The law firm of Gray Plant Mooty announced today that Robert (Bob) A. Stein will join the firm’s Minneapolis office serving as Of Counsel on November 2, 2006. He will focus his practice on estate planning and other areas. Stein is a nationally recognized authority in the areas of estate planning, trusts, and decedents' estates.

Previously, Stein was the Executive Director and Chief Operating Officer of the American Bar Association (ABA), where he was responsible for the management of more than 900 persons and annual budgets of more than $180 million at the ABA’s headquarters in Chicago and its Washington, D.C., office. Stein said, “With the ABA, I’ve had opportunity to provide leadership in improving the administration of justice and expanding the rule of law in this country and around the world. This has been an overwhelmingly satisfying and rewarding experience. Now it’s time for me to step down from the ABA and accept my invitation back home to Minnesota, where I am excited to join the distinguished law firm of Gray Plant Mooty, as well as rejoin the faculty of the University of Minnesota Law School.”

Gray Plant Mooty’s Managing Officer, Bruce Mooty said, “Bob is currently one of the most recognized and well respected lawyers in the world. He is a perfect fit for our organization and his core values mirror ours. He brings outstanding legal skills, unprecedented commitment to the profession and dedication to the community through diversity efforts and pro bono work. Bob is an accomplished and talented attorney who will be a tremendous asset and valuable resource for our firm and clients. Bob had the opportunity to join several law firms throughout the world and we couldn’t be more pleased that he chose Gray Plant Mooty.”

Prior to joining the ABA, Stein was Dean of the University of Minnesota Law School and was the first William S. Pattee Professor of Law. From 1977-1980, he served as the University of Minnesota Vice President for Administration and Planning. He was the University’s representative to the NCAA, the Big Ten, and the WCHA from 1981-1993. Stein remains active with the NCAA. Currently serving as an Everett Fraser Professor of Law at the University of Minnesota Law School, Stein teaches a unique course on the remarkable work American lawyers have done to bring the rule of law to struggling new democracies throughout the world. In addition, he teaches a course to undergraduate students about the major cases that have shaped our nation over the past 200 years.

Stein holds leadership positions in numerous organizations. Since 1973, Stein has served as a Commissioner from Minnesota on the National Conference of Commissioners on Uniform State Laws, as appointed by the Minnesota Governor, Attorney General and Chief Justice. He is a member of the council, member of the executive committee, and advisor to several Restatements of the American Law Institute. He is the Secretary-Treasurer, Professional and Public Interest Division and Assistant Treasurer of the International Bar Association. He is the immediate Past President of the University of Minnesota Alumni Association and currently serves on its Board of Directors. From 2005-2006 he served on the Minnesota Law Review Advisory Board. In addition, he currently serves on the Board of Directors for several companies, including Great Northern Iron Ore Properties (trustee); Fiduciary Counseling, Inc. (Director, Board of Directors; Executive Committee); and the Educational Credit Management Group (Chair, Board of Directors). Gibbons Falls Class Boasts 13 Experienced Attorneys
Gibbons' Fall Associate Class of 2006 includes 13 attorneys, all of whom have professional experience prior to joining the firm, which includes serving as judicial clerks, judicial interns, law clerks or as professionals in another field.

"The firm's initiative to recruit judicial law clerks and other experienced attorneys is a win-win for our firm and our clients," said Patrick C. Dunican, Jr., Managing Director of Gibbons. "Clients get uncommon value because these associates are not first-year lawyers who require training, instead they provide first-hand knowledge of judges in the federal and state systems and the inner workings of the court.

"We are pleased to welcome this talented group of lawyers. By focusing on the recruitment of experienced young lawyers, we have continued the firm's tradition of high-caliber attorneys and helping to grow all four of our offices," added Peter J. Torcicollo, Director of Professional Development, Recruiting and Retention for Gibbons.

Court Protects Kimberly-Clark Trademark Orange Color
On November 2, 2006, the United States District Court for the Northern District of Georgia, Atlanta Division, granted a permanent injunction in favor of Kimberly-Clark Corporation and Kimberly-Clark Worldwide, Inc. against ValuMax International, Inc. in a trademark infringement and dilution case involving color.

Kimberly-Clark asserted trademark infringement, unfair competition and trademark dilution, violations of the Lanham Act, as well as a violation of the Georgia Deceptive Trade Practices Act and Georgia Trademark law regarding its Color Orange disposable medical face mask sold under the FLUIDSHIELD® trademark. The Color Orange is a registered trademark of Kimberly-Clark in connection with face masks. Kimberly-Clark claimed that ValuMax infringed its registered trademark by selling a disposable medical face mask of a "confusingly similar orange color."

The court ordered that ValuMax be permanently enjoined from using an orange color for its medical face mask product or from using any other mark which could cause confusion or dilute Kimberly-Clark's trademark-registered Color Orange. It further ordered ValuMax to destroy all medical face masks of an orange color similar to that used by Kimberly-Clark as well as any product used to produce the orange color in contention.

Kimberly-Clark is a widely recognized manufacturer and supplier of a variety of consumer and non-consumer products that are marketed and sold worldwide. Kimberly-Clark has sold and extensively promoted disposable medical face masks under its Color Orange trademark since 1988 and the company's Color Orange trademark has become a valuable asset as a symbol of Kimberly-Clark, its quality products and its goodwill.

Kimberly-Clark was represented by attorneys Thomas M. Williams and Michelle A. Miller of the intellectual property law firm Brinks Hofer Gilson & Lione and attorneys Mark VanderBroek and Alison Grounds of the Atlanta law firm of Troutman Sanders.
