Pennsylvania Supreme Court Finds Workmanship Not an "Occurrence" that Triggers Coverage
On October 25, 2006, the Pennsylvania Supreme Court issued a ruling finding that faulty workmanship is not an "occurrence" as is required to trigger coverage under commercial general liability policies. See Kvaerner Metals Division of Kvaerner U.S. Inc., et al. v. Commercial Union Insurance Co., et al., Nos. 47 & 48 MAP 2004, Pa. Sup. The Pennsylvania Supreme Court decision overturned the decision issued by the intermediate appellate Pennsylvania Superior Court.

The Supreme Court opinion states: "the definition of 'accident' required to establish an 'occurrence' under the policies cannot be satisfied by claims based on faulty workmanship.

WHITEFORD, TAYLOR & PRESTON NAMED EMPLOYER OF DISTINCTION
The ARC of Baltimore, in partnership with the Baltimore Business Journal, has selected Whiteford, Taylor & Preston LLP (WTP) as an Employer of Distinction. This inaugural award honors companies who have clearly demonstrated that employing individuals with developmental disabilities has contributed to their company’s success.

WTP and five other employers were honored at an Employers of Distinction Recognition Breakfast on October 19. “This is a great honor for our firm. Hiring from ARC’s workforce program has been a ‘win-win’ situation for us in terms of gaining dependable, hard-working employees. In fact, one of our ARC employees has been on staff for over 20 years,” noted Managing Partner Albert J. Mezzanotte, Jr.

“Our firm believes in creating a diverse working environment,” explained Barbara Wilson, WTP’s director of Human Resources. “Hiring people with developmental disabilities is a great way for us to enrich our workplace while giving opportunities to individuals who have a lot to offer as employees.”

The Arc of Baltimore is one of the nation's largest agencies addressing the needs of people with mental retardation. The Arc of Baltimore is widely recognized for improving the quality of life of these individuals by offering such programs and services as vocational training, community living, and supported employment.

Weltman, Weinberg & Reis Co., L.P.A. Expands Governmental Collections Practice Group
Weltman, Weinberg & Reis Co., L.P.A. (WWR), the nation’s largest creditors’ rights law firm based on revenue and placements according to Collections & Credit Risk magazine, is pleased to announce the formal expansion of its Governmental Collections Practice Group (GCPG).

In recent years, government entities have been experiencing more drastic budget cuts. With cities, states and municipalities being forced to do more with less, there has been a resulting spike in governmental collection needs. Due to market demand, WWR recently made the decision to expand its governmental collections practice group in order to offer clients a broader range of legal services. The GCPG provides collection and legal services to city and state governmental bodies on matters involving bankruptcy, reimbursement for unpaid premiums and coverage related to worker compensation claims, demand letter programs, collection of Department of Job & Family Services contributions, evictions, fraud recovery, Medicaid estate recovery, tax collection, utility claims and other general claims.

Over the years, WWR has forged strong existing relationships with the State of Ohio and other municipalities, and as a result, has developed expertise in handling governmental collection work. WWR is a member of the Ohio Municipal League and understands the intricacies involved with the collection of all types of city and state collection matters.

WWR Partner Sara Donnersbach and Associate Stanley Green will head the expanded GCPG. Mr. Green, an attorney with over 25 years of experience in governmental collections, states, “Over the years, I’ve learned that an integral part of preserving the fiscal health of communities involves maximizing the recovery of outstanding debt in a timely manner while maintaining a positive image with residents and business owners. At WWR, we understand the importance of capturing delinquent revenue in order to reduce the stress on city and state governments to maintain the same level of services with their reduced budgets.”

Ms. Donnersbach, a Partner in WWR’s Complex Collections department and Manager of WWR’s Attorney General Collection Unit, states, “Here at the firm, we provide a wide range of legal expertise and collection services to our clients. Since we have been assisting with governmental collection claims for the State of Ohio and other municipalities for quite some time, the expansion of this group was a natural evolution for us. China's ICBC launches record IPO, shares soar
In the largest IPO in history, the share price of Industrial and Commercial Bank of China (ICBC), the People's Republic of China's largest state-owned bank, rose 15 percent on their first day of trading, valuing the bank at about US$ 139 billion. The IPO, the first simultaneous Hong Kong and mainland China listing, raised up to US$ 21.9 billion from investors and helped make ICBC rank fifth among global banks.

Knowledgeable Real Estate Attorneys Wanted – Now
The November 2006 issue of Illinois Real Estate Journal features an article about the evolution of the real estate lawyer. Schwartz Cooper attorney, Ron Grais, a former developer, is quoted throughout the piece. Mr. Grais discusses the need for experienced real estate attorneys, noting that Schwartz Cooper has "22 real estate attorneys, but more than half are partners. When clients are dealing with today’s real estate situations, to get intimately involved as the client is, you have to have experience." He also comments on the increasing role of technology in his practice. "When I started this business in 1968, I had a rule that I wouldn’t do a deal unless I saw the property first," Grais said. "Now I rarely can do that, there just isn’t time to visit them all. I’m doing a 30-property deal in Texas right now, [using satellite images on the Internet] from my Chicago office.
