GrayRobinson Welcomes New Associates.
GrayRobinson, P.A. is pleased to announce that John Heilman and Adam Woodruff have joined the firm's Lakeland office as associates.

John Heilman was born in Clearwater, Florida and after attending the University of North Carolina - Chapel Hill for two years, he obtained his B.A. in English from the University of Notre Dame in 1996. Heilman obtained his M.B.A. from the University of Florida Warrington Graduate School of Business, and graduated from the University of Florida Levin College of Law in 2000. Prior to joining GrayRobinson, Heilman practiced with a national long-term care defense litigation firm. He has handled various transactional and litigation matters in the areas of real estate, construction, franchise, and corporate law.

Adam Woodruff is originally from Huntington, West Virginia. He graduated with honors from the Warrington College of Business at the University of Florida in 2001 and received his J.D. from Nova Southeastern University in Fort Lauderdale in 2005. In 2006, he received his LL.M. in Real Estate from The John Marshall Law School in Chicago, Illinois where he also graduated with honors. Woodruff will focus his practice in the areas of real estate, corporate and business law.

Zelkowitz appointed Commissioner to Biscayne Corridor Community Redevelopment Agency
On April 26, 2006, the Miami Shores Village Council unanimously appointed Steven W. Zelkowitz as it resident Commissioner to the Biscayne Corridor Community Redevelopment Agency (CRA). Miami-Dade County created the Biscayne Corridor CRA following a finding of slum and blight.

The Commissioners of the Biscayne Corridor CRA will oversee the redevelopment of the area through the use of tax increment revenues (TIF). CRAs are dependent special districts created by local governing bodies pursuant to statutory authorization in order to use TIF to alleviate slum and blight. In addition to his land use zoning and real estate practice, Mr. Zelkowitz has an extensive governmental practice including the representation of a number of CRAs throughout the State of Florida.

Gray Robinson Welcomes New Associates
GrayRobinson, P.A. is pleased to announce that Katrice Jenkins and Kelly Keller have joined the firm's Tampa office as associates.

Katrice Jenkins was born and raised in New Orleans, Louisiana. She received her J.D. in 2003 from the University of Miami School of Law, and her Masters from Florida A & M University, with honors, in 2000. She graduated from the University of Miami with a B.A. in English and minor in Psychology in 1997. Jenkins will concentrate her practice in the areas of insurance defense and general civil litigation.

Kelly Keller received her J.D., with honors, in 2003 from Stetson University College of Law. Prior to joining GrayRobinson, Keller served as a law clerk to Hon. Elizabeth A. Jenkins, U.S. Magistrate Judge. She also clerked for Hon. Virginia M. Hernandez Covington, United States District Judge. Keller will focus her practice in the areas of commercial litigation, bankruptcy, and creditor's rights.

Health Opportunity Patient Empowerment Act of 2006
the Ways and Means Committee, on a party-line vote, approved the Health Opportunity Patient Empowerment Act of 2006 (H.R. 6134). The bill modifies the HSA rules to make HSAs more attractive. Specifically, the bill does the following, effective for taxable years after December 31, 2006:

* Permits an individual to transfer the balance remaining in his or her FSA or HRA account as of September 21, 2006 (or, if less, the balance on the date of the transfer) to a new HSA. The transfer must be made before January 1, 2012.

* Modifies the limit on contributions to HSAs, so that it is not limited to the annual deductible of the high deductible health plan (HDHP); instead, contributions would be limited only by indexed dollar amount ($2,850 self-only; $5,650 family for 2007).

* Requires the Secretary of Treasury to announce the cost-of-living adjustments applicable to HSAs by June 1 of each year.

* Allows individuals who become covered by a HDHP after January to contribute up to the full annual limit, even if they were only eligible individuals for a portion of the taxable year; however, if they do not maintain an HDHP for the 12-month period beginning with the last month of year (except in the case of death or disability), then they must pay tax on the HSA contributions plus a 10% penalty.

* Allows employers to make contributions to HSAs on behalf of non-highly compensated employees in higher amounts (or higher percentages of deductibles) than to highly compensated employees without violating the comparable contribution rules.

* Allows individuals to make a one-time distribution to rollover amounts from an IRA to an HSA, subject to the HSA contribution limit.

This is the first step on the legislative process, and the legislative year is drawing to a close. Next steps would be to have the entire House of Representatives vote on the bill and then have the bill sent over to the Senate for action. Both the House and the Senate are currently in recess and will not return until after the November elections. This means that there likely will not be enough time to take up this bill during this Congress. Any outstanding bills that remain at the end of this Congress, including this bill, will not carry over to the next Congress and will have to be reintroduced. If the Democrats control the House in the next Congress, it is highly unlikely that this bill would be favorably reported out of the House Ways and Means Committee, given the Democrats' opposition to this bill in Committee this year.

Robert W. Sargeant Joins WK&G
Robert W. Sargeant, formerly with Stoel Rives LLP, has joined the Seattle office of Williams, Kastner & Gibbs PLLC as a Member. Rob is a real estate lawyer with extensive experience in litigation and transaction matters. His clients include buyers, sellers, developers, landlords and tenants, lenders, brokers, escrow and title companies. Prior to reentering private practice, Rob managed Stewart Title Guaranty Company's National Title Services office in Seattle, which issues title policies and closes commercial escrows throughout the country, and served as a vice president and underwriting counsel from 1999 to 2004. During the same period, Rob also served as a member of the Washington Land Title Association's (WLTA) Executive Committee and as chair of the Judiciary Committee. He was lead counsel for the WLTA as amicus curiae in Ellingsen v. Franklin County, a landmark decision by the Washington State Supreme Court.
