Paul, Weiss Achieves Victory for Martha Graham Center of Contemporary Dance
Paul, Weiss won a major victory this week for the Martha Graham Center of Contemporary Dance in a landlord-tenant dispute in New York Supreme Court. The plaintiff, landlord NYC Goetz Realty Corporation, had sued our client for rents remaining under an unexpired lease after Martha Graham vacated its offices due to intolerable conditions created by plaintiff’s demolition and construction work in the building. Martha Graham asserted numerous defenses and counterclaims, including constructive eviction and breach of the covenant of quiet enjoyment. Before the parties conducted discovery, plaintiff moved for partial summary judgment on the complaint and dismissal of Martha Graham's defenses and counterclaims. Justice Emily Jane Goodman denied plaintiff’s motion, concluding that issues of fact exist as to the severity of the office's condition and whether the construction was ongoing when Martha Graham vacated. The Paul, Weiss team includes litigation partner Lynn Bayard and associate Darren Johnson, real estate partner Meredith Kane, former litigation associate Dawn Barker and litigation associate Allison Cohn.
