CRAVATH REPRESENTS KOS PHARMACEUTICALS IN ACQUISITION BY ABBOTT LABORATORIES
Cravath represented Kos Pharmaceuticals Inc. in its acquisition by Abbott Laboratories Inc. for approximately $3.7 billion. The lawyers involved in this matter are partners Alan C. Stephenson and Sarkis Jebejian and associates Robert A. W. Pleasant, Joel Unruch, Raffi Melkonian and Angela Olivarez on corporate matters, partner Michael L. Schler and associate Vinay Shandal on tax matters, partner Eric W. Hilfers and associates Julia Gray and Kerry Halpern-Skoglund on executive compensation and benefits matters, senior attorney Gregory J. Battista on environmental matters, and associate Robin C. Landis on antitrust matters. The deal was announced on November 6, 2006.

ANTHONY R. VACANTI JOINS BUCKINGHAM, DOOLITTLE & BURROUGHS, LLP AKRON AND CLEVELAND OFFICES
The law firm of Buckingham, Doolittle & Burroughs, LLP (“BDB”), is pleased to welcome Anthony R. Vacanti, an Associate resident in the Akron and Cleveland offices. The addition of Mr. Vacanti strengthens BDB’s real estate & construction practice. He currently assists the Real Estate & Construction Practice Group in a wide variety of matters, including assisting with hearing and oral argument preparation, researching legal issues in preparation for litigation, drafting motions and pleadings, and drafting transactional documents.

Mr. Vacanti began with BDB as a Summer Associate in 2005, continuing as a law clerk in Spring 2006. His experience includes extensive legal research and drafting in the areas of litigation, real estate, construction, contract and government law. As an intern, Mr. Vacanti investigated adult felonies for the Public Defender Service in Washington, D.C., where he interviewed witnesses and victims and worked with attorneys on details of criminal cases. He also served as a legislative intern in the United States Senate in Washington, D.C., assisting with a variety of tasks.

Mr. Vacanti earned his J.D., magna cum laude, at Case Western Reserve University Law School, Cleveland, Ohio, in 2006, where he was inducted into the Order of the Coif. He was a member of the National Moot Court Team and Moot Court Board. Mr. Vacanti was the recipient of the CALI Excellence for the Future Awards in: Criminal Procedure, Land Use Control, and Environmental Aspects of Business Transactions. He was also the recipient of the Case Law Leadership Award. In addition, he earned his B.A., Political Science and Philosophy, in 2002, from The American University, Washington, D.C.

Mr. Vacanti resides in Cleveland, Ohio.

BROWN RUDNICK PARTNER EARNS TOP RANKING AS UK TECHNOLOGY LAWYER BY CHAMBERS & PARTNERS
Brown Rudnick, a premier international law firm, today announced Rory Graham, London leader of the firm’s International Technology & Outsourcing Group, has been ranked by Chambers & Partners as a top UK lawyer in both IT and Business Process Outsourcing. Mr. Graham was noted as a “focused” lawyer who has “definitely been around the outsourcing block,” and who “knows all the arguments” having acted for both suppliers and customers. The results are published in the 2006-2007 edition of Chambers & Partners’ Guide to the UK’s Leading Business Lawyers. The full editorial can also be viewed online at www.chambersandpartners.com.

Rory Graham is consistently rated in the legal directories in the top tier of UK technology lawyers, having acted on over 100 transactions across the globe, with a deal value exceeding $26 billion. He is one of only 30 lawyers in the world to be rated by his peers as an expert in both IT and telecoms law.

Mr. Graham’s recent work has included advising on the creation of Mobile Virtual Network Operators (MVNOs) in Europe and the US, and he is noted as an expert in relation to these deals, as well as business-critical outsourcing deals. Together with practice leader Dov Scherzer in New York, he acts on some of the largest and most complex technology deals and renegotiations in the world, as well as on innovative methods of financing these deals.

Mr. Graham trained in London and Hong Kong and became a partner in technology firm Bird & Bird at the age of 27. He subsequently headed the outsourcing practice of a global law firm, before joining the London office of Brown Rudnick in February 2006.

Recent Talk by Don Freedman -- Securing Living Arrangements for People with Disabilities
Don Freedman spoke recently at a conference on “Building a Home - A Conference on the Complex Issues Families Face in Securing Supportive Living Arrangements for their Children.” He participated in a panel discussion on Home Control and Ownership through Financial Planning and Proper Estate Planning. The conference was a collaborative effort of Massachusetts Families Organizing for Change (MFOFC), the ARC of East Middlesex, the Governor's Commission on Mental Retardation and the Autism Support Center, DMR Northeast Region. It was held November 4, 2006, at the Boston University Conference Center, in Tyngsboro, Massachusetts. An article based on his remarks is on the RFG firm website.

Womble Carlyle Member to Moderate Conference on New Internet Standard
Holly Emrick Svetz, a government contracts partner in the Tysons Corner office of Womble Carlyle Sandridge & Rice, will moderate a luncheon program in Washington, D.C., on Nov. 13, 2006, on the cutting-edge topic of "IPv6 in the City - Ready or Not?"

Many may not be aware that according to a government directive, all federal agencies must make all their information systems compliant with IPv6 (Internet Protocol version 6), a new upgraded Internet standard, by June 30, 2008.

Recent studies have shown that most agencies are not on track to comply with the deadline, and many government contractors - which as a matter of good business practice need to become IPv6 compatible as well - are also behind schedule.

IPv6, which is already being rapidly adopted overseas, particularly in Asia, is superior to the current Internet because it provides vastly more Internet addresses for computers and other devices. Many estimates are that the current supply of addresses will run out within a decade or so. IPv6 also has built-in security improvements to counter hackers and other information thieves.

"IPv6 will eventually reach all of us," said Svetz, who follows developments in the field closely and is prepared to help Womble Carlyle clients make the transition to the new standard. "Those who make the transition the quickest will be in the best position to respond to government requirements and to capture commercial opportunities that IPv6 will support."

In addition to Svetz, another speaker at the Nov. 13 event will be Tom Patterson, the CEO of Command Information, a Herndon, Va., company that has been brought in by many government agencies to help with the IPv6 transition. A private equity group, the Carlyle Group, recently made a $15 million investment in Command Information. (The Carlyle Group is unrelated to the Womble Carlyle law firm.)

The luncheon event, run by the DC Tech Council and sponsored by Womble Carlyle, will focus on government contracting aspects of the IPv6 transition. It will take place at Maggiano's Little Italy restaurant, 5333 Wisconsin Avenue, N.W., in Washington, D.C. It will run from 11:30 a.m. to 2:00 p.m.

Orrick Lawyer Interviewed About U.S. Supreme Court Case
New York office leader Peter Bicks was interviewed on the Bloomberg Law radio show about a punitive damages case before the U.S. Supreme Court. Arguments were made in the Phillips Morris case, and the ruling should be decided this summer. While Bicks couldn't definitively predict how the ruling will turn out, he was able to provide observations, having tried several multibillion-dollar punitive damage cases. "We’re going to have to wait and see until we get the actual decision from the court. And we therefore have to be a little bit careful about reading too much into comments that the justices made," Bicks said. "Based on the comments that were made, there certainly is a real possibility here that the Supreme Court may not issue the broad pronouncement on punitive damages that many were hoping for.

Anderson, Trask Publish on "Results-Oriented Class Certification: Schwab v. Philip Morris
O'Melveny-DC partner Brian Anderson and counsel Andrew Trask recently published the Washington Legal Foundation Working Paper "Results-Oriented Class Certification: Schwab v. Philip Morris," which critically analyzes Senior Federal District Court Judge Jack Weinstein's recent certification of a nationwide class of light cigarette smokers asserting consumer fraud claims. The authors argue that the certification should be overturned on appeal.

They write, "When stripped of its context as part of the plaintiffs' bar's ongoing war on tobacco, the Schwab class certification order is the epitome of a sweeping, results-oriented decision that will create litigation mischief unless reversed." They add, "The big question, however, is whether Judge Weinstein's famous ability to insulate his decisions from effective appellate review -- displayed here by his scheduling of a massive trial before any interlocutory appeal can likely be heard -- will force defendants to settle a case that, procedurally, should not qualify for en masse litigation.
