Nixon Peabody agrees to defend Town of Hancock against the Friends of the Upper Delaware River; National law firm with strong roots in Upstate New York will represent the town on a pro bono basis
Albany, NY. Nixon Peabody LLP, one of the largest law firms in the country with strong roots in Upstate New York, has agreed to defend the Town of Hancock, pro bono, in a potential litigation concerning the Town of Hancock’s response to the extraordinary floods in June and July 2006, which was recently threatened by Friends of the Upper Delaware River. Because it believes the Town quickly and actively responded to the flooding in order to minimize the damages incurred, and because this small, rural town cannot afford legal counsel, Nixon Peabody agreed to provide legal services to the Town of Hancock on a pro bono basis, which means the legal services it provides are for free.

Ruth E. Leistensnider, a partner in the Environmental practice at Nixon Peabody, said, “After reviewing the facts, it became immediately clear that the Town of Hancock is unfairly being victimized for the actions it took to prevent a major disaster and protect the well-being of its citizens during the devastating floods in the Summer of 2006.” Ms. Leistensnider, who represents clients in various aspects of environmental law and has litigated matters on behalf of a diverse group of municipalities and companies, added, “This is an example of Nixon Peabody working for the public good of a small community that is being unfairly accused, something we are deeply committed to doing. We have taken this case on pro bono because we believe so strongly in the appropriateness of the Town’s actions. The Town did its part in defending itself against a natural disaster. We will now do our part in working with the town and its citizens to prevent a legal disaster.”

In June and July 2006, the Town of Hancock experienced devastating floods that caused many streams to overflow and created major damage to the town’s infrastructure, property and homes. In order to protect the well-being of residents and prevent further devastating damage, the Town responded by applying for and undertaking emergency repairs. Since then, Friends of the Upper Delaware River, a not-for-profit advocacy organization representing fly fishers and the fly fishing industry, has provided a notice of intent to sue the Town of Hancock, New York.

Mayer, Brown, Rowe & Maw LLP's Marshall Stoddard interviews Alan Greenspan at Finance Industry Conference
Mayer, Brown, Rowe & Maw partner Marshall Stoddard Jr. recently interviewed former Federal Reserve Board Chairman Alan Greenspan at a national financial industry conference, eliciting a wide range of views on the economy and international affairs. And the interview demonstrated that even though he's retired, when Alan Greenspan talks, the financial markets listen.

While providing what the Chicago Tribune characterized as "a generally upbeat view of the U.S. economy," Greenspan roiled the currency markets with his comments that the U.S. dollar stands to lose ground to the euro among central banks. His comments were seen as contributing the October 26th fall of the dollar against major currencies.

The discussion was conducted as part of the 62nd Annual Commercial Finance Association Convention in Washington D.C., attended by more than 1,450 financial and service industry executives.

The Commercial Finance Association (CFA) is the trade group of the asset-based financial services industry, with members throughout the U.S., Canada and around the world. The annual conference is a three-day event where attendees hear from well-known speakers, learn from industry veterans at educational programs and network.

Stoddard has been involved with the CFA for more than 30 years and was selected to conduct the Greenspan interview by CFA executive director, Bruce Jones. CFA's executive committee members and Stoddard generated questions for the interview. Publications such as the Financial Times, Chicago Tribune and Wall Street Journal noted Mr. Greenspan's remarks during the convention and Stoddard received acclaim and praise for his interview.

Stoddard currently serves as chairman of the CFA education foundation, Inc., a publicly supported establishment created to sustain educational and research programs for the asset-based financial services industry. The foundation is funded primarily through grants and contributions from industry service providers.

Kennedy Covington Hosts Evening at N.C. Museum of Art
Kennedy Covington, one of the largest law firms in the Carolinas, hosted more than 450 clients and friends at the N.C. Museum of Art's "Monet in Normandy" exhibit last night.

The event included private access to the exhibition, as well as live music and a cocktail reception.

"We were thrilled to provide this once-in-a-lifetime experience to our clients and friends," says Kent Christison, partner-in-charge of Kennedy Covington's Raleigh and RTP offices. "The museum is the only venue on the East Coast to host this exhibit. We are proud to support the North Carolina arts community."

The exhibit features 50 of Monet's paintings borrowed from public and private collections in the U.S., Canada, England, Switzerland, Scotland, France, Germany, Sweden, the Netherlands, Spain and Japan. According to the museum, many of the selected works rarely travel.

Kennedy Covington IP Partner Featured on Cover of Charlotte Business Journal Special Edition
Kennedy Covington Partner Susan Jackson is featured on the cover of the Charlotte Business Journal's October 27th special edition, "The Business of Law and Accounting."

Jackson, Founding President of The Charlotte Women's Bar, was pictured on the cover and quoted in the feature article. The article, "Raising the bar: Charlotte Women's Bar addresses gender issues," speaks to the organization's effort to assist women attorneys in advancing their careers.

Founded in April of 2005, The Charlotte Women's Bar has more than 160 members and is the largest chapter of the North Carolina Association of Women Attorneys (NCAWA). In the Charlotte Business Journal's article, Jackson is quoted as saying, "We've gotten the clear message that women attorneys want to work on professional development - skills that will help them in a business environment."

In September, Jackson was honored by the Charlotte Business Journal and the Diversity Council of the Carolinas with the 2006 Diversity in Business Award for her efforts on behalf of The Charlotte Women's Bar, as well as other women's initiatives.

Jackson is a Partner in the Intellectual Property group of Kennedy Covington, focusing her practice on patents, trademarks, copyrights and unfair competition, as well as licensing and opinion work. Jackson is also a former President of the Carolina Patent Trademark and Copyright Law Association, a professional association of intellectual property attorneys in North and South Carolina.

Kennedy Covington attorney Nina Shor was also featured in the Charlotte Business Journal article. Shor is President-elect of The Charlotte Women's Bar. She is an attorney in the real estate department of Kennedy Covington and focuses her practice on mixed-use, single-family subdivisions, condominium, and shopping center developments. In June, Shor was honored for her work with The Charlotte Women's Bar with a 2006 Women in Business Achievement Award from the Charlotte Business Journal.

Washington’s Court of Appeals Makes Important SEPA Review Ruling
The Court of Appeals, in a consolidation of interrelated landmark forest industry cases, has held the statutory exemption from SEPA review for most forest practices is not subject to Department of Ecology SEPA Rules that would subject otherwise exempt actions to SEPA review requirements. In Alpine Lakes Protection Society (ALPS) v. Department of Ecology Forest Practices Board, filed October 10, 2006, the challengers had argued that proposed statutorily exempt forest practices lose their exempt status and are subject to SEPA review requirements if, in combination with all other past, present, and future forest practices and other actions in the area, they may have significant adverse environmental impacts. While this case involved the forest industry exemptions, its importance extends to all statutorily exempt activities. These include school closures, water rights decisions for agricultural irrigation, air operating permit decisions, watershed restoration projects, NPDES permits/renewals/modifications for existing discharges, municipal incorporations, disincorporations, annexations, reductions, and consolidations.

FEMSA in its Acquisition of Coca-Cola FEMSA Shares from The Coca-Cola Company
Cleary Gottlieb represented Fomento Económico Mexicano, S.A. de C.V. (FEMSA) in its acquisition of 148,000,000 Coca-Cola FEMSA (KOF) Series D Shares from subsidiaries of The Coca-Cola Company for an aggregate purchase price of $427.4 million. Through this acquisition, FEMSA increased its voting participation in KOF from 53.6% to 63.0% and its economic participation from 45.7% to 53.7%. This transaction closed on November 3.

FEMSA is the largest beverage company in Latin America, exporting its products to the United States, and select countries in Latin America, Europe and Asia.

The Washington Legal Clinic for the Homeless Honors Weil Gotshal
The Washington Legal Clinic for the Homeless honored Weil, Gotshal & Manges' Washington DC office for the firm’s pro bono work on behalf of those who are most disadvantaged. Weil Gotshal was recognized at the Legal Clinic’s annual reception on November 1 for its "extraordinary efforts to make justice a reality for those struggling with homelessness."
