Eight Associates Join Woodcock Washburn
The national intellectual property law firm Woodcock Washburn LLP is pleased to announce that eight associates have joined the Firm: Walter Frank, Michael A. Koptiw, Jr., Kenneth E. Plochinski, Lauren Rabinovic, Aaron B. Rabinowitz, Hilary A. Reinhardt, Joshua C. Sanders and Jake W. Soumis.

Walter Frank focuses his practice on patent procurement. Frank received a B.S. in Chemistry, cum laude, from Shepherd College in 1974, an M.S. in Transition Metal-catalyzed Organic Synthesis from the University of Delaware in 1978, a Ph.D. in Organic Chemistry from University of Virginia in 1982 and a J.D. from Temple University's James E. Beasley School of Law in 2006. Frank is a registered patent agent, holding 26 patents from service as a senior scientist in the flavor and fragrance industry. Frank had joined the Firm in July as an Advisor.

Michael A. Koptiw, Jr. focuses his practice on litigation and patent prosecution. Koptiw, who is a past summer associate, received his J.D. from Rutgers School of Law in 2006. He received his B.S. with Honors and M.S. in Electrical Engineering at The Stevens Institute of Technology. He worked for two years as a senior member of the technical staff in the Network Technology Development Department at AT&T.

Kenneth E. Plochinski, a patent procurement attorney, joined the Firm from Fitch Even Tabin & Flannery, and is based in the Firm’s Seattle office. He received both a B.S.E. in Engineering, cum laude, in 1981 and an M.A. in Mathematics in1983 from the University of Michigan, and a J.D., cum laude, from University of Michigan Law School in 2003.

Lauren Rabinovic’s practice focuses on litigation. Rabinovic is a 2003 graduate of Boston University School of Law. She received her B.S. in Biology from the University of Michigan in 1993 and her Ph.D. in Neuroscience from the University of Pittsburgh in 2000. Prior to joining Woodcock Washburn, Rabinovic was an associate at Foley Hoag in Boston.

Aaron B. Rabinowitz focuses his practice on litigation and patent prosecution. Rabinowitz received his received a B.S.E. in Chemical Engineering, cum laude, from Princeton University in 1997 and a M.S.E. in Chemical Engineering from the University of Pennsylvania in 2000. Rabinowitz received his J.D., cum laude, from Temple University Beasley School of Law in 2004. Prior to joining Woodcock Washburn, Rabinowitz clerked for the Honorable Franklin S. Van Antwerpen, U.S. Court of Appeals for the Third Circuit, and the Honorable Jan E. Dubois, U.S. District Court for the Eastern District of Pennsylvania.

Hilary A. Reinhardt’s practice focuses on patent prosecution. She is a 2006 graduate of Indiana University Law School. Reinhardt received her B.S. in Computer Engineering Summa Cum Laude from The University of Cincinnati in 2003.

Joshua C. Sanders focuses his practice on litigation and patent prosecution. A past summer associate, Sanders is a 2006 graduate of Villanova University School of Law. He received his B.S., cum laude, in Chemistry from Merrimack College in 1999 and his M.S. in Chemistry from the University of Virginia in 2002. Sanders has worked as an Analytical Chemist at Merck & Co.

Jake W. Soumis is a patent prosecution attorney who was a summer associate. He is a 2006 graduate of Franklin Pierce Law Center. He received his B.S. with Honors in Mechanical Engineering from the University of Michigan in 2003. Soumis worked as a Designer for the University of Michigan Research Department and a technician/mechanical engineer at Carter Mechanical.

Porzio Bromberg & Newman Joins with Barnes & Barnes
According to a joint announcement from D. Jeffrey Campbell, managing principal of Porzio, Bromberg & Newman P.C., and Timothy L. Barnes, president of Barnes & Barnes P.C., their law firms are merging, effective November 1, 2006. The name of the combined firm will remain Porzio, Bromberg & Newman P.C.

Timothy Barnes and Jefferson T. Barnes, shareholders of Barnes & Barnes, are moving their practice to Porzio’s Morristown office. Barnes and Barnes, with offices in Chatham, has a practice limited to representing plaintiffs in significant personal injury and medical malpractice matters.

Porzio Bromberg & Newman, with its main office in Morristown and branch offices in New York City and Brick, New Jersey, is a firm of 88 lawyers that represents both businesses and individuals across a wide variety of practice areas, including a practice complementary to the Barnes & Barnes practice. The merger with Barnes and Barnes brings to seven the number of lawyers who comprise Porzio’s plaintiffs personal injury and medical malpractice team.

Mr. Campbell explains that the merger is “a move consistent with Porzio’s long-term growth strategy to expand in several areas, including plaintiffs personal injury, while maintaining the cohesiveness and core values that have long characterized the firm.” Since January, Porzio has added lateral principals and counsel in the areas of commercial litigation, real estate and land use, tax appeals, corporate and international tax, and trusts and estates.

William A. Krais, who continues to chair the firm’s Personal and Fiduciary Services Practice Group, welcomes Tim Barnes and Jeff Barnes. Krais says, “both Tim and Jeff are a credit to the legal profession. The results they have achieved over the years demonstrate their unwavering commitment to their clients. They have served the profession through their dedication to and involvement with many legal and civic organizations throughout Morris County and New Jersey. We have worked side-by-side with them for many years in various organizations and have come to know and like them as lawyers and as people.”

National Association of Bond Lawyers Elects Mintz Levin Attorney Meghan Burke to Board of Directors
Mintz, Levin, Cohn, Ferris, Glovsky and Popeo, P.C. attorney Meghan Burke has been elected to the Board of Directors of the National Association of Bond Lawyers (NABL). Ms. Burke also will serve as the Chair of the NABL's Bond Attorney's Workshop, the leading educational conference for bond lawyers which will take place in September 2007.

Widely recognized as the primary bar organization for bond lawyers in the nation, the National Association of Bond Lawyers works to promote the integrity of the municipal market by advancing the understanding of and compliance with the law affecting public finance. The organization acts as a significant participant in policy-making at the national level in the municipal bond market. The NABL is composed of over 3,000 members from across the country and is headquartered in Chicago, IL.

Ms. Burke is a Member in the firm's Public Finance Section. She has extensive experience in public finance and public agency representation serving as bond counsel and counsel to underwriters and borrowers in connection with tax-exempt general obligation and revenue financings. Her additional experience consists of representation of institutional investors in high yield project financings in both new money transactions and workouts. She received her B.A. from Oberlin College (1988) and her J.D. from Northeastern University School of Law (1991).

Fifty Mintz Levin Attorneys Recognized as Massachusetts Super Lawyers
Mintz, Levin, Cohn, Ferris, Glovsky and Popeo, P.C. today announced that fifty of the firm's attorneys were selected as Massachusetts Super Lawyers for 2006. The findings are published in the November 2006 issue of Boston Magazine and in a stand-alone magazine, Massachusetts Super Lawyers. In addition, three Mintz Levin attorneys, Richard Mikels, R. Robert Popeo, and Stephen Weiner were recognized among the Top 100 lawyers in the state. Massachusetts Super Lawyers are selected based upon ballots sent by Law & Politics to over 31,000 Massachusetts attorneys who have been in practice for five years or more. Independent research is then conducted on each of the nominees followed by a panel review process. Only five percent of Massachusetts lawyers were named 2006 Massachusetts Super Lawyers.

High Court upholds ComReg’s decision to withdraw offer of 3G licence to Smart
The High Court yesterday, 31 October 2006, upheld the decision of the Commission for Communications Regulation (“ComReg”) to withdraw its offer of a 3G ‘B’ licence to Smart Mobile Limited (“Smart”).

ComReg withdrew the offer of the licence in February 2006 as Smart had apparently failed to comply both with the terms of its bid and with the conditions of ComReg’s 3G licence offer. Smart failed to provide ComReg with a €100 million performance guarantee bond in a form acceptable to it within the specified deadline.

Smart had sought a declaration that there was a "concluded contract" between Smart and ComReg in relation to the award of the licence. Smart also sought an order restraining ComReg from awarding the licence to any other party or treating its negotiations with Smart for the award of the licence as being at an end.

In a 113 page judgment, Mr. Justice Kelly said that Smart's ambitions had outstripped its ability to perform and described its strategy as one of “bluff, bluster and threats”. He considered that Smart's misfortunes were of its own doing and that it "cannot point the finger at ComReg".

Mr. Justice Kelly said the provision of appropriate bonds was a matter of major importance. He considered that the failure by Smart to meet its obligation in that regard had to be viewed very seriously by ComReg and that ComReg had done so in a reasonable and lawful fashion.

Costs and other matters will be dealt with on 9 November 2006.

Smart has been given 28 days to seek leave to appeal.

ComReg Chairperson, Isolde Goggin, said:

“ComReg welcomes today’s judgement, which confirms that ComReg’s original decision was correct, and that it followed fair and correct procedures. ComReg believes that it has been vindicated by the Court. While we are disappointed that the award of the 3G licence has been delayed, to the detriment of consumers, we are pleased that these legal proceedings on this issue have now concluded”.

ComReg has stated that it proposes, subject to any appeal, to make arrangements to offer the fourth 3G licence.

Website legal requirements – it’s time for an audit!
Have you conducted a legal audit of your website and online ordering procedures?
Nearly every business has a website, whether just for information purposes or for selling goods or services.
Robert McDonaghYet, how many businesses are aware of the legislation which applies to websites and e-commerce transactions? Is your website designed to comply with WEEE, e-commerce, equality and data protection legislation?

A survey by the Irish Data Protection Commissioner of public sector websites in 2004 found that only 22% had adequate privacy statements compliant with the Data Protection Acts and the Electronic Communications Regulations. A majority of websites (56%) had no privacy statement at all. It is likely that similar if not higher figures apply to private sector websites. Similarly, a survey by the Office of the Director of Consumer Affairs in 2005 found that only 14% of the websites surveyed were fully compliant with the E-Commerce and Distance Selling Regulations.

It is a criminal offence not to comply with some of this legislation. The way in which you commission and design your website can also have significant implications for your business.
