Fasken Martineau celebrates one hundred years in Québec
Events and festivities celebrating Fasken Martineau's 100th anniversary in Québec have kicked off with the opening of the exhibit entitled "Justice in New France : Crime and Punishment," which is being held at Montréal's Château Ramezay Museum until September 3, 2007. Interested in making this event available to the public and the legal community, Fasken Martineau agreed to support the museum in bringing this project to life and shed light on Québec's legal history.

The exhibit was officially launched on October 10, 2006 in the presence of the Honourable J.J. Michel Robert, Chief Justice of Québec and Francis Fox, Senator and Strategic Counsel at Fasken Martineau.

Fifth Circuit U.S. Court of Appeals Affirms Insurer Owes No Duty to Defend Because of Automobile Exclusion
On October 24, 2006 the Fifth Circuit U.S. Court of Appeals affirmed that a commercial general liability insurer does not owe a duty to defend its insured in regard to negligence claims given the policy's automobile exclusion. See Lincoln General Ins. Co. v. Aisha's Learning Center, No. 05-10981, 2006 U.S. App. LEXIS 26433 (5th Cir. 2006). The commercial general liability insurer, Lincoln General Insurance Company, sought a declaratory judgment to enforce the automobile exclusion so that it owed no duty to defend its insured daycare center, Aisha's Learning Center, in regard to negligence claims stemming from injuries allegedly resulting from a child who was left in one of the center's vans in ninety-five degree heat. Lincoln General Insurance Company argued, inter alia, that coverage did exist under a business auto policy issued by American International Insurance Company.

The Fifth Circuit determined that although the center's van was not being driven at the time of the alleged injury to the child, the van was still in "use" as is required for application of Lincoln General's auto exclusion policy as the van had been used to transport children. The Court stated that "when an automobile is being used as a vehicle, and that use has not ended as to the victim, the injury does arise out of the use of the automobile.

Weltman, Weinberg & Reis Co., L.P.A. Takes Part in National Credit Education Week 2006
For the fourth consecutive year, Weltman, Weinberg & Reis Co., L.P.A. (WWR) joined efforts with ACA International (The Association of Credit and Collection Professionals) during September 18-22, 2006 for National Credit Education Week (NCEW). NCEW is a public service campaign that aspires to educate consumers about the importance of credit and to help students that will soon be facing new financial responsibilities to understand the credit system and how to use it wisely.

With credit debt in America steadily growing, WWR feels it is important to promote personal finance management through more widespread credit education. The firm conducted two activities this year to promote NCEW. This years’ activities revolved around the theme “Play Your Cards Right: Don’t Gamble With Your Credit,” which focused on understanding the rules of the modern credit system in order to use it as a positive tool in accomplishing financial goals.

First, WWR sponsored a scholarship contest for graduating high school seniors from public high schools. The contest included schools located near the firm’s eight primary offices, including Burlington (NJ), Chicago, Cincinnati, Columbus, Cleveland, Detroit, Philadelphia and Pittsburgh. Scholarship applicants were asked to design a mock advertisement and write a short essay emphasizing the importance of credit education. The firm received nearly 40 submissions and awarded seven college scholarships worth $500 each.

In addition, WWR coordinated credit education presentations for high school students in Chicago, Cincinnati, Cleveland, Columbus, Detroit and northern Kentucky. Twelve attorneys from various WWR offices presented valuable information to over 1190 high school students at the following schools:

· Chicago: Alan B. Shephard H.S., Eisenhower H.S and Simpson H.S.
· Cincinnati/Northern Kentucky: Clark Montessori H.S. and Highlands H.S
· Cleveland: Beachwood H.S., Cleveland Central Catholic H.S., Hebrew Academy of Cleveland, Lincoln West H.S. and Westlake H.S.
· Columbus: Westerville-South H.S.
· Detroit: Divine Child H.S., Troy H.S. and Walled Lake Western H.S.

Sutherland Helps Close Largest Private Timberland Sale in U.S. History
Sutherland Asbill & Brennan LLP represented Resource Management Service LLC (RMS), Forest Investment Associates (FIA), and other investors that are part of a consortium of buyers led by RMS, in their purchase of International Paper timberland holdings, a deal which closed Friday. The $5 billion transaction is considered the largest private timberland sale in U.S. history.

Under the agreement, International Paper has sold 3.8 million acres of mostly southern forestland to the investor group for approximately $5 billion in cash and notes at closing. JP Morgan served as a financial advisor to the buyer group on the deal.

RMS, based in Birmingham, and FIA, based in Atlanta, are timberland investment firms specializing in land management on behalf of individual and institutional investors. Approximately 300,000 acres of the timberlands are in Georgia. The remainder are located in Arkansas, Texas, Louisiana, Virginia and Michigan.

“Our clients very much appreciated our efforts and we are proud of being able to represent them in this tremendous accomplishment,” said Managing Partner Mark D. Wasserman. “This transaction was truly a team effort and serves as another significant example of Sutherland’s ability to carry out complicated transactions.”

The cross-practice Sutherland team was led by partners Victor P. Haley and Haynes R. Roberts of the real estate group, Daniel R. McKeithen of the tax group, and William H. Bradley, B. Knox Dobbins, Thomas C. Herman, and Eric R. Fenichel of the corporate and finance groups.

“In this new era of timberland ownership, investment, and management, our firm has a proven record of success,” said Sutherland Corporate Partner William H. Bradley. “We’re happy that our clients value the work Sutherland attorneys did in brokering such a noteworthy deal.

Twenty new associates join Stites & Harbison
Stites & Harbison announced today the addition of twenty new associates firm wide.

Here is a closer look at the Atlanta attorneys. Both are admitted to practice in Georgia.

Amy M. Lovell, a native of Stone Mountain, Ga., is a member of the Real Estate Service Group. She graduated from the University of Georgia School of Law, Athens, Ga., in 2006. Prior to joining the firm, Lovell was a summer associate for Stites & Harbison in 2004 and 2005. Before that she worked for Bank of America as a product analyst from June 2002 to June 2003.

LaTasha V. McAlpine is a native of Montgomery, Al. She is a member of the Intellectual Property Service Group. McAlpine graduated from the Emory University School of Law in Atlanta in 2006. Prior to joining the firm, she was an Intellectual Property Law Clerk from August 2004 to April 2005 and a summer associate 2004 and 2005 for Stites & Harbison in Atlanta. In 2001 she was a summer manager for AT&T Research Laboratory in Middletown, N.J.

Prior to joining Stites & Harbison, Bennett worked as a summer associate in Stites & Harbison's Lexington, Ky., office in 2005. Before that she was a legal intern for Align Technology, Inc., Santa Clara, Calif., from 2004 to 2005.

Laura Leigh Mays is a native of Beattyville, Ky. She is a member of the Torts & Insurance Practice Service Group. Mays graduated from the University of Kentucky College of Law in 2006. Before joining Stites & Harbison, Ms. Mays was a Summer Associate, summer 2004, at Greenebaum Doll & McDonald, PLLC, Lexington, Ky. John W. Pollom, a native of Danville, Ky., is a member of the Business Litigation Service Group. He graduated from William and Mary School of Law, Williamsburg, Va., in 2006. Prior to joining Stites & Harbison, Pollom was a research assistant for Professor James Moliterno at William and Mary School of Law, Williamsburg, Va. Natalie L. Reed joins Stites & Harbison in Louisville
Stites & Harbison announced today that Natalie L. Reed joined the firm as Counsel in the Louisville, Ky., office. She is a member of the Real Estate & Banking Service Group and her practice focus is capital markets lending.

Reed's most recent engagements include representation of a client regarding a $120 million construction loan for a mixed-use town center complex in Virginia Beach, Va. She also assisted developers and property owners with acquisitions, permanent loans, leases and title issues.

Prior to joining the firm, Reed served as a junior partner from May 2002 to March 2004 and as an associate from September 1997 to May 2002 for Hale and Dorr LLP of Washington, D.C. While there, she worked with a developer regarding the construction of two new office buildings in the Navy Yard area of Washington, D.C. In one case, she successfully negotiated a purchase agreement, and in another case, she amended and restated an operating agreement through which the client acquired an interest in the property-owning entity.
