Kodak Wins Summary Judgment in Patent Suit Filed by Ampex
A WilmerHale team led by William Lee, Don Steinberg, Michael Summersgill, and Calvin Walden achieved a significant victory for their clients, Eastman Kodak Company and Altek Corporation, when the Federal Court in the District of Delaware granted summary judgment in favor of Kodak in the patent lawsuit filed by Ampex Corporation.

Ampex filed patent infringement actions in the International Trade Commission (ITC) and the Federal Court in Delaware against Kodak in October 2004 in which it accused Kodak’s digital cameras of infringing an Ampex patent. The Federal Court action was stayed pending the resolution of the ITC action. The ITC action was litigated for ten months. Shortly before trial, and after Kodak successfully moved to disqualify one of Ampex’s expert witnesses, Ampex dropped its ITC complaint. The case was then litigated in the Federal Court in Delaware for over twelve months. In May 2006, WilmerHale filed a motion for summary judgment seeking a ruling that Kodak’s cameras did not infringe Ampex’s patent. The District Court agreed and, on November 1, 2006, granted summary judgment in Kodak’s favor.

Willkie Represents ISS in Acquisition by RiskMetrics Group
leading financial risk management firm RiskMetrics Group announced that it will acquire Willkie client Institutional Shareholder Services Inc. (ISS), the world’s leading provider of proxy voting and corporate governance solutions to the institutional marketplace. As reported in the November 1 Wall Street Journal, ISS will become a wholly owned subsidiary of RiskMetrics, and the combined company will have nearly 900 employees and about $210 million in annual revenue. The merger facilitates both companies’ plan to expand beyond their core businesses of financial risk management and corporate governance to offer a broad range of data, analytics and advice to investors. The deal was handled by partner Jeffrey Poss; special counsel Kim Walker; and associates Adam Turteltaub, David Rubinsky, Park Bramhall, Jordan Messinger, Christopher Peters and Amanda Granacher.

Brown Raysman Set To Merge Next Month With Thelen Reid
Law firms in New York, San Francisco, New Jersey and Connecticut are moving ahead with two separate merger plans they hope will enable them to better compete on a national level.

In the larger of the planned combinations, San Francisco's Thelen, Reid & Priest and New York's Brown Raysman Millstein Felder & Steiner announced yesterday they have agreed to become 615-lawyer Thelen Reid Brown Raysman & Steiner, effective Dec. 1. . . .

. . .The Thelen Reid deal pairs a larger West Coast firm best known for its construction practice, which represents engineering giants like Bechtel Corp., with a smaller New York firm focused on technology and intellectual property matters.

The current Thelen Reid firm is itself the product of a 1998 merger between San Francisco's Thelen, Marrin, Johnson & Bridges and New York's Reid & Priest. . . .

. . .Brown Raysman was a highly active firm during the late 1990s technology boom, representing several startups in Manhattan's Silicon Alley. But the firm has increased its presence in other practice areas and, earlier this year, acquired 15-attorney New York construction law boutique Ross & Cohen.

Movers & shakers
Thelen Reid & Priest LLP, a national leader in construction, energy and project finance, and Brown Raysman Millstein Felder & Steiner LLP, a pioneer in technology law and real estate finance, have agreed to merge, forming a firm with more than 615 lawyers. Its name will be Thelen Reid Brown Raysman & Steiner LLP and the merger will take effect Dec. 1.

The management structure of the new firm will include an office of the chair. Stephen O'Neal and Julian Millstein will serve as co-chairs, and Thomas Hill becomes managing partner of operations.

Stoel Rives Partner Elected to Board of Worldwide Legal Organization
Geoffrey Revelle, a partner in the Seattle office of Stoel Rives, was recently elected to the Board of Directors of TerraLex, an international network of leading independent law firms.

Election results were announced after TerraLex’s 2006 annual meeting in Prague. The board consists of representatives from member law firms around the globe. Revelle is one of only two directors from firms in the western United States.

“I’m honored that my peers selected me to serve on the TerraLex board,” Revelle says. “Law firms from all over the world compete for TerraLex membership because its network of attorneys offers clients prompt, cost-effective access to global resources. I look forward to helping guide the organization as it continues to grow.”

In the United States, TerraLex membership is limited to one law firm per state. As the exclusive TerraLex member in Washington State, Idaho and Oregon, Stoel Rives is the first law firm to represent TerraLex in three markets.

TerraLex currently has more than 150 member firms located in approximately 100 countries and 40 U.S. states. Its members maintain hundreds of offices and offer the services of approximately 15,000 lawyers.

SILLS CUMMIS OPENS PRINCETON OFFICE
Sills Cummis Epstein & Gross P.C. is pleased to announce the opening of its new Princeton office located at 650 College Road East. The office will initially be staffed with 10 attorneys. Over the next six to eighteen months, the plan is to grow the number to approximately 30 attorneys. “As part of our growth strategy, as we surveyed the landscape, we focused on Princeton,” said Max Crane, Deputy Managing Partner. “It just seemed to be a natural fit.”

Mr. Crane stated that a number of areas of the Firm’s strength corresponded to business sectors that were also strong in the Princeton area such as life sciences, pharmaceutical and medical device industries, banking and financial services, land use and development, and regulatory sectors.

Mr. Crane also announced that four lawyers from Reed Smith would be joining the Princeton office: Paul H. Shur, Member of the Firm, Chair of Banking and Finance, James A. Dempsey, Of Counsel, Banking and Finance Practice Group, Scott Pyfer, Of Counsel, Banking and Finance/Bankruptcy and Creditors’ Rights, and Charles Panzer, Of Counsel, Bankruptcy and Creditors’ Rights. Six attorneys from the Newark group will also take up residence in the Princeton office: Members Thomas Jay Hall and Kevin J. Moore, Co-Chairs of the Land Use and Redevelopment Practice Group, Robert Axel Kasuba, an Associate in the Land Use and Redevelopment Group, Brian Coven, a Member of the Firm who focuses on Corporate Transactional work, and finally Ted Zangari and Max Crane, Deputy Managing Partner, who will be splitting their time between Princeton and Newark.
