Joe Simons Discusses Department of Justice's Antitrust Reforms
Partner Joe Simons commented on the potential implications of the U.S. Department of Justice's antitrust reforms on mergers in today's Daily Deal article, "DOJ Quietly Tries Out Merger Reforms." The article reports that the Department of Justice's antitrust division has implemented reforms aimed at cutting the cost that agency antitrust reviews impose on merging parties. The cost of filing a merger notification is about a quarter of a million dollars, but as Joe, the former head of the bureau of competition at the Federal Trade Commission, told the publication, it is not uncommon for the cost for complying with a second request for information to range from $3 million to $25 million. Second requests for information are used by antitrust agencies to examine competitive problems in mergers between competitors and other strategic combinations.

Dorsey Helps Secure Return of Kirby Puckett's Cremated Remains
As widely reported in the media, Arizona judge Benjamin Vatz recently ruled in favor of our client, Tonya Puckett, as Conservator of her children Kirby Puckett, Jr. and Catherine Puckett, in two contested matters involving the Estate of baseball Hall of Famer Kirby Puckett. First the Court ruled that Mr. Puckett's cremated remains should be released to the custody of Kirby, Jr. and Catherine. The personal representative of the the Estate, Brian Woods, had refused to release the remains to the Puckett children, arguing instead that they should be placed in a mausoleum. Second, Judge Vatz, citing a ""pattern of indifference"" towards the Puckett children and breaches of fiduciary duty by Woods, also granted our petition to remove Woods as personal representative and as trustee of certain trusts established for the Puckett children.

Dorsey trust and estate partner Bridget Logstrom filed both petitions on behalf of Puckett's children with the Arizona probate court, and Dorsey trial partner Chris Shaheen conducted the subsequent trial proceedings.

Logstrom said the Puckett family was very pleased with the ruling. ""It's been an extremely difficult time for them. From my personal experience, they are wonderful children and they are very happy that they no longer have to fight for their father's remains.

Lashay Appointed to 'Operation Safe Surf'
Harrisburg attorney Jill M. Lashay has been appointed to serve as part of Pennsylvania Attorney General Tom Corbett's ""Operation Safe Surf.""

Operation Safe Surf is a program created to help educate kids, parents and schools on how to be safe online. In partnership with the Pennsylvania Bar Association, approximately 300 attorneys were trained to serve as advocates of the Office of the Attorney General. The attorney volunteers, along with agents from the Attorney General's Child Predator Unit and representatives from the Pennsylvania Coalition Against Rape, will make presentations to school and parent groups across Pennsylvania.

In addition to the presentations, supplemental program materials will include books, lessons, DVDs for children and parents, and a web resource center accessible via the Attorney General's web site.

Lashay became interested in the program after hearing about it through the Pennsylvania Bar Association. ""As a mother of two small children, I felt an obligation to my family and the community to use my legal skills and public speaking expertise to reach out to folks in Central Pennsylvania and assist the Attorney General with this valuable program,"" she said.

Wright & Kozlowski Presenters at ABA CLE Meetings
Orlando partner Kenneth Wright and Columbus associate Richard Kozlowski were invited to be presenters at the ABA's Section of Taxation and Section of Real Property, Probate and Trust Law Joint Fall CLE Meeting held in Denver, Colorado, October 19-21.

Wright was the Program Chair for the session for the Special Investors and Investment Structure Group of the Real Property, Probate and Trust Law Section. Under Wright's leadership, two presentations were conducted for group members: ""Investing in Real Estate in China"" and ""Alternative Vehicles for Foreign Investment in U.S. Real Property.""

Kozlowski was a panel member for the first presentation, which provided an overview of current legal and practical issues in ""acquiring"" real property in China.

The Special Investors and Investment Structure Group includes the division's committees that address specialized investments in real estate, including pension plan investments, insurance company investments and foreign investment in U.S. real estate, and/or specialized structures for investment and financing, including limited liability companies, partnerships, REITs, land trusts and real estate investment funds.
