Tarullo Honored by American College of Construction Lawyers
Schottenstein Zox & Dunn Co., LPA (SZD) is proud to announce that Michael D. Tarullo, Leader of the firm’s Construction Practice Group, has been welcomed to the fellowship of The American College of Construction Lawyers, Class of 2007.

The American College of Construction Lawyers encompasses the top one percent of the construction bar in the U.S. All candidates to be selected to join the College undergo rigorous and detailed consideration by the College’s Nomination Committee and Board of Governors. Fellowship is extended by invitation only to those construction lawyers who are “found to have mastered the practice or the teaching of construction law and dispute resolution in the highly complex technical and legal fields pertaining to the built environment, and whose professional careers have been marked by the highest standards of ethical conduct, professionalism, civility, and collegiality.”

Tarullo has served the legal industry for over 17 years and was an engineer who practiced in the construction industry for nearly 20 years prior. His engineering position lends to his unique field experience in actual construction, construction-related businesses and field construction claims evaluation and preparation. He is AV® Peer Review Rated through Martindale-Hubbell, named one of The Best Lawyers in America, Construction Law, 2006-2007; included in The International Who’s Who of Construction Lawyers, 2005; named an Ohio Super Lawyer, 2004-2006; and also named to Chambers USA American’s Leading Lawyers for Business, Construction, 2004-2006.

Tarullo will be formally inducted into the College at their annual meeting to be held February 23-26, 2007, in Laguna Niguel, California.

Friedman Assists in Preparing Attorney General Candidate Arguments
Dan Friedman, Special Counsel in the Litigation Department in the Baltimore office and author of The Maryland Constitution: A Reference Guide, was quoted in this article after Maryland's highest court dismissed a lawsuit that could have removed Democratic attorney general candidate Douglas F. Gansler from the November 7 election ballot.

An Anne Arundel County circuit court judge ruled that Mr. Gansler's combined legal experience and 17 years as a member of the Maryland State Bar met the constitutional requirement that the candidate have practiced law in Maryland for 10 years, and dismissed the case.

Jason Shoemaker, who argued the case against Mr. Gansler, said the uncertainty about Mr. Gansler's qualifications could give Governor Robert L. Ehrlich, Jr. the right to challenge Mr. Gansler's election.

According to state constitution, the governor can "decide on the election and qualification" of the winner of the attorney general election.

Mr. Friedman, who helped Mr. Gansler's attorneys prepare for the high court, said the exact meaning of the language "is an open question of Maryland law, but I believe that the governor's job is just to swear in the winner of the election.

McCarter & English partner Susan Feeney named Counselor of Real Estate
Susan A. Feeney, a partner in the law firm of McCarter & English, LLP, has been named a Counselor of Real Estate.

Counselors of Real Estate is an international group of prominent real estate, financial, legal and accounting professionals, as well as government and academic leaders, who are admitted by invitation of their peers only, based on outstanding professional achievement, impeccable judgment, and commitment to integrity. Earlier this year, Frank E. Ferruggia, another partner in McCarter & English's Newark office, was also named to the group.

Ms. Feeney's law practice focuses on taxation, redevelopment law and condemnation. She has appeared before the Tax Court and County Tax Boards of New Jersey and has extensive experience in litigating property tax appeal cases involving office complexes, hotels, data centers, golf course properties, manufacturing facilities, industrial facilities, shopping malls, nursing homes, assisted living facilities and condominium and cooperative residential developments. Ms. Feeney also advises municipalities and taxpayers on farmland assessment qualification and roll-back taxes and has handled cases involving diminution of property value due to environmental contamination and wetlands impact. She is experienced in property tax exemption issues involving religious, education and hospital not-for-profit entities as well as the valuation of telecommunication properties, including switching stations and cellular towers.

Ms. Feeney is proficient in redevelopment law, assisting real estate clients in securing approvals, redeveloper designation and tax abatements and incentives in redevelopment areas. She advises developers and municipalities in condemnation proceedings, and has negotiated payment in lieu of taxes for developers, municipalities and tax exempt entities.

Drzal and Lay Represent IntelliMat in $5 million Series A Financing
LeClair Ryan represented IntelliMat, Inc. in a $5 million Series A financing that closed in October 2006. IntelliMat, Inc., based in Virginia, develops and provides specialized dynamic, digital floor displays using its patented IntelliMat® display. Three separate investment groups participated in the financing arrangement.

Leading LeClair Ryan in this transaction were Michael P. Drzal and David M. Lay.
