Gide Loyrette Nouel Hong Kong, legal counsel to the Emotion group in its takeover by Publicis
Gide Loyrette Nouel advised the Emotion group, leader in the Asian events management market, on its takeover by Publicis Groupe. Founded in 2002 by three French entrepreneurs, Emotion is now considered to be the agency of reference in Asia for the organisation of high-end events for numerous prestigious clients, especially in the luxury industry. With offices in a ten or so Asian countries, the group now employs more than a hundred people.

Publicis Groupe is the world's fourth largest communications group with offices spanning more than one hundred countries on five continents. Emotion will become part of Publicis Events Worldwide, an agency specialising in the organisation of major international events.

Emotion will retain its brand name for its core luxury market and its founders will remain in charge of management.

Gide Loyrette Nouel Hong Kong, under the responsibility of Fabrice Turries and with the support of Gide Loyrette Nouel Shanghai, advised the Emotion group throughout the transaction. Emotion was also assisted by Lacourte Balas & Associés for the French law aspects of the transaction. Publicis Groupe was advised by White & Case.

Craig Enoch Receives 2006 SMU Distinguished Alumni Award
The Hon. Craig T. Enoch, shareholder and chair of the appellate practice group at Winstead Sechrest & Minick P.C., will receive the Southern Methodist University Distinguished Alumni Award, the highest honor the university bestows upon its graduates. The recognition will take place at an awards banquet and ceremony at 7 p.m. on Thursday, Nov. 9 at the Fairmont Hotel.

Enoch has led a distinguished career spanning all three levels of the state court system. He served on the Texas Supreme Court for 11 years before retiring in 2003. Previously, he served as presiding judge of the 101st District Court and chief justice of the 5th District Court of Appeals.

Enoch earned his Bachelor of Arts degree in 1972 and a Juris Doctor degree in 1975, both from SMU, and later earned a Master of Laws degree from the University of Virginia School of Law. While on the trial bench, he became a leader in court administration and developed a management system used as a model for all civil courts in Texas. Since 1993, Enoch has served on the Executive Board of SMU’s Dedman School of Law, and in 1999, he received that school's Distinguished Law Alumni Award.

The 2006 recipients include Paul M. Bass Jr., Enoch, Jerry LeVias and John W. Nieto. Denise Scofield will receive the Emerging Leader Award, recognizing an outstanding alumnus or alumna who has graduated within the last 15 years.

A Cook County jury returned a verdict in favor of a physician represented by Robert W. Smyth.
The firm’s client was the former chief of the medical staff and chairman of surgery at Alexian Brothers Medical Center. The allegation was that the defendant-physician misperformed peripheral vascular surgery leaving the plaintiff with serious post-operative problems and permanent disfigurement. The jury returned its verdict for the defendant-physician.

John J. Duffy, John A. Krivicich and Charles S. Ofstein received a directed verdict on behalf of Ford Motor Company.
The plaintiff was traveling northbound on I-94 when a wheel separated from a 1987 Ford F-150, bounced over the concrete median and crashed through the plaintiff’s windshield. The plaintiff suffered two broken vertebrae, which were surgically fused, as well as permanent double vision and weakness on the right side of his body. The plaintiff alleged that the spare wheel and tire were original equipment and that the taper on the lug nuts did not match the taper on the wheel thus allowing the lug nuts to back off over time. Ford contended that the operator of the vehicle, who had changed the wheel and tire 33 miles before it came off, failed to tighten the lug nuts sufficiently to create optimum clamp load. Ford further argued that the plaintiff could not establish with any reasonable certainty that the wheel and tire used in the roadside change was the same wheel equipped with the vehicle back in 1987. At the conclusion of plaintiff’s case-in-chief, a directed verdict was entered in favor of Ford. The court ruled that the plaintiff failed to establish sufficient evidence that the wheel and tire used during the roadside change were the same replacement wheel and tire equipped with the vehicle in 1987.

Celeste M. Wolfe has joined the firm as an associate in our litigation department.
She concentrates her practice in family law and litigation. Celeste has handled a myriad of general civil litigation cases including general negligence, premises liability, negligent hiring/supervision, insurance coverage disputes, nuisance claims, false imprisonment, assault and battery, respondeat superior and declaratory actions. Celeste’s experience includes representing clients from a suit’s inception through appeal including facilitation and other forms of alternative dispute resolution. Celeste has tried numerous cases as lead counsel, resulting in favorable jury verdicts for her clients.

Prior to joining Cox, Hodgman & Giarmarco, Celeste had her own family law practice and represented business entities and individuals in litigation. Celeste also is a mediator for Wayne County which places her in the position to evaluate the monetary value of cases presented.

Celeste is extremely active in the Oakland County Bar Association and a member of the State Bar of Michigan, Women’s Lawyer’s Association of Michigan, and Macomb County Bar Association.

WCM Achieves Favorable Result in Brooklyn, NY Damages Only Trial
Partner John Collins achieved a favorable result in a Brooklyn, New York construction accident trial. In the case of Guanuquiza, et. al. v. Castle Village Owners Corp., et. al., the plaintiff, a construction worker, was working on scaffolding without a harness or any type of safety equipment when he fell 8 feet to the ground. As a result of his fall, the plaintiff sustained a bi-malleolar equivalent transverse commuted fracture of the distal third left fibula with displacement. Three surgeries were required to treat the injury. At the close of discovery, plaintiff moved for summary judgment against our client, the building owner. By virtue of N.Y. Lab. Law §240, this motion was granted and the case proceeded to trial exclusively on the issue of damages.

On the eve of trial, the plaintiff demanded a non-negotiable $900,000 to settle the case. We responded with a best and final offer of $300,000.

After a weeklong trial, in which we cast doubts on the plaintiff’s credibility in respect of the extent and permanency of his injury, and immediately before the jury was charged, plaintiff asked if we would settle the case for $350,000. We reiterated that $300,000 was our best and final offer.
