Three WilmerHale Lawyers To Receive The Legal Aid Society’s 2006 Pro Bono Award
WilmerHale Partner Edward Tobin and Associates Ilona Cohen and Sarah Hurwitz will be honored by The Legal Aid Society of New York as recipients of the group’s 2006 Pro Bono Award. The Legal Aid Society’s 2006 Pro Bono Awards and Law Firm Recognition ceremony will be held on Monday, November 6, 2006 in recognition of the outstanding contributions of individual lawyers and law firms to the cause of equal justice.

Mr. Tobin, Ms. Cohen and Ms. Hurwitz will be recognized for their representation of Amadou Ly, an eighteen-year old immigrant from Senegal who overstayed his visa when he was abandoned by his mother in the United States at age fourteen. WilmerHale worked in partnership with the Legal Aid Society and Latham & Watkins to successfully encourage immigration authorities to drop deportation proceedings against Mr. Ly and allow him to stay in the United States and attend college.

Firm Welcomes Pierre Ullmann to Paris Office
The firm is pleased to announce that Pierre Ullmann has joined the Paris office as a partner in the Tax Department. Mr. Ullmann specializes in handling French and international tax law aspects of major M&A transactions and restructurings of listed and unlisted companies. He regularly advises on financial instruments and derivatives, the structuring of international investments and personal estate tax matters. Additionally, he has particular expertise advising on real estate projects for foreign investors. Prior to joining Willkie, Mr. Ullmann led the tax law practice in the Paris office of Brandford Griffith & Associates.

Thurgood Marshall Academy Honors V&E with Classroom Dedication
The Thurgood Marshall Academy Public Charter High School honored Vinson & Elkins LLP by naming a classroom after Judge William Benson Bryant, chosen by the firm as a role model, in recognition of the firm’s long-standing support of the school’s students.

V&E lawyers have tutored students and provided monetary support to the law-related, college-preparatory school since it opened in 2001 in the annex to the Congress Heights United Methodist Church. Having outgrown the location, the Academy last year inaugurated its new home in the renovated and historic Nichols Avenue School building in Southeast Washington, D.C.

The new facility features a moot courtroom, spacious classrooms, modern science laboratories, and a library for the school’s 363 students, most of whom are African-American.

“Building our communities and striving for excellence are two core values of Vinson & Elkins and we are very proud to have been able to live out these values through our work with the Thurgood Marshall Academy,” said Bill Lawler, a partner in V&E’s Washington office.

In addition to making financial contributions to the school in excess of $100,000 over the past five years, V&E lawyers have been providing weekly after-school tutoring for students that is a mandatory part of the curriculum for the 11th graders at the academy.

Each Tuesday the students are bused to V&E’s office for an hour and a half tutoring session that includes dinner. So many V&E attorneys and staff volunteered to help tutor students that the firm has expanded the program to seniors, who are not required to attend a tutoring program and would not normally participate.

There are currently 16 students, both juniors and seniors, involved in the program at V&E. The firm tutors the students in all subjects including Math and English. V&E matches the expertise of its lawyers with students who need help in those areas.

“Our work with the Academy has been terrifically rewarding for the students as well as the tutors, who have not only shared their time and academic knowledge, but also their life experiences and perspectives,” Mr. Lawler said.

This year, the tutoring program at V&E has been headed by D.C. associate Christina Vitale, with 16 attorneys and staff participating.

“The tutoring program involves an additional element of mentoring, and observing the bond that develops between student and tutor is very rewarding,” said Ms. Vitale. “It also provides a nice break from our legal work while still allowing us to contribute to the community.”

The Thurgood Marshall Academy is a public high school open to all D.C. residents that apply and is committed to four driving principles: community, diversity, democracy/participation and excellence. The Academy is providing a first-rate education to students in the D.C.-area through a standards-based college-preparatory curriculum that not only encourages critical thinking but also addresses any remedial needs so that all students have an opportunity to excel.

Judge William Benson Bryant (1911 – 2005), for which V&E chose to name the classroom, attended college and law school at Howard University graduating at the top of his class in 1939. Mr. Bryant overcame segregation to serve as Assistant U.S. Attorney for D.C. from 1951 to 1954, then returned to private practice. He was appointed to the U.S. District Court for the District of Columbia in 1965 and rose to Chief Judge in 1977 making him the first African-American Chief Judge of Washington’s federal court.

The ceremony honoring Vinson & Elkins with the unveiling of the plaque honoring the firm and Judge Bryant was held at the Thurgood Marshall Academy on Nov. 2 at 5 p.m.

IRS Answers Toxic Query; Post 1986 Radioactive Waste Debt Not Exempt
DC based Tax partner Howard Cooper is quoted in this article on a recent IRS “TAM” ruling that radioactive solid waste does not meet the definition of solid waste under the 1986 tax law and, therefore, tax-exempt bonds cannot finance facilities that process or store it.

. . .Howard Cooper, a tax partner with Thelen Reid & Priest LLP, who represents a number of electric utilities, said he had not seen the TAM. However, he gave three reasons yesterday why he thinks it is bad for the IRS to determine radioactive solid waste does not meet the definition of solid waste, especially when the federal government has not opened a national disposal facility for nuclear waste.

"One, I think it is wrong under the law," Cooper said. "Two, I think it is putting a double whammy on utilities. Because the government hasn't built the disposal facilities, the utilities have to build on-site storage, and now the government is making the cost of the on-site storage more expensive. Third, I think it is bad to issue a ruling on a subject while regulations are pending.

Orrick and Dewey Merger Vote Approaching
The upcoming partnership vote on Orrick's potential merger with Dewey Ballantine was explained in a Legal Week (U.K.) article, and chairman Ralph Baxter clarified his motivation behind the proposal. "Our single most pressing priority for the last two years has been to build our New York practice and if the merger goes through, no-one can offer that kind of quality both in New York and on the West Coast.

Orrick Recognized for Second Annual Diversity Job Fair
Orrick's second annual diversity job fair was mentioned in a Daily Journal article about diversity recruiting. Firmwide recruiting manager Karen Massa explained that the fair, which attracted between 200 and 300 students, "was something that clearly demonstrated a special focus on diversity.
