Robert J. Miller Joins Jones Day Columbus Office Former P&G global legal head to focus on cross border transactions
The international law firm Jones Day is pleased to announce that Robert J. Miller has joined the Columbus office as Partner in the general business practice, where he will focus primarily on cross-border transactions and corporate governance.

Prior to joining Jones Day, Mr. Miller served as corporate general counsel/global legal for Procter & Gamble in Cincinnati, where he oversaw legal efforts relating to corporate law, mergers and acquisitions, intellectual property strategy, technology licensing, contract law, litigation and claims defense, and international trade.

"The Firm’s worldwide scale is a major differentiator in the marketplace and provides the platform for me to leverage my skills on deals around the world. Mr. Miller spent several years in Japan, where he successfully handled a variety of Asian transactions including joint ventures, divestitures and corporate structures. While the majority of the transactions were in China and Japan, he also led projects in India, Vietnam, Indonesia, Korea, Taiwan and Australia. He brought to each opportunity the skill he gained working with foreign government officials to gain the appropriate licenses, protections and regulatory approvals.

Firm Boosts Philadelphia Business Group
Blank Rome LLP is pleased to announce that Helen Han Mountain has joined the Firm as an Associate in the Business Department. Ms. Mountain will be based in Blank Rome’s Philadelphia office.

Ms. Mountain joins Blank Rome after serving as an Associate with the law firm of Duane Morris in Philadelphia, where she concentrated her practice in the areas of corporate governance, mergers, stock and asset acquisitions, private placements, loan agreements as well as general business transactions. Ms. Mountain also has experience submitting documents for filing with the Securities and Exchange Commission, including periodic reports and registration statements, state securities commissions, and banking and insurance regulatory authorities. Ms. Mountain also served as a Judicial Clerk in the Chambers of the Honorable Michael M. Baylson.

Actively involved within the legal community, Ms. Mountain serves on the Executive Committee of the Asian American Bar Association of the Delaware Valley. In addition, Ms. Mountain is a member of the Philadelphia Bar Association and National Asian Pacific American Bar Association.

Admitted to practice in Pennsylvania and New Jersey, Ms. Mountain received her law degree from Villanova University School of Law, where she served as Managing Editor of the Villanova Sports & Entertainment Law Journal. Ms. Mountain holds a Bachelor of Arts in Psychology from the University of Pennsylvania.

Commercial Litigator Brings Arts Experience
Blank Rome LLP is pleased to announce that Jonathan Scott Goldman has joined the Firm as an Associate in the Litigation Department. Mr. Goldman resides in Cheltenham, Pennsylvania and will be based in Blank Rome’s Philadelphia office.

Prior to joining Blank Rome, Mr. Goldman served as an Associate with the New Jersey law firm of Sherman, Silverstein, Kohl, Rose & Podolsky, P.A. Mr. Goldman specializes in commercial litigation including contract, insurance, and real estate disputes, as well as litigation in the areas of personal injury, and trusts and estates.

Admitted to practice in Pennsylvania and New Jersey, Mr. Goldman received his law degree from Temple University Beasley School of Law, where he served as Executive Articles and Symposium Editor for the Temple Political & Civil Rights Law Review and received the Albert H. Friedman Award for the best guided research paper upon graduation. Mr. Goldman holds a Master of Fine Arts from Tufts University, School of the Museum of Fine Arts and a Bachelor of Arts from Princeton University, Woodrow Wilson School of Public and International Affairs.

New Jersey State Bar Association Elects Stephen M. Orlofsky to House of Delegates
Blank Rome LLP is pleased to announce that the New Jersey State Bar Association has elected Stephen M. Orlofsky as one of its state delegates to the American Bar Association (ABA) House of Delegates, the policy-making body of the association.

Established in 1936, the House of Delegates consists of 549 members and serves as the ABA’s primary body for adopting new policies and recommendations. Delegates meet twice a year, and action taken by the House of Delegates on specific issues becomes official ABA policy.

At Blank Rome, Mr. Orlofsky serves as a partner in the Firm’s commercial litigation group, concentrates his practice in the areas of complex litigation and alternative dispute resolution, and counsels clients on trial and appellate litigation strategy. Mr. Orlofsky served as a United States District Judge for New Jersey from 1996 to 2003. Prior to that, Mr. Orlofsky also served as a United States Magistrate Judge for New Jersey from 1976 to 1980.

In 2003, Mr. Orlofsky traveled to Iraq as part of a 13-member team jointly commissioned by the U.S. Department of Justice and the Department of State to assess its judicial system. Mr. Orlofsky spent six weeks in Iraq conducting interviews and gathering information to assist the Coalition Provisional Authority in reconstructing the Iraqi court system.

Mr. Orlofsky frequently lectures on various topics, including Federal Practice and Procedure, Professional Ethics and Professionalism, Evidence, Electronic Discovery, Commercial and Criminal Litigation, and Appellate Techniques.

Kirkland Becomes Newest Member of Womble Carlyle's Atlanta Office
Womble Carlyle Sandridge & Rice, PLLC, today announced that Jimmy F. Kirkland has joined the firm’s Environmental Practice Group as a member in the Atlanta office.

Kirkland is an accomplished environmental lawyer who has 16 years of experience in private practice and another 13 years as a manager of the Emergency Response Team of the Environmental Protection Division of Georgia’s Department of Natural Resources.
As a private attorney, Kirkland has extensive experience negotiating with government agencies, working with clients to develop comprehensive environmental management systems, conducting environmental audits, and negotiating creative and cost-effective soil and groundwater remediation strategies under CERCLA, RCRA, state remediation and Brownfield programs, and voluntary initiatives.

Kirkland joins Womble Carlyle from Atlanta’s King & Spalding, LLP, where he worked since 1989 in King & Spalding’s tort litigation and environmental team.

"Jimmy is a terrific lawyer who will help us build our environmental group in Atlanta," said Steven Dunlevie, managing member of Womble Carlyle’s Atlanta office. "His environmental experience is especially helpful to us since he has a strong background both in regulatory and compliance work and in the defense of environmental tort litigation."

Governor Easley Appoints Michael Leonard to NC Land and Water Conservation Study Commission
Governor Mike Easley has appointed Michael Leonard to the North Carolina Land and Water Conservation Study Commission.

Leonard, a member of the firm's Product Liability Litigation Practice Group, is a member of the North Carolina Natural Heritage Trust Fund and a member of the Conservation Fund board of directors. Leonard received the Oak Leaf Award from the Nature Conservancy in 1991 and the Chevron Conservation Award in 1998.

The commission works to identify and evaluate the existing sources of state funding for the public acquisition of land or interests in land to protect drinking water quality and prevent polluted runoff, conserve rivers, wetlands, floodplains, coastal waters, working farms, working forests, local parks, state parks, game lands and other natural areas and land visible from scenic highways in North Carolina. Members also collect research and information from North Carolina and other states and jurisdictions regarding incentive based techniques and management tools used to protect land and water and assess the applicability of such tools and techniques to land conservation in North Carolina.

US Appeals Court Affirms Artist's Copyright Infringement Win
In a significant victory for the art world, the US Court of Appeals for the Second Circuit affirmed a 2005 trial court decision that a painting commissioned by Deutsche Bank and created by the artist Jeff Koons was protected fair use and did not infringe the work of a freelance photographer.

In Blanch v. Koons, No. 03 Civ. 8026 (LLS), 2005 WL 2875322, fashion photographer Andrea Blanch sued Koons, Deutsche Bank and the Solomon R. Guggenheim Foundation, alleging that one of his paintings, "Niagara," which collaged and juxtaposed images from the world of mass-media fashion and advertising, infringed the copyright in Blanch's photograph published in the fashion magazine Allure. Among other relief, Blanch sought one million dollars in punitive damages and the destruction of the painting itself. White & Case, on behalf of Deutsche Bank, moved for summary judgment on several grounds, including that the artist's use of the Blanch photograph was privileged fair use.

Last November, Judge Lewis Stanton of the Southern District of New York ruled that use of the photograph was fair because Koons used the image "as raw material in a novel context to create new information, new aesthetics and new insights."

"This ruling is significant as it affirms that artists like Jeff Koons - and those who commission and sponsor such artists - have a right to develop work that appropriates and comments on contemporary media free from copyright liability," said White & Case intellectual property partner Carol Witschel, who led the team representing Deutsche Bank. "This will help ensure the creation of fresh and innovative works of art."

White & Case partner Steven Betensky and associates Stefan Mentzer and Jennifer Co also served on the team representing Deutsche Bank. Lawyer John Koegel of The Koegel Group represented Koons, and Larry Friedman of Cleary, Gottlieb represented The Solomon R. Guggenheim Foundation.
