AV&H Represents Purepac Pharmaceutical Company in Metformin Launch
AV&H represented Purepac Pharmaceutical Company in connection with its launch of various products containing the active ingredient metformin. The firm provided patent and FDA advice and also represented the company in two cases involving exclusivity disputes under the Hatch-Waxman Act. In one case, AV&H lawyers successfully obtained a temporary restraining order from the U.S. District Court for the District of Columbia against the Food & Drug Administration’s award of generic marketing exclusivity relating to metformin hydrochloride extended-release tablets, 500 mg, currently marketed by Bristol-Myers Squibb Company under the trade name Glucophage® XR. A hearing on Purepac’s motion for preliminary injunction was held on November 12, 2003, at which AV&H argued that FDA’s actions were arbitrary and capricious in light of the statutory mandates set forth in the Hatch-Waxman Amendments and FDA’s regulatory scheme. Purepac successfully negotiated a settlement of the case shortly thereafter.

Stanley Defends Its Colors, Trade Turfs
AV&H successfully represented The Stanley Works in its declaratory judgment action against Black & Decker, which had asserted trademark challenges against Stanley's use of a yellow and black color scheme on certain products and packaging. After extensive discovery in which AV&H prevailed on a motion for sanctions against Black & Decker, and with AV&H's motion for summary judgment pending, the firm secured the dismissal of Black & Decker's trademark challenges, thereby ensuring that Stanley could continue to employ its long-established color scheme unchanged.

AV&H Successfully Concludes Foreign Auction Bid Rigging Case
AV&H successfully represented Enron International Korea (EIK) in an antitrust action against Credit Suisse First Boston (CSFB) in the Southern District of New York. The complaint alleged that when EIK attempted to auction certain of its energy assets, CSFB conspired with domestic and foreign bidders to rig the auction. After AV&H obtained expedited foreign discovery, EIK was able to obtain a favorable business settlement.
