Brinks Hofer Gilson & Lione’s Meredith Addy Named President of the Richard Linn American Inn of Court
Meredith Martin Addy, a shareholder at Brinks Hofer Gilson & Lione, one of the largest intellectual property law firms in the United States, was recently elected President of the newly-formed Richard Linn chapter of the American Inns of Court (AIC).

The AIC has more than 20,000 state, federal and administrative law judges, attorneys, law professors and law students nationwide who participate in established "inns" across the country. Originally, formed in the late 1970's as a means to improve trial advocacy, today inns meets monthly both to "break bread" and offer programs on ethics and professionalism as well as on the improvement of skills and mentoring. The Linn Inn is based in Chicago and, in addition to fostering the AIC's guiding principles of collegiality, professionalism, ethics and civility, will focus on the practice of intellectual property law. As a founding member and the Inn's first President, Ms. Addy is building the Linn Inn with members of the Chicago area intellectual property community, judges, law professors, leading lawyers, young lawyers and law students.

The Inn is named after The Honorable Richard Linn, Circuit Judge, U.S. Court of Appeals for the Federal Circuit. Nominated by President Clinton, Judge Linn has been a member of the Federal Circuit since 2000. He is a founding member of the Board of Governors, Virginia State Bar Section on Patent, Trademark and Copyright Law; former Adjunct Professor, George Washington University Law School; member of the Intellectual Property Advisory Board of George Washington University Law School and Past President of the Giles Sutherland Rich American Inn of Court. Judge Linn was the guest of honor at the inaugural meeting of the Linn Inn.

Ms. Addy focuses her practice on intellectual property litigation in U.S. district courts and appeals before the U.S. Court of Appeals for the Federal Circuit. Ms. Addy is a member of the Board of Managers for the Intellectual Property Law Association of Chicago (IPLAC), a member of the American Intellectual Property Law Association's (AIPLA) Amicus Committee, a member of the editorial board of the AIPLA Quarterly Journal and a former clerk to current Chief Judge Paul R. Michel of the U.S. Court of Appeals for the Federal Circuit. She also is active with veterans' organizations, preparing cases at the Federal Circuit and the Supreme Court of the United States.

For Lawyers Chasing Cybersquatters, Strategic Decisions Are Far From Simple
The uniform arbitration procedure used for resolving trademark-related domain name disputes offers a quick and inexpensive litigation alternative, but the issues of when or whether to use that procedure are often difficult to decide, say lawyers who routinely handle such disputes. Disputes involving multiple domain names present special challenges. If the trademark owner can demonstrate that these domain names are likely connected to the same individual, “99 percent of the time WIPO will rule on all of them,” said David Kelly of Finnegan Henderson. Choosing a URP provider also involves strategic considerations. If the lawyer senses that the dispute will settle quickly, it may be advantageous to pursue the action with the World Intellectual Property Organization, advised Kelly.

PTO Commissioner Doll Says That Limiting Continuations Will Improve Patent Landscape
John J. Doll, commissioner for patents at the Patent and Trademark Office, argued at the American Intellectual Property Law Association’s annual meeting on October 19 that the agency’s proposed rules for limiting the number of continuation applications will substantially improve patent examination and reduce the backlog of pending applications. In response to Doll’s comments, Charles Van Horn of Finnegan Henderson argued that the “significant” rules changes proposed at Section 1.178(d)(1) will create a complicated batch of problems for attorneys prosecuting patents. When questioned on whether the agency had the statutory authority to make the rules changes, Doll said a lawsuit is highly likely and the agency has “better than a 50/50 chance of prevailing.” Van Horn said that he sees those chances as “a whole lot less than 50/50.

Baker & McKenzie Advises Dell on EUR 200M Factory in Poland
Baker & McKenzie Gruszczynski & Partners has advised Dell Inc., the US computer systems company, on the establishment of its second European manufacturing plant, which will be located near Lodz in Poland.

The Firm advised on all aspects of the transaction including Government negotiations, EU law, state aid, tax relief, real estate due diligence and land purchase, planning issues and construction agreements. Marcin Gmaj led the team, which was based in Warsaw. Marcin is a partner in the Firm's Polish direct investment practice.

The plant will be located in a new Special Economic Zone and is being built with support from the Polish Information and Foreign Investment Agency (PAIZ). It is one of the largest greenfield investment projects ever undertaken in Poland and will make laptops and servers. It will open in the second half of next year and will employ 1,000 people initially, eventually expanding to around 3,000.

Syracuse Attorney Elected Chair Of BS&K's Agribusiness Practice Group
Charles J. Sullivan has been elected Chair of the firm's Agribusiness Practice Group.

Mr. Sullivan advises cooperatives, agricultural suppliers, agricultural lenders, food processors, other agribusinesses and farmers about a variety of matters, including cooperative formation, governance, finance, taxation, securities compliance, antitrust regulation and contracts; agricultural finance and credit, including secured lending, workouts and bankruptcy; transactions and business planning; participation in USDA Farm Service Agency farm programs; challenges to USDA determinations before the USDA National Appeals Division and federal courts; food safety compliance; and compliance with the Perishable Agricultural Commodities and Packers and Stockyards Acts.

He received his LL.M. degree in Agricultural Law from the University of Arkansas School of Law in 1996, his J.D., magna cum laude, degree from Buffalo Law School in 1992 and received his B.A., cum laude, degree from St. Lawrence University in 1989.

Syracuse Attorney Elected Vice President Of New York State Bar Association
Syracuse attorney David M. Hayes has been elected Vice President of the New York State Bar Association. He will serve as a Vice President representing the Fifth Judicial District. (Herkimer, Jefferson, Lewis, Oneida, Onondaga and Oswego counties.) Hayes was also elected to the Executive Committee of the State Bar.

The 26-member Executive Committee oversees the management and administration of the Association within policies determined by its governing body, the House of Delegates.

Hayes is Of Counsel to Bond, Schoeneck & King, PLLC concentrating in business law, including agricultural cooperatives, antitrust, corporate governance, finance, insurance, securities and strategic planning.

Hayes earned his J.D. from the University of Virginia Law School. He received a B.A. from Syracuse University, where he is now an adjunct professor of law at the College of Law. He also is a graduate of Christian Brothers Academy in Syracuse.

Hayes serves as a Director and Treasurer of the Legal Services of Central New York, Inc. and the Legal Aid Society of Mid-New York, Inc. He is a Director of the Onondaga County Bar Foundation, Inc.

Active in the Association, Hayes is a member of the Antitrust Section Executive Committee and a former member of the Corporate Counsel Section s Executive Committee. He is a former member of the Nominating Committee and a member of the Special Committee on Sarbanes-Oxley Issues. He is Chair of the Fifth District Fellows of the New York Bar Foundation and is a frequent seminar presenter.

Hayes is a Past President of the Onondaga County Bar Association, and a Past President and Honorary Director of the Boys and Girls Club of Syracuse.

The 72,000 member New York State Bar Association is the official statewide organization of lawyers in New York and the largest voluntary state bar association in the nation.
