Hannah Widlus & Patricia Gillman Published in Compensation & Benefits Review & HedgeWorld.com
Hannah and Patricia’s article, “Fund Investing: What to Ask For and How to Ask For It,” was published in the July/August issue of Compensation & Benefits Review, and on HedgeWorld.com on October 31. An increasing number of pension plans are investing in private equity and hedge funds, and the terms and provisions governing these investments often favor management. The authors explain that many institutional investors, like pension plans, are unaware that these terms are subject to negotiation. Through review of actual fund documents, their article offers examples of several terms that, with some revision, will promote a greater balance between the needs and interests of the fund sponsor or Manager, on the one hand, and those of the Investors or Members, on the other. In particular, it addresses the topics of reports to fund Members, the valuation of fund assets, the Manager’s discharge of its fiduciary duties, redemption or withdrawal procedures, the distribution of side letters and use of most favored nation provisions as well as specific ERISA matters. They also comment on difficulties that may arise as a result of the wording of a provision and, in certain cases, propose language for inclusion in a side letter between the Manager and the Investor.

Molander to Chair Defense Research Institute's Insurance Law Committee
Partner Julia Molander's appointment to chair the Defense Research Institute's (DRI) Insurance Law Committee is announced in the October issue of Insurance Journal. The Insurance Law Committee, with more than 2,000 members, is the DRI's second largest committee, and a leading provider of educational resources on substantive aspects of insurance law. Molander describes the organization as ""invaluable"" for defense trial attorneys and corporate counsel, and says she hopes her role as committee chair will allow her to assist defense attorneys with the ""educational, ethical and economic challenges"" of the legal profession.

Molander, who is based in Sedgwick's San Francisco office, previously served as the committee's vice-chair, diversity liaison, and as a member of its steering committee. For nearly 30 years, she has represented property and casualty insurers; life, health and disability carriers; and umbrella and excess insurers in virtually all aspects of the insurance business. Her expertise includes insurance coverage, reinsurance, claims handling, bad faith liability, and insurance fraud. She also has significant experience resolving complex litigation involving employee benefits arising under the Employee Retirement Income Security Act (ERISA) and related statutes.

Partner to Join Prominent Legal Research and Education Institute
Sedgwick, Detert, Moran & Arnold LLP announced that New York Partner Kenneth Rashbaum has been invited to join the prominent legal research and education institute: The Sedona Conference. In this capacity, he will be assigned to the Working Group that focuses on developing international electronic information management, discovery and disclosure. Rashbaum, chair of Sedgwick's electronic discovery, data management & compliance practice, is resident in Sedgwick's New York office. Rashbaum counsels corporations on electronic document management, offshore outsourcing of data services, Sarbanes-Oxley, the HIPAA Privacy and Security Rules, and state and federal privacy laws. Rashbaum received his B.A., summa cum laude , from the State University of New York, College at New Paltz, and his J.D. was conferred by Hofstra University School of Law.

Orange County Attorney to Lead Trial His Alma Matter's Trial Program
Sedgwick, Detert, Moran & Arnold LLP announced Orange County Attorney Robert Beggs is leading the Trial Practice/Mock Trial program at his alma mater: Chapman University School of law. Chapman Law is recognized as one of the region's best law schools, and has a comprehensive programs that produces excellent trial lawyers. Chapman's Mock Trial students learn trial advocacy skills first-hand by preparing for and participating in an interscholastic trial competitions. Chapman has reached either the regional semifinal or final round of competition for the past three years.

""I am honored to continue Chapman's tradition of exposing students to invaluable academic and real-world legal challenges,"" said Beggs. ""Teaching also affords me the opportunity to test new theories and practices, which hones my own trial skills as well.""

While at Chapman, Beggs was president of the Mock Trial Board. Now resident in Sedgwick's Orange County office, he handles complex personal injury, premises liability, and wrongful death matters.

American Business Women’s Association Asks Orange County Attorneys to Build Its Newest Chapter
Sedgwick, Detert, Moran & Arnold LLP announced attorneys Alexandra Wilcox and Deanna Spelber were appointed by the American Business Women's Association's (ABWA) Newport Beach chapter to vice presidents of programming and finance respectively. Founded in 1949, the ABWA was created to offer business development training and networking opportunities to the record number of women who had entered the American workforce during WWII. Now well into its fifth decade, the ABWA has hundreds of chapters across the country, including it's newest chapter in Newport Beach, which offers monthly meetings centered on educational, networking and fund-raising programs.

American Law Institute Elects Chicago Appellate Partner to Membership
Chicago partner Kirk C. Jenkins, an appellate and constitutional law expert, was elected to membership in the American Law Institute (ALI), a leading resource for legal research, analysis, and authoritative texts. This honor recognizes Jenkins’ record of professional achievements, demonstrated commitment to furthering the law through publishing and public speaking, and community involvement. He will serve on the ALI Members' Consultative Groups for the “Restatement (Third) of Torts: Economic Loss” and “Principles of the Law of Aggregate Litigation,” a treatise on the law of class actions.

An accomplished attorney, Jenkins writes on constitutional law matters and is authoring a book on appellate practice. His credentials include election to the California Academy of Appellate Lawyers, a prestigious group of highly experienced appellate attorneys whose election process involves rigorous scrutiny of appellate lawyering skills. Jenkins also has long been active in community groups addressing historic and architectural preservation, charitable causes, and civil and political rights.

Membership in ALI is by election only and is limited to 3,000 attorneys, law professors and judges from the U.S. and over two dozen foreign countries. Candidacy is traditionally limited to law firm partners; in-house counsel at the general or associate general counsel level; high-level government attorneys; tenured academicians; and judges. Ex officio members include all nine U.S. Supreme Court justices, the chief judges of all U.S. Circuit Courts of Appeals, the U.S. Attorney General and Solicitor General, and other prominent leaders and jurists.
