Paul Hastings Climbs to 37th Ranking on American Lawyer Summer Associate Survey
In its fourth annual ranking of the nation's elite law firms for summer associates, The American Lawyer Summer Associate Survey named Paul Hastings 37th of its 172 ranked firms. Last year the firm placed 105th of 156 ranked firms. Rankings are based on feedback from more than 6,700 law school students.

Significant Victory for Honda in Nationwide Class Action
O'Melveny-Los Angeles partner Tad Allan and counsel Eric Kizirian recently won an important victory for Honda in the California Court of Appeal, which affirmed the trial court's dismissal of a nationwide class action alleging that hundreds of thousands of Honda Accords and other Honda vehicles from the mid-1990s are defective in that an engine oil seal can become dislodged, causing the loss of all engine oil and catastrophic engine damage.

The plaintiffs brought a nationwide class action after the alleged "defect" came to their attention through Honda's Product Update Campaign -- a voluntary program through which Honda assisted its customers by notifying them of the problem and providing a "fix" (a retainer bracket to hold the seal in place), or reimbursed owners who experienced the problem for their engine repair costs, even though the cars were no longer covered by Honda's warranty. The plaintiffs alleged that Honda did not go far enough, in that the problem supposedly affected more model years than those covered by Honda's Product Update Campaign.

Sustaining Honda's demurrer without leave to amend, the trial court agreed with the O'Melveny team that a manufacturer is not liable for an alleged defect that the manufacturer knows of at the time of sale, if the product functions normally within the express warranty period. On October 31, the California Court of Appeal issued its decision affirming the trial court in all respects. The Court found that there was no breach of Honda's express warranty, no violation of the Magnuson-Moss Act, no violation of the California Legal Remedies Act, and no violation of California's Unfair Competition Law ("UCL").

Addressing the last claim, the Court stated, "[i]n short, the failure to disclose a defect that might, or might not, shorten the effective life span of an automobile part that functions precisely as warranted throughout the term of its express warranty cannot be characterized as causing a substantial injury to consumers, and accordingly does not constitute an unfair practice under the UCL.

Cozen O’Connor Paralegal Aleksandr D. Mccune Receives Volunteer of the Year Award
Cozen O'Connor paralegal Aleksandr D. McCune has received the Volunteer of the Year Award by the Housing Justice Project of Kent (HJP) in Seattle. The Housing Justice Project (HJP) is a homelessness prevention project that helps low-income tenants in King County. Volunteer attorneys and volunteer legal assistants staff walk-in clinics at the King County Courthouse and Kent Regional Justice Center.

McCune serves as an insurance coverage paralegal in the firm’s Seattle office. He earned his undergraduate degree from the University of Washington (B.A., geography, 1994), his law degree from Seattle University School of Law (J.D., 2000), and his master of laws from the University of Washington School of Law (LL.M., taxation, 2001).

Cozen O'Connor Attorneys Obtain Significant Appellate Victory Before the Pennsylvania Supreme Court
Cozen O'Connor members Deborah S. Minkoff and Michael A. Hamilton, and of counsel Gaele McLaughlin Barthold, recently secured a significant appellate victory before the Pennsylvania Supreme Court for the firm’s client, National Union Fire Insurance Company of Pittsburgh, Pa., in an insurance coverage dispute against its insured, Kvaerner Metals.

The coverage dispute began when Bethlehem Steel sued Kvaerner, alleging that Kvaerner improperly constructed a coke oven battery. National Union denied that it owed a duty to defend or indemnify Kvaerner with respect to that action. The Superior Court agreed with Kvaerner, ruling that National Union owed a duty to defend, while an issue existed as to whether allegations of faulty workmanship qualifies as an "occurrence" under National Union's liability policy. The issue of whether there is liability coverage for faulty workmanship claims is a significant insurance issue in many jurisdictions across the country.

Cozen O'Connor was then retained to appeal the matter to the Pennsylvania Supreme Court. The Court agreed to hear the appeal and issued its long-awaited ruling on October 25, 2006. The Pennsylvania Supreme Court first addressed the Superior Court’s determination that it could look beyond the complaint in order to impose a duty to defend on a liability carrier. In reversing the Superior Court, the Supreme Court held that an insurer’s duty to defend must be determined solely from the language of the complaint against the insured. The Pennsylvania Supreme Court then reviewed that complaint to determine if it alleged an “occurrence” for purposes of the policy. The Court concluded that faulty workmanship does not satisfy the “occurrence” requirement and, therefore, National Union owed no duty to defend or indemnify Kvaerner.

Buchanan Ingersoll & Rooney Finishes 11th in Nation Among 2006 Summer Associates; Firm Ranks First in Pittsburgh and Philadelphia
Buchanan Ingersoll & Rooney PC ranked 11th nationwide, first in Pittsburgh and first in Philadelphia in The American Lawyer's 2006 Summer Associates Survey. The survey was published in the November issue of the publication.

Tom VanKirk, CEO of Buchanan Ingersoll & Rooney, notes that the summer associate season fell in the middle of a large merger.

"Our summer program has been strong over the past few years," he said. "This year, we took two firms' programs and integrated them mid-summer as part of a merger that had a large impact on Philadelphia and Pittsburgh. That makes this year's rating all the more exciting for Buchanan."

The Summer Associates Survey examined nine areas of job satisfaction, including how much "real work" was assigned, how training and guidance measured up, interactions with partners and how well the firm communicates its goals.
