Holland & Hart Welcomes Delissa Hayano To The Cheyenne Office
Holland & Hart is pleased to announce that Delissa Hayano has joined the firm's Litigation Department.

Ms. Hayano is an associate in the firm's Environmental & Resources group. In law school, she served as Editor-in-Chief of the Wyoming Law Review, worked with the University of Wyoming's General Counsel on higher education issues, and interned with Judge Wade Waldrip and Judge Jeffrey Donnell, District Court of the Second Judicial District of Wyoming. Prior to law school, Ms. Hayano taught English at the university and high level and was named Wyoming's First-Year Teacher of the Year in 1996.

Holland & Hart Welcomes Six New Associates
Holland & Hart is pleased to announce that Buck Beltzer, Sarah Marks, Scott Martinez, Cathryn Milkey, Tasha Newland, and Alyssa Yatsko have joined the firm's Denver office.

Mr. Beltzer is a member of the Construction and Real Estate practice group. Prior to joining Holland & Hart, Mr. Beltzer practiced as a professional civil engineer in private practice in Colorado and North Carolina. He received his J.D. (2006) from the University of Denver College of Law and his Bachelor of Civil Engineering (1999) from Auburn University.

Ms. Marks is a member of the Employee Benefits practice group. Prior to joining Holland & Hart, she served as the Deputy Press Secretary to U.S. Senator Evan Bayh. She received her J.D. (2006) from the University of Virginia School of Law and her B.A. (2000) from Williams College.

Mr. Martinez is a member of the Litigation Department. Prior to his legal career, he worked in the world of politics serving as campaign manager to both federal and state candidates and acting executive director of the Colorado Democratic Party. He received his J.D. (2006) from the University of San Diego School of Law and B.A. (2000) from the University of Colorado at Boulder.

Ms. Milkey is a member of the Business Department. Prior to her legal career, Ms. Milkey was a Senior Research Associate for a market research firm and a member of AmeriCorps Cape Cod. She received her J.D. cum laude (2006) from the University of Notre Dame Law School and her B.A. (2000) from the University of North Carolina at Chapel Hill.

Ms. Newland is a member of the Environmental Compliance practice group. Previously, she was an Associate Environmental Scientists at MWH where she performed human health and environmental risk assessment analysis for dozens of contaminated sites. She received her J.D. (2006) from the University of Denver College of Law and her B.S. (2001) from the University of Washington.

Ms. Yatsko is a member of the Labor and Employment practice group. Previously, Ms. Yatsko served as a Registered Client Services Associate at a financial services company where she helped create and monitor financial plans. She received her J.D. (2006) from the University of Denver College of Law and her B.A. (2000) from Northwestern University.

Attorneys present to MULTILAW Annual Meeting in Beijing, China
Frost Brown Todd Members, Greg E. Mitchell and Susan Grogan Faller, have recently returned from Beijing, China, where they were featured speakers at MULTILAW’s Annual Meeting hosted by Jun He Law offices in Beijing, China. Mitchell presented, “The Challenges for China as an Exporter – the U. S. Perspective,” and Faller presented “Advertising in China.

Their presentations come on the heels of the October announcement of Frost Brown Todd’s strategic alliance with Hubei Sunshine Law Firm. The firm is located in the Hubei Province, which is the sister province to the U.S. state of Ohio. Frost Brown Todd has three offices in Ohio.

Mitchell’s practice is concentrated in the areas of international regulation and trade compliance and insurance/risk management, and chairs the Firm's trade compliance practice group within the International Services Group. Prior to joining the Firm, he was associated with the High-Technology/International Trade Practice Group of Buchanan Ingersoll, P.C. and with American Export Group International Services, Inc., a Washington D.C. / Baltimore based export corporation doing business mainly in Western Europe and the Middle East.

Faller is the MULTILAW Media, Advertising and Entertainment Special Interest Practice Group Leader and chairs FBT’s First Amendment, Media and Advertising Practice Group. During her years of practice with the Firm, she has represented various advertising and media clients in connection with clearance, claims substantiation, unfair competition, defamation, disparagement and invasion of privacy matters and lawsuits. Ms. Faller is a past president of the Media Law Resource Center Defense Counsel Section, which is an international association of media lawyers.

MULTILAW is an international organization with member firms in every major commercial center. Other presenters at the conference included Dalton Albrecht on the Canadian Perspective, Horst Teller on the EU Perspective and China's negotiator to the WTO, Ms Yuejiao Zhang.

Clark joins FBT Nashville
Frost Brown Todd LLC (FBT) welcomes attorney, Sarah M. Clark to the Nashville office. Clark will practice in the Business & Corporate and Commercial Transactions/Real Estate Departments.

Originally from, Hendersonville, Clark is a 2006 graduate of Vanderbilt University School of Law. During the summer of 2004, Clark clerked for the Honorable John S.W. Lim in Hawaii’s Intermediate Court of Appeals. A 1999 graduate from Beech High School, she went on to receive her BBA in Marketing from Belmont University, graduating summa cum laude in 2003.

Filing EEOC Charge Precludes Complaint Under North Carolina Disability Law
In a case handled by Ford & Harrison attorneys Wade Ballard and David Tyner, an appeals court in North Carolina has held that an individual cannot file a complaint in state court under North Carolina’s disability law if that person has filed a charge under the Americans with Disabilities Act (ADA) with the Equal Employment Opportunity Commission (EEOC). See Bowling v. Margaret R. Pardee Memorial Hospital (Oct. 17, 2006). The decision in this case is the first time an appeals court has specifically addressed the issue of whether the filing of an administrative charge precludes the filing of a state court claim under the North Carolina Disabilities Act (NCDA).

In this case, Bowling was discharged because of job performance and subsequently filed an EEOC charge claiming his discharge violated the ADA. While that charge was pending, Bowling filed suit in North Carolina state court, claiming, among other things, that his discharge violated the NCDA. The trial court dismissed Bowling’s NCDA claim, and the appeals court upheld this decision based on the language of the NCDA.

Delaine Smith practices in all areas of employment law. She litigates claims of discrimination and harassment under Title VII, the ADA, the ADEA, and the FMLA, as well as state law tort and contract claims. Ms. Smith is active in the Federal Bar Association (Labor & Employment Section Officer and Governing Board; past chapter President), and is AV® Peer Review Rated by Martindale-Hubbell. She received her law degree from the University of Memphis Law School (J.D., 1991).

Keith Warren has exclusively represented management in employment litigation and traditional labor law under the NLRA for the past 30 years. Nationwide, he has acted as lead counsel in more than 100 union representation cases, negotiated hundreds of union collective bargaining agreements, and handled numerous arbitrations and employment litigation trials. Before entering private practice, Mr. Warren was a Judge Advocate in the U.S. Air Force and a trial attorney for the National Labor Relations Board. FagelHaber Names Joel Dalinka Head of Commercial Finance & Secured Transactions Department
FagelHaber LLC announced that it has named Joel Dalinka to chair its Commercial Finance & Secured Transactions Department, which includes many of the firm’s attorneys who work on all facets of negotiating, drafting and enforcing lending and credit transactional documentation.

“Joel is the ideal choice to lead the practice area,” said Joel Haber, FagelHaber’s Chairman. “He is highly respected within the firm and throughout the business community, and he will be a terrific leader for the practice area.”

Joel Dalinka, 35, has been with the firm since 1999 and concentrates his practice in representing lenders and borrowers in commercial, asset-based, mortgage and other loans. He has represented a broad base of clients, including institutional lenders, borrowers, finance companies, manufacturers, distributors, lessors and lessees, and purchase money secured sellers.

Joel Dalinka received his J.D. cum laude from Northwestern University School of Law and was an editor for the Law Review. He received his B.S. degree in accounting with high honors from the University of Illinois at Urbana-Champaign. Joel Dalinka is a Certified Public Accountant who worked as a tax accountant at a former “Big 6” accounting firm before practicing law.
