King & Spalding Earns Significant Victory for Internet Security Systems, Inc. in Patent Infringement Case
King & Spalding, a leading international law firm, announced today that its intellectual property team has earned a key victory for its client Internet Security Systems, Inc. ("ISS") in a patent infringement case in federal court in Delaware.

The case was scheduled for a four-week jury trial on October 30. But on October 17, Chief Judge Sue Robinson granted ISS summary judgment, holding all of the plaintiff's asserted patent claims to be invalid.

In 2004, SRI International, Inc., a nonprofit research institute formerly affiliated with Stanford University, accused ISS of infringing five patents relating to computer network intrusion detection systems. (Symantec Corp. was the co-defendant in the case and was not represented by King & Spalding.)

In granting summary judgment and ruling that the plaintiff's patent claims were invalid, the court held that an article posted by the inventors on a file transfer protocol ("FTP") Internet site constituted an invalidating "printed publication." The court found that the FTP site was publicly accessible, the address of the site was distributed to members of the intrusion detection community in both presentations and via e-mail, and the site was commonly referenced by individuals in online newsgroups. In light of these findings and the court's interpretation of sufficient "indexing" of the article, such that members of the public exercising reasonable diligence could locate the article on the FTP site, the court held the patents at issue invalid and entered judgment in ISS's favor.

King & Spalding’s Andrew Hruska, A Former Justice Department Official, A Panelist at Two November Seminars on Corporate Criminal Investigations
Andrew C. Hruska, a partner in the Special Matters and Government Investigations practice of King & Spalding, a leading international law firm, will be a panelist at two programs in November that examine the current state of play in corporate criminal investigations and how the rights of companies and individuals are affected.

Hruska will be one of four panelists at a November 13th discussion entitled “Cooperation or Coercion? Does the Thompson Memo Interfere with the Right to Counsel?” The event, sponsored free of charge by the New York City Lawyer’s Chapter of the Federalist Society, will be held at the Cornell Club, 6 East 44th Street, with a reception at 6:00 p.m. followed by a discussion at 7:00 p.m. Reservations are not required. Hruska will also participate in a CLE program sponsored by the New York City Bar on Wednesday, November 15, from 6:00 p.m. to 9:00 p.m., at the organization’s offices, 42 West 44th Street. Preserving the Attorney-Client Privilege Within Business Entities,” will look at the current state of attorney-client privilege within corporations; pending and potential legislative and rulemaking proposals for enhancing its visibility; and practical techniques and strategies aimed at preserving the privilege. Before joining King & Spalding in June 2005, Hruska served as the Chief Assistant United States Attorney for the Eastern District of New York, where he oversaw the expansion of the office's vigorous corporate fraud enforcement program, including the successful investigations and prosecutions concerning Computer Associates, Symbol Technologies, American Tissue Inc. and many other public companies. He previously was Senior Counsel to United States Deputy Attorney General Larry Thompson.

Katten Muchin Rosenman’s Andrew Katzenstein Elected to American College of Trusts and Estates Counsel
Katten Muchin Rosenman LLP is pleased to announce that Andrew M. Katzenstein, a partner in the Firm’s Trusts & Estates Practice, has been elected as a Fellow of the American College of Trusts and Estates Counsel (ACTEC). The ACTEC is a professional association comprised of many of the most distinguished trusts and estates attorneys in the United States.

Fellows of the ACTEC must be nominated by other Fellows in their geographic area and are elected by the membership at large. A lawyer cannot apply for membership in the College. Fellows are selected on the basis of professional reputation and ability in the fields of trusts and estates law, as well as based on their substantial contributions to these fields through lecturing, writing, teaching and bar activities.

With the election of Mr. Katzenstein, Katten now counts seven ACTEC Fellows among its attorneys, an unusually large number for a single law firm. Other Fellows include Mal L. Barasch, Ronni G. Davidowitz, Charles Harris, Michael O. Hartz, Joshua S. Rubenstein and Beth Tractenberg.

Mr. Katzenstein’s practice focuses on estate, gift, generation-skipping tax planning, income tax of trust planning, and probate and trust administration matters, including resolving disputes between fiduciaries and beneficiaries. He also devotes a significant portion of his practice to charitable organization matters.

Mr. Katzenstein has taught Estate Tax at UCLA Law School since 1992 and previously taught Estate Planning and Advanced Estate Planning in the Graduate Tax Program at both the University of San Diego and Golden Gate University. He is a frequent lecturer on a variety of estate planning and tax related topics in the U.S., Europe and Canada, and appears annually before the Los Angeles County, Beverly Hills, and California State Bar Associations. In addition, he has participated in the prestigious USC Tax Institute and the USC Probate and Trust Law Conference.

Katten Muchin Rosenman Adds Richard Zelichov as Partner in Securities Litigation Practice
Katten Muchin Rosenman LLP is pleased to announce the addition of Richard H. Zelichov as a Los Angeles-based partner in its Securities Litigation Practice. Mr. Zelichov becomes the sixth partner to join the practice since March, when Bruce G. Vanyo joined the Firm’s L.A. office as practice co-chair. Partner Anissa D. Seymour joined Mr. Vanyo in the L.A. office in June, and in August, Eric A. Kuwana joined the Firm’s Washington office as Deputy Chairman of the Firm’s Litigation Practice, along with partners Ugo Colella and Catherine S. Wood.

Prior to joining Katten, Mr. Zelichov was an associate in the Litigation workgroup of Irell & Manella LLP’s Los Angeles office. Prior to that, he served as a law clerk to the Honorable Alfred T. Goodwin of the U.S. Court of Appeals for the Ninth Circuit.

Mr. Zelichov focuses his practice on securities litigation matters and business tort disputes. His experience includes the defense of corporate executives in a variety of civil securities matters and SEC and Department of Justice investigations. He has also defended a wide range of companies and their executives in securities class actions.

Mr. Zelichov received his B.A. from Yale College and his J.D. from the Columbia University School of Law, where he was a Harlan Fiske Stone Scholar, a James Kent Scholar and managing editor of the Columbia Journal of Law & Special Problems. He is admitted to practice in California and before the United States District Court for the Central and Northern Districts of California, the United States Court of Appeals for the Ninth Circuit and the United States Supreme Court.

Katten is nationally recognized for its experience and record of success in defending clients in shareholder securities class actions, corporate governance cases, internal investigations, regulatory enforcement proceedings, and Department of Justice prosecutions. Hunton & Williams Undergoes Significant Expansion In Asia
Hunton & Williams' practice in Asia continues to expand to reinforce the firm's continuing growth in the energy, infrastructure, finance, and mergers and acquisitions sectors in the region.

The firm's Greater China practice relocated to Beijing from Hong Kong to more directly support clients in data protection, dispute resolution, energy, foreign direct investment, international trade, and M&A and commercial transactions.

Holland & Hart Welcomes William Taylor
Holland & Hart is pleased to announce that William L. Taylor has joined the firm's White Collar and Government Investigations practice group.

Mr. Taylor is Of Counsel in the firm's Denver office, specializing in corporate internal investigations, white collar defense, and complex commercial litigation. Prior to joining Holland & Hart, Mr. Taylor served as Chief of the Major Crimes Section for the U.S. Attorney's Office, District of Colorado. As a federal prosecutor, he led investigations and prosecutions of public corruption, health care fraud, mail, wire, securities, and bank fraud, bankruptcy fraud, false claims, immigration and customs violations, U.S. passport fraud and other identity theft and threat offenses, firearms, and narcotics violations. Mr. Taylor also served as the office’s Criminal Health Care Fraud Coordinator and led a task force of state and federal agencies investigating emerging transnational criminal organizations engaged in complex frauds, money laundering, and cyber crime.

Prior to his service with the Justice Department, Mr. Taylor served as a Deputy District Attorney in Denver, and he worked with a Washington D.C. law firm, specializing in corporate internal investigations and civil litigation arising out of Department of Defense procurement contracts.

As a state and federal prosecutor and a trial attorney, Mr. Taylor has tried more than seventy cases to jury or bench, and has both conducted and defended against numerous state and federal grand jury investigations.
