Joins Klinedinst's Environmental Law Group
The business attorneys at Klinedinst PC are pleased to announce that Timothy R. Pomeroy has joined the San Diego legal team.

Before coming to Klinedinst, Mr. Pomeroy served in the United States Air Force as an attorney in the Judge Advocate General's Corps (JAG). Much of his work focused on complex environmental legal issues facing the military. He would regularly advise commanders on relevant federal and state environmental statutes, as well as ensure compliance at almost two dozen hazardous waste sites. He drafted legal reviews on a diverse range of topics, including environmental policy, and participated in environmental audits.

In addition to complex environmental work, Mr. Pomeroy handled military justice and adverse actions, including courts-martial proceedings. In one posting, he prepared over 100 tort claims at one of the world's busiest Air Force claims offices. He would also be called on to advise military hospital and regional medical counsel on various legal issues, and participate in post-trial and clemency matters. While serving at Los Angeles Air Force Base, he even coordinated the base's Victim and Witness Assistance Program.

One of the highlights of his JAG service came when Mr. Pomeroy was handpicked by the Pentagon to help diffuse the international scandal that erupted over prisoner mistreatment at Forward Operating Base Abu Ghraib. During his assignment in Iraq, he advised the facility commander, staff and interrogration teams on applicable law and policy involving the base's detainee population. Working under intense international scrutiny, he was able to ensure 100% case accountability, even under combat conditions.

"Timothy is a tremendous attorney who is able to get the job done, even under the most extreme circumstances," noted John D. Klinedinst, CEO of Klinedinst PC. Mr. Pomeroy graduated from Pepperdine University School of Law in 2001, with a Juris Doctor and Master of Dispute Resolution. During law school, he participated in the Willem C. Vis International Commercial Arbitration Moot competition in Vienna, Austria. He was also named Managing Editor of Dispute Resolution Law Journal, and was a founding Board Member for the Center for Entrepreneurship and Technology Law. During law school, he worked as a Legal Intern with the National Association of Securities Dealers (NASD) in their Los Angeles office. He received his undergraduate degree from Brigham Young University with a B.S. in Psychology.

HILL WALLACK LLP WORKERS’ COMPENSATION PRACTICE GROUP ATTORNEYS PRESENT SEMINAR
Members of Hill Wallack LLP’s Workers’ Compensation Practice Group were recently panelists at the Council on Education in Management Seminar “New Jersey Workers’ Comp Update 2006”. Partners of the firm’s Workers’ Compensation Practice Group, Craig W. Summers and Marc Harlan Herman together with associates, Denise A. DaPrile and Kenneth W. Thayer discussed solution-oriented workers’ comp updates. They presented claims management best practices for handling preexisting injuries and repeat claimant and proactive strategies for reducing out of control workers’ comp costs while associate, Jae H. Cho discussed ADA and FMLA issues.

The Workers’ Compensation Practice Group represents major self-insured corporations, insurance companies and clients of third-party administrators in the defense of workers’ compensation claims, as well as defense of tort liability, environmental litigation and automobile dealer litigation.
