Robinson & Cole LandLaw Partner Speaks at MMA Fall Conference for Selectmen
Brian W. Blaesser, a partner in R&C’s LandLaw Section, who recently published the 9th edition of his book, Discretionary Land Use Controls: Avoiding Invitations to Abuse of Discretion (Thomson-West: 2006) (click here for more) was recently invited to speak on the topic of land use reform to the Massachusetts Municipal Association (MMA) at its Fall Conference for Selectmen. In a “Point-Counterpoint” format, Mr. Blaesser gave the perspective of the real estate industry on the proposed Land Use Reform Act (LURA), smart growth, open space preservation and affordable housing, including implementation issues involving Chapter 40R, the “Smart Growth Zoning and Housing Production” Act. Mr. Blaesser and his partner, Michael S. Giaimo, served on the Commonwealth Housing Task Force that drafted Chapter 40R.

Paul Hastings Obtains Summary Judgment for Major Pharmaceutical Company
Paul, Hastings, Janofsky & Walker LLP (Paul Hastings), a leading international law firm, won a summary judgment motion on behalf of Eisai Co. Ltd. regarding the pharmaceutical company's billion dollar a year ulcer medication, Aciphex.

A federal court in Manhattan rejected claims by generic drug maker Teva Pharmaceuticals that the drug's patent claims are obvious (Eisai Co. v. Teva Pharmaceuticals USA Inc.).

The Paul Hastings team was led by New York partners Joseph O'Malley and Bruce Wexler.

Harvard Law School Student Named Fulbright & Jaworski Scholar
Dionna Little, a new Harvard Law School student, has been designated a Fulbright & Jaworski Scholar. Fulbright will pay a portion of her tuition and expenses, amounting to $10,000 during her first year of law school.

The award stems from Fulbright's role as one of the sponsors of the Lloyd M. Johnson Scholarship Program. The program was established by the Minority Corporate Counsel Association to provide financial support to outstanding minority college students who are pursuing a career in law. Each year, Fulbright participates with other law firms and corporations in selecting scholarship recipients from more than 500 applicants.

Little graduated cum laude from Washington University in St. Louis in May of this year, majoring in psychology and African and African-American studies. Among her academic awards and honors, she was a John B. Ervin Scholar, an Enterprise Scholar, a National Achievement Scholar, a National Merit Commended Scholar and a Ralph Bunche Scholar.

She also designed and conducted an original research project as a Mellon Mays Undergraduate Fellow, spent a summer in Kenya in a study abroad program and was a NFCA All-America Scholar Athlete.

Honors and Appointments Legal Business
Douglas Henderson received the Golden Eagle Award, presented in recognition of service to the mission of the U.S. Court of Federal Claims. Henderson is a founding partner of Finnegan, Henderson, Farabow, Garrett & Dunner; a former member of the Federal Circuit Claims Court’s advisory council; and a former law clerk at the U.S. Court of Federal Claims. Henderson also has served as a member of the House of Delegates of the American Bar Association. He is a founding member of the Federal Circuit Bar Association, the ITC Trial Lawyers Association, and the Court of Federal Claims.

City Bar Announces Second Annual Dewey Medal Winners
Dewey Ballantine LLP, along with the New York City Bar Association, will host their second annual Thomas E. Dewey Medal Presentation Ceremony on November 28, 2006 at 6 p.m. The award is given to an outstanding assistant district attorney in each of New York City's district attorney's offices. Court of Appeals Judge Albert M. Rosenblatt will give the keynote address, and a reception will follow. The Dewey Medal Presentation Ceremony is open to the public.

Cozen O’Connor Attorney Benjamin E. Zuckerman Featured Speaker at Jewish Employment and Vocational Service Annual Award Luncheon
Cozen O’Connor member Benjamin E. Zuckerman recently served as the featured speaker at the Jewish Employment and Vocational Service (JEVS) annual award luncheon, “Strictly Business.” The event was attended by more than 400 business and community leaders from the Philadelphia area. It recognized companies whose practices support JEVS' mission and individuals with inspiring stories of how they overcame barriers to employment through JEVS' programs.

Zuckerman is chairman of the board of directors of JEVS Human Services, one of the largest non-profit agencies in the Philadelphia region, which provides a broad spectrum of services to more than 17,000 people each year in the Delaware Valley, including job skills training and career management for the unemployed, people on welfare, and people who have lost their jobs and are seeking new avenues of employment; vocational rehabilitation and recovery services for people with developmental, physical or emotional disabilities; residential and day service facilities for disabled or developmentally challenged adults; and personal care assistance to elderly, ill or disabled people seeking to remain in their homes rather than enter a hospital, nursing home or other residential facility.

Zuckerman practices with Cozen O'Connor’s general litigation department from the firm’s Philadelphia office. He concentrates his practice in the areas of commercial and general litigation, including a broad range of civil matters, and has extensive experience in insurance defense litigation, casualty defense litigation and insurance fraud and bad faith litigation. From 1966 to the present, Zuckerman has been lead counsel in hundreds of civil trials covering a broad spectrum of commercial, personal, and insurance related matters in all levels of state and federal courts. Additionally, he served as an assistant district attorney in Montgomery County, Pennsylvania in 1968 and 1969.

Zuckerman is an adjunct professor of Advanced Trial Advocacy at Temple University Beasley School of Law. From 1994 through 1998, he was an adjunct professor of Trial Advocacy at the Rutgers University School of Law Camden, New Jersey. He has often served as a presenter at bar association continuing legal education programs and seminars, and has also served as a faculty member on several occasions for the Pennsylvania Defense Institute Trial Advocacy Program for attorneys. In 1992, Zuckerman was inducted as a fellow in the American College of Trial Lawyers. In 2005 and 2006, he was selected as one of Pennsylvania’s "Super Lawyers" by Philadelphia magazine.

Zuckerman earned his undergraduate degree from Pennsylvania State University (B.A., 1963) and his law degree from Georgetown University Law Center (J.D., 1966), where he was an associate editor of the Georgetown Law Review. He is admitted to practice in Pennsylvania, and is a member of the American, Pennsylvania and Philadelphia bar associations.

Covington Advises Abbott Laboratories in $3.7 Billion Acquisition of Kos Pharmaceuticals, Inc.
Abbott Laboratories (NYSE: ABT) announced the acquisition of Kos Pharmaceuticals (NASDAQ: KOSP) through a cash tender offer of $78.00 per common share, or $3.7 billion.

Covington & Burling LLP represented Abbott in the transaction. Abbott is a global, broad-based health care company devoted to the discovery, development, manufacture and marketing of pharmaceuticals and medical products, including nutritionals, devices and diagnostics.

The Covington team was led by Catherine Dargan, John Hurvitz and Scott Smith and included corporate associates Andrew Ment, Marianna Horton, Ingrid Loreen, Marcus Weiss and Michael Tzartzouras.
