Neuf Cegetel Completes €911 Million Initial Public Offering
Shearman & Sterling represented Neuf Cegetel, the leading alternative fixed telecommunications operator in France, in its €911million initial public offering. The transaction was France's third largest IPO of the year and included a capital increase and offering of existing shares, combining a retail offering in France and an institutional private placement in France and outside of France, including a 144A placement in the United States. The company also completed an employee share offering by way of a capital increase.

Bentley Receives Distinguished Service Award from American Planning Association
Mark S. Bentley, a shareholder with the law firm of GrayRobinson, P.A., has received the 2006 Distinguished Service Award by the Sun Coast Section, Florida Chapter of the American Planning Association. The award was presented at the recent Sun Coast Section's Annual Awards Dinner on November 2, 2006 at Maestro's, which is located at the Tampa Bay Performing Arts Center in downtown Tampa. This award recognizes individuals who have had an outstanding career in planning and have made significant contributions to the planning profession.

Bentley, also a certified planner (AICP), practices in the areas of eminent domain litigation, land use, zoning, governmental and administrative law. His practice includes representation of both local governments and property owners.

Dykema Named ACLU of Michigan Pro Bono Law Firm of the Year
Dykema, a premier Midwest-based law firm, has been named the American Civil Liberties Union (ACLU) of Michigan Pro Bono Law Firm of the Year. The firm will be honored at the ACLU of Michigan’s Annual Dinner November 18.

Over the past 10 years, Dykema has devoted more time to ACLU of Michigan cases and programs than any other large firm in the state. In addition to providing top-notch cooperating attorneys for numerous high-impact, high-profile cases, Dykema attorneys have served on the ACLU Lawyers Committee and the ACLU Advisory Board.

"We are very pleased that the ACLU of Michigan has recognized Dykema for its dedication and commitment to the pro bono community," said Rex E. Schlaybaugh, Jr., Dykema chairman and chief executive officer. "Dykema has had a long tradition of commitment to pro bono legal service and I congratulate our attorneys on this honor."

"We look forward to continuing our long-standing relationship with the organization and supporting its efforts to provide legal services for those who otherwise might go without representation," added Heidi Naasko, Dykema’s attorney pro bono coordinator.

Currently, Dykema is working with the ACLU of Michigan to improve the criminal defense system for low-income people throughout Michigan. In past ACLU cases, the firm has defended the right of women to become full and equal members of the Fraternal Order of Eagles, the right of students to voice their opinions, and the right of domestic violence victims to be free from eviction from public housing because of violence perpetuated by abusive partners.

Dykema believes the practice of law, especially in a large commercial firm, is a privilege that carries with it profound societal responsibilities. Performing legal services for those who are traditionally denied access to justice – or for organizations that benefit such persons – is a central part of our effort to improve the quality of life for the underserved in our community.

Last year, Dykema attorneys and support staff performed 11,295 hours of pro bono work. The firm has earned several prestigious awards for its pro bono work, including the Detroit Local Initiatives Support Corporation (LISC) and Community Development Advocates of Detroit 2005 Community Partner Award, the 2005 Legal Aid and Defender Firm of the Year Award, and the 2004 Community Legal Resources Award.

Becky Fitzsimmons Selected to YWCA Rising Stars
Becky Fitzsimmons, an attorney at the law firm of Dinsmore & Shohl LLP, was recently named as a YWCA Rising Star, an award given to young professional women (ages 25-40) who pursue excellence in their careers. Nomination criteria include exemplifying outstanding career success, dynamic leadership and the unique ability to serve as a role model.

Bracewell & Giuliani Partner to Chair New State Bar of Texas Energy Tax Committee
Bracewell & Giuliani LLP partner Roger D. Aksamit has been named chairman of the newly formed Energy and Natural Resources Tax Committee in the Tax Section of the State Bar of Texas. Mr. Aksamit was chosen by his colleagues because of his substantial experience in representing both publicly held and closely held companies and business clients in all aspects of transactional tax matters.

“Tax issues and the energy industry are constantly evolving and creating challenges for those who work within these issues," Mr. Aksamit said. "I am honored that my state bar colleagues have selected me to head this important committee.”

FEDERAL COURT ENTERS FINAL JUDGMENT IN FAVOR OF SAMSUNG
A federal court judge today entered final judgment for Samsung Electronics in Matsushita’s long-running lawsuit against the company for alleged infringement of Matsushita’s dynamic random access memory (DRAM) semiconductor patents. In its suit, filed in May 2002, Matsushita sought more than $300 million in past damages from Samsung.

In rendering his judgment, Chief Judge Garrett Brown of the U.S. District Court for New Jersey fully incorporated the jury verdict in favor of Samsung that was announced on August 25, 2006, after a four-week jury trial in Trenton, New Jersey. In its suit, Matsushita sought not only significant damages for Samsung’s sales of DRAM in the United States over a 16-year period, but an injunction barring future sales of Samsung’s DRAM products in the United States. Samsung is the largest maker of commodity DRAM in the world. In contrast, Matsushita left the commodity DRAM business in 1999.

According to both the verdict and the judgment, Samsung’s DRAM products do not infringe any of the three patents that Matsushita brought before the jury. In addition, the jury found that two of the three asserted patents are invalid as both anticipated and rendered obvious by the prior art, despite Matsushita’s arguments to the jury that these patents represented groundbreaking advances in semiconductor technology.

The court also entered a judgment on the jury’s verdict that Samsung’s one counterclaim patent is valid, but that Matsushita did not infringe it.

Jeffrey K. Sherwood, an Akin Gump partner focusing on patent litigation, was lead trial counsel for Samsung throughout the case. Akin Gump partners Joseph P. Esposito, David R. Clonts, Gregory M. Hasley and Frank C. Cimino Jr. also represented Samsung at trial.
