Baumann Joins Evans & Dixon, L.L.C. as Human Resource Manager
Cynthia H.K. Baumann (photo) has joined Evans & Dixon, L.L.C. as human resources manager.

In her new position, Baumann is responsible for all recruiting and employee relations issues. She brings to Evans & Dixon four years experience in human resources for legal, medical and governmental organizations. Baumann’s career history includes human resource positions with Esse Health and two other local law firms.

She currently is working to obtain a master’s degree in human resource management/human resource development from Webster University.

Pennsylvania Legislature to Consider New Requirements for Jury Instructions
The Pennsylvania House Judiciary Committee is now considering a bill to require the following of all jury instructions: “All instructions to a jury regarding applicable law and conduct of deliberations shall be in plain and understandable language. Each juror shall be provided with a written copy of the instructions for use during deliberations.

Troutman Sanders And American Cancer Society Team With Atlanta Legal Aid Society To Launch Cancer Pro Bono Project
Troutman Sanders LLP is pleased to announce a new pro bono alliance with the American Cancer Society and the Atlanta Legal Aid Society. Through this alliance, the law firm will provide free basic estate planning services on a pro bono basis to low-income individuals with cancer in the Atlanta metropolitan area.

“Estate planning is an essential part of dealing with a life threatening illness,” said Sarah G. Isabel – member and project coordinator, Troutman Sanders’ Atlanta Pro Bono Committee. “However, it is frequently overlooked or avoided because of cost and a lack of education about end-of-life or incapacitation decision making.”

Troutman Sanders attorneys will provide pro bono services that include the drafting and execution of documents, such as Last Will and Testament, Financial Power of Attorney, Health Care Power of Attorney, Living Will and Nomination of Guardian.

Cancer patients needing legal assistance on basic estate planning should contact the American Cancer Society at 800-227-2345.

The American Cancer Society is dedicated to eliminating cancer as a major health problem by saving lives, diminishing suffering, and preventing cancer through research, education, advocacy and service. Founded in 1913 and with national headquarters in Atlanta, the Society has 13 regional divisions and local offices in 3,400 communities, involving millions of volunteers across the United States.

Atlanta Legal Aid Society, Inc. provides civil legal services to persons with very low income in Fulton, DeKalb, Gwinnett, Clayton and Cobb counties. Last year, Legal Aid attorneys assisted over 50,000 people and handled over 20,000 cases, primarily involving housing, family, and senior citizens issues. Begun in 1924 by 17 attorneys, Atlanta Legal Aid has meant access to justice for countless individuals, who might otherwise be shut out of an increasingly complex legal system because they do not have the money to hire a lawyer.

2007 Environmental Community Service Award Raising Awareness of Environmental Concerns with Schools Throughout the Delaware Valley Region-Wide Collaboration Spearheaded by Wawa, NBC 10 and Manko, Gold, Katcher & Fox, LLP
With the success of last year’s first Environmental Community Service Award, Wawa, NBC 10, and the environmental law firm of Manko, Gold, Katcher & Fox, LLP (MGKF) have joined together once again to create the Second Annual Environmental Community Service Award,. The goal of the award is to raise awareness of environmental concerns and to encourage middle and high schools in the Delaware Valley to participate in a community service project that will enhance and improve the quality of life in their community.

The first year of the award was a great success and the winners were Friends Central Middle School and Camden High School. Each received a $5,000 honorarium to further their environmental programs. The applications for this year’s Environmental Community Service Award will be available online at www.wawa.com, www.nbc10.com and www.mgkflaw.com. The deadline is Friday, February 23, 2007. Winners will be announced just prior to Earth Day, Sunday, April 22, 2007.

To launch the Environmental Community Service Award, a kick-off event was held on Wednesday, October 25 in the “10!” Show studio at NBC 10 in Philadelphia. Meteorologist Amy Freeze served as host with Robb Fox, partner of MGKF. Students concerned about the environment attended from schools throughout the region. It was an opportunity for the students to express the issues they find most worrisome about the environment and to ask questions of expert guests.

The judges of this educational competition are representatives from The Franklin Institute, the Academy of Natural Sciences, from Pennsylvania and New Jersey’s Department of Environmental Protection and Delaware’s Department of Natural Resources and Environmental Control including individuals from each of the sponsoring organizations.

Harleysville Insurance Company wins Environmental Coverage Case
Riker Danzig Scherer Hyland & Perretti LLP announced that its client, the Harleysville Insurance Companies, won an important environmental coverage case involving contamination at a retail gasoline station in Hunterdon County.

The plaintiff sought coverage for contamination caused by a one time gas leak that it claimed occurred in 1983. Using documentary evidence from the NJDEP and by engaging hydrogeologists to evaluate the aquifer and speed of the groundwater, Riker Danzig attorneys refuted the testimony of the station owners and operators as to the source and date of the release of gasoline, and presented evidence that the contamination occurred after 1986, when Harleysville would have no responsibility to supply coverage due to the absolute pollution exclusion. In addition, The Honorable Victor Ashrafi J.S.C. determined that, based on historical documents from the supplier as well as the competing opinions of scientific and industry experts, the plaintiff did not prove that the supplier used MTBE, a chemical used as an additive in its gasoline, prior to the time of the alleged 1983 leak, and therefore was unable to establish causation between the alleged 1983 incident and the subsequent MTBE contamination at the site.

Riker Danzig partner Lance Kalik, lead attorney for Harleysville, notes that the case is significant because, “it demonstrates that courts will continue to require the policyholder to bear the burden of proof in proving an occurrence during the policy period, even in these historical discharge cases. This is particularly appropriate where, as in this case, the station owner did not inform the carrier of the claim until years after the alleged incident. The station owner's recollection of events may not carry the day for the policyholder when there is other evidence tending to dispute the source or nature of the discharge.”

Competition Authority blocks acquisition by Kingspan of Xtratherm
The Competition Authority announced on 26 October 2006 that it has decided to block the proposed acquisition of Leanort Group (Xtratherm) by Kingspan Group plc (Kingpsan) on the grounds that such a transaction would substantially lessen competition in the manufacture and provision of insulation materials in the State.

As a result the acquisition may not be put into effect.

The Competition Authority’s determination follows a four-month market investigation by the Authority’s Mergers Division.

It is only the second time the Competition Authority has blocked a proposed merger since the provisions of the Competition Act regarding merger control came into effect in January 2003. The first such case involved IBM and Schlumberger in October 2004.

The Competition Authority has stated that it will publish its determination on or before 25th November 2006 in accordance with its obligation under section 22 of the Competition Act 2002 to publish its determination within one month. We will provide a further update then.

Either party may appeal to the High Court the Competition Authority’s determination pursuant to section 24 of the Competition Act 2002. Such an appeal must be made within one month after the date on which the undertaking concerned was informed by the Authority of the determination.

Larry P. Schiffer, Reinsurance Litigation Partner, Receives the Edmund S. Muskie Pro Bono Award from the American Bar Association
Larry P. Schiffer, a partner in the litigation and dispute resolution practice of LeBoeuf, Lamb, Greene & MacRae LLP, was awarded the Edmund S. Muskie Pro Bono Award from the Tort Trial and Insurance Practice Section (TIPS) of the American Bar Association. The award was presented on October 21, 2006, at the Section Leadership Dinner at the TIPS Fall Planning meeting at Pinehurst, North Carolina.

The Edmund S. Muskie award is presented annually to the member of the Tort Trial and Insurance Practice Section who has provided outstanding pro bono and community service. The award recognizes TIPS members who have the attributes embodied by Senator Muskie: his dedication to justice for all citizens, his public service, and his role as a lawyer and distinguished leader of TIPS.

Mr. Schiffer has been involved in a number of pro bono, public service, and community activities including over ten years as a volunteer mediator during the past ten years for the mandatory commercial mediation program of the United States District Court for the Southern District of New York, and for the New York Supreme Court Commercial Division’s Alternative Dispute Resolution Program, an Election Protection volunteer lawyer answering election day questions from voters, a lecturer on legal research and writing for the Corporate Law Program of Sponsors for Educational Opportunity, which provides minority students with internships in corporate law firms, and served as a volunteer notary for families and victims of the September 11th attacks on the World Trade Center.

Most notably, Mr. Schiffer has been an integral part of MDA’s Wings Over Wall Street®, a fundraising event for research to find treatments and a cure for amyotrophic lateral sclerosis (ALS), also known as Lou Gehrig’s disease. Wings was founded by Mr. Schiffer’s late sister-in-law, Toni Diamond, and his brother, Warren Schiffer, after Toni was diagnosed with ALS in late 2000. Mr. Schiffer’s involvement with the event since its inception exceeds well over 2000 hours of service. In six years, Wings has raised over $6 million for the ALS researchers at The Robert Packard Center for ALS Research at Johns Hopkins and the Eleanor and Lou Gehrig MDA/ALS Research Center at Columbia University, and is one of the largest MDA/ALS fundraising events in the United States.

Scot Fishman, LeBoeuf Lamb’s manager of corporate social responsibility, including pro bono, congratulated Mr. Schiffer on this honor: “Larry’s dedication to community service and pro bono legal work is a model for all our attorneys, and I’m very pleased that he has been recognized for his impressive achievements in this area.”
