Attorney Michael Chesal Appointed by the Florida Bar to serve on the Inaugural Committee for Intellectual Property Law Certification.
Kluger Peretz Kaplan & Berlin is pleased to announce that Michael B Chesal, a Member of the firm, practicing in Intellectual Property Law, has been appointed by the Florida Bar President, Henry M. Coxe, III, to serve on the Intellectual Property Law Certification Committee which will oversee the inaugural board certification processes for Intellectual Property Law. The nine-member certification committee will review credentials for the first class of applicants, develop policy to implement standards approved by the Florida Supreme Court, and draft and administer the first examination.

The rules regulating the Florida Bar require the initial appointees to the Certification Committee to be “eminent attorneys in the practice field, members in good standing and admitted to The Florida Bar no less than 10 years.”

Chesal holds a J.D., cum laude, from the University Of Miami School Of Law and a B.S.B.A., cum laude, from the University of Florida. A member of the Florida Bar since 1988, Michael joined Kluger Peretz Kaplan & Berlin in May of 1991 where he followed his interest in developing a practice protecting and defending trademarks, copyrights, and other intellectual property. He is admitted to practice in the U.S. District Court, Southern and Middle Districts of Florida, the U.S. Court of Appeals, Eleventh Circuit, and the U.S. Supreme Court.

Certification is the highest level of recognition by the Florida Bar of the competency and experience of attorneys in the 22 areas of law approved for certification by the Florida Supreme Court. Attorneys who become board certified also are evaluated as to their character, ethics, and professionalism.

South Florida Firm Serves as Florida Counsel in a $1.1 Billion Purchase
Kluger, Peretz, Kaplan & Berlin represented Empire Group Holdings LLC as Florida counsel in a billion-dollar, national real estate deal that concluded Thursday, October 5, 2006.

Empire, a privately held company based in Montvale, N.J., purchased the Lexford Housing Division, which is comprised of 289 properties in 10 states and a property management business based in Reynoldsburg, Ohio, consisting of approximately 800 employees.

Kluger, Peretz, Kaplan and Berlin assisted Dreier LLC, a New York City-based firm and Empire’s Chief outside counsel, with the Florida portion of the complex transaction, which covered 85 properties owned by a comparable number of entities and located in 28 counties throughout the state.

Kluger, Peretz, Kaplan and Berlin’s team included Eliot C. Abbott, Jon Chassen, Dale S. Bergman, associate Karyl Argamasilla, and two paralegals. The team’s primary responsibility was to ensure that the sale and the extensive acquisition financing documentation complied with state law.

David Cost Joins Hiscock & Barclay Law Firm
David M. Cost (Schenectady resident) joins the Albany office of Hiscock & Barclay, LLP as an Associate Attorney.
Cost concentrates his practice on commercial litigation. He also handles torts, insurance and products liability litigation issues. Cost is a graduate of University at Buffalo Law School, The State University of New York, (J.D., 2006) and Hamilton College, (B.A., 2003). His admission to the New York State bar is pending.

Daley and Skiff Join Hiscock & Barclay Law Firm
Kathryn M. Daley and Matthew J. Skiff join the Syracuse office of Hiscock & Barclay, LLP as Associate Attorneys.

Daley (Liverpool resident) concentrates her practice in the area of litigation, focusing on complex commercial litigation and intellectual property litigation. Daley, whose admission to the New York State Bar is pending, is a graduate of Cornell Law School (J.D., 2006) and University of Rochester (B.A., 2003).

Skiff (Syracuse resident) focuses his practice on torts and products liability defense and professional malpractice defense.

Vivendi Sues Deutsche Telekom for $7.5 Billion Under RICO Act
In a dramatic move, one European telecommunications giant is suing another in American courts using the Racketeer Influenced and Corrupt Organizations (RICO) Act. On October 23, the Paris-based Vivendi used RICO to sue the Bonn-based Deutsche Telekom in United States District Court in Seattle. Contending that American phone networks were used to send e-mail messages as part of an organized scheme to defraud Vivendi of its control of the Polish carrier Polska Telefonia Cyrfrowa (PTC), Vivendi is suing for the treble damages allowed under RICO—or $7.5 billion.

The New York Times sought commentary from Blank Rome partner Jerry D. Bernstein:

“Deutsch Telekom is expected to file a motion to dismiss the case, contending that the American courts do not have jurisdiction over the events, said Jerry D. Bernstein, a partner at Blank Rome who runs the firm’s white-collar, internal and governmental investigations practice and is not involved in the dispute. Then the company will probably challenge whether the RICO statues apply to a commercial dispute.

Haskell Slaughter's Driver Leads The Women Lawyers Section of The Birmingham Bar to Double Team Ranks and Triple Fundraising For 2006 Komen Race
Haskell Slaughter Young & Rediker, LLC Associate Khristi Doss Driver recently served as Team Captain for the Birmingham Bar Association Women Lawyers Section team for this year's Susan G. Komen Breast Cancer Foundation Race for the Cure. The event took place on Saturday, October 14 in downtown Birmingham's Linn Park. Under Ms. Driver's leadership, the team - informally called "Pinstripes & Pearls" - doubled its size to 13 members and included one breast cancer survivor. The team also tripled the annual funds raised to $3335.00, to date.

About the Susan G. Komen breast cancer Foundation
The mission of the Susan G. Komen Breast Cancer Foundation is to eradicate breast cancer through research, education, screening, and treatment. The North Central Alabama Affiliate of the national organization was formed in 1994. Locally, 75% of the net profits fund non-duplicative, community-based breast health education and breast cancer screening and treatment projects for the medically underserved. The Komen Race for the Cure Series is the largest series of 5K runs/fitness walks in the world. The 2006 series marks the 23rd anniversary of the Race, and more than 1 million people are expected to participate in more than 100 Races around the United States. This year also marked the 15th Anniversary of the Komen Birmingham Race.

ABOUT KHRISTI DOSS DRIVER
Khristi Doss Driver has participated in the Komen Race for the last three years. Her next community service effort will be coordinating Haskell Slaughter's participation in the YWCA Santa's Workshop event, providing holiday gifts to homeless mothers and their children.

Ms. Driver's practice is focused on civil trials and appeals. She has represented insurers and insureds in a wide variety of matters, including products liability, insurance coverage matters, property and casualty claims, fraud, bad faith and punitive damages claims, construction disputes and employment discrimination cases. Ms. Driver was awarded full scholarships to both the University of Alabama and Cumberland School of Law. At law school, she was active in both trial advocacy competitions and the Cumberland Law Review. Currently, Ms. Driver is an active member of the Entertainment Committee of the Birmingham Bar Association.
