Stephen V. Falanga Named To NJBIZ Magazine's List of 'Forty Under 40'
Connell Foley LLP announced today that Stephen V. Falanga was honored as one of the “Forty Under 40” at a recent awards ceremony. The recognition came from NJBIZ Magazine which also hosted the awards ceremony on Monday, November 6th in Woodbridge, New Jersey. Falanga was chosen from a field of nominees for his outstanding achievements and his ethical pursuits.

The Forty Under 40 awards program honors men and women who have been making headlines in their field and who share a commitment to business growth, professional excellence and the community. The awards program is sponsored by AXA Advisors, and Wiss Certified Public Accountants.

Mr. Falanga is a partner at Connell Foley where he specializes in Banking Law and Finance, Bankruptcy and Corporate Law. Mr. Falanga joined Connell Foley in 1993, after completing a clerkship with the United States Bankruptcy Court for the District of New Jersey. He currently chairs the Firm’s Hiring Committee and also sits on the Firm’s Marketing Committee.

Five WRF Partners Receive Top Honors in National Rankings
The Lawdragon 500 Leading Lawyers in America has recognized Wiley Rein & Fielding’s Richard E. Wiley and Lawrence W. Secrest, III as being among the nation’s 500 best lawyers. Lawdragon ratings are based on extensive research, online balloting and phone interviews of law firms’ clients, colleagues and competitors.

Fewer than 0.01 percent of all lawyers in America are named to the Lawdragon 500 list, representing the absolute best lawyers in America. Lawdragon notes that Dick Wiley, the former Federal Communications Commission chairman, “guides the legal work of communications giants Viacom, Verizon, Motorola and more.” Lawdragon recognizes Lawrence Secrest for his practice within the Telecommunications Practice Group at Wiley Rein & Fielding.

Also, The Lawdragon 3000 Leading Lawyers in America has recognized partners Thomas W. Brunner, Laura A. Foggan and Daniel J. Standish as well as Dick Wiley and Larry Secrest as being among the nation’s 3,000 best lawyers. This list represents fewer than 1 percent of America’s lawyers and is culled through the same research methods used in the Lawdragon 500. All three WRF partners represent the firm’s renowned Insurance Practice Group. Tom Brunner chairs the Group at WRF, Dan Standish chairs the Professional Liability Group and Laura Foggan is an Insurance partner who also co-chairs the Appellate Practice Group at the firm.

In compiling the Lawdragon 500 and the Lawdragon 3000, researchers from Los Angeles-based Lawdragon Inc. evaluated attorneys on four primary factors: subject-matter knowledge, client service, reputation and value.

CLE Professionalism Credit Granted for Workshop on Legal Project Management
One hour of Professionalism credit and general Continuing Legal Education (CLE) credit is available for attorneys who participate in a new workshop on Legal Project Management.

The workshops will be conducted for in-house lawyers and general counsel interested in improving the delivery of legal services through the use of project management. Representatives from Morris, Manning & Martin, LLP will coordinate the workshops and provide an in-depth look into project management as a means of delivering legal services on time and on budget, and enhancing the professionalism within the attorney-client relationship.

The workshops focus on the efficiencies obtained by using project management in performing legal services in areas such as mergers and acquisitions, litigation and dispute resolution, and patent and intellectual property prosecution. In addition, case studies where legal project management has been used to improve communications, efficiency and transparency in the delivery of legal services by inhouse and outside legal counsel will also be examined.

Topics to be covered in the workshops include:
• What is legal project management?
• How to use project management in delivering legal services
• How project management can be used to increase efficiency and control costs in managing

legal projects
• The 10 steps to adopting and implementing legal project management
• Using legal project management – case studies
Speakers on legal project management will include:

Former Buckeye to Kickoff Schottenstein Zox & Dunn United Way Campaign
Coinciding with central Ohio’s most anticipated day in sports, Schottenstein Zox & Dunn (SZD) will be holding its annual United Way Campaign throughout the week before The Ohio State University (OSU) football game against University of Michigan. To kickoff the charitable event, SZD is proud to have one of OSU’s former players as their guest of honor.

Roger Harper, former defensive back for the OSU football team from 1989-1992, will serve as SZD’s guest speaker at the firm’s Annual United Way Kickoff Luncheon on Friday, November 10 at 11:45 am. The event will take place at the firm’s offices and will officially begin SZD’s week-long campaign, concluding at their “Beat the Blue Bash” on Friday, November 17 at 4:30pm.

“Our United Way Campaign Kickoff offers a unique opportunity to get our professionals excited about both the upcoming big game and of course SZD’s efforts to raise funds for the United Way through their dedicated support,” said Smokey Williams, SZD’s Director of Operations and United Way Committee member.

SZD also holds numerous raffles and a silent auction to raise funds for the United Way during the kickoff week. The firm’s 2007 United Way Committee includes Malinda Susalla, Eve Ellinger, Nell Chambers, Karen Pierson and Smokey Williams.

AVIATION LITIGATION FIRM, MOTLEY RICE LLC, FILES SUIT AGAINST WEST CARIBBEAN AIRWAYS AND OTHERS IN CONNECTION WITH AUGUST 2005 CRASH
One of the largest plaintiffs' aviation litigation firms in the world, Motley Rice LLC, today announced that it has filed suit against Colombian-based West Caribbean Airways, as well as US-based companies MK Aviation (as well as its owner and its aliases), and others on behalf of the family of several passengers who died in the crash of West Caribbean Airways Flight 708, which took place on August 16, 2005 in a mountainous region in northwest Venezuela.

The plane, a McDonnell Douglas MD-82, was en route from Panama City, Panama to Fort de France, Martinique at the time of the crash. According to accident reports, after a 7,000 feet-per-minute dive, the plane crashed into a field in the western state of Zulia, Venezuela. All 160 passengers and crew were killed. The death toll of the crash makes it one of the deadliest of 2005, worldwide, and the second worst crash ever involving an MD-80. West Caribbean Airways Flight 708 is the 20th loss of an MD-80, since the aircraft was brought into service in 1980 and the deadliest air disaster in the history of Venezuela.

According to the complaint, West Caribbean Airways had recently leased the aircraft from defendant MK Aviation, Inc., a Nevada company with operations in the United States. Prior to MK Aviation's purchase, the aircraft had sat in desert storage in California for nearly four years -accumulating more than 48,000 hours and 23,000 cycles - thus requiring expensive parts and highly trained technicians to ensure its return to airworthiness. However, according to the lawsuit, West Caribbean, which had suffered a prior airline disaster in March 2005, was under dire financial stress. The company had been cited by the Columbian Civil Aviation Authority (Aerocivil) with 14 "very serious violations to aviation safety." Because of these infractions, Aerocivil had placed a hefty fine on the airline. This fine was then reduced due to the airline's poor financial condition.

Yet, despite allegedly knowing about the financial stress of West Caribbean and the safety violations and suspended operations, defendant MK Aviation leased the aircraft to the airline. That following May, the Columbian Ports and Transportation Supervision Department imposed an injunction on West Caribbean, based on its poor financial condition. According to the complaint, this injunction was based on an evaluation of West Caribbean's financial statements that diagnosed an inevitable business failure. Nevertheless, it is alleged that West Caribbean willfully, wantonly and recklessly continued to fly its dangerous aircraft, and failed to provide the proper training or rest for its crews, needlessly risking the lives of every passenger that boarded its planes. In addition, the lawsuit claims that West Caribbean circulated lists soliciting desired "black market" parts, unregistered and unapproved, that render an aircraft unairworthy, just in order to keep the plane flying.

Furthermore, two Florida-based companies, Newvac Corporation and Go 2 Galaxy Inc., and its principal, Jacques Cimetier, contracted with West Caribbean to provide air travel for passengers between Martinique and Panama. In May 2005, these two companies submitted a request to the government of France seeking approval for West Caribbean to operate the flights. As a precondition, the companies had to demonstrate that the aircraft was properly insured. However, West Caribbean's insurance lapsed in July 2005.

On August 16, 2005, the inevitable happened. Flight 708 from Panama to Martinique crashed in Venezuela, killing all 160 passengers and crew.

"We believe the defendants, including those with operations in the U.S., took advantage of U.S. laws to form a deadly loophole carrier. Unless we act to hold these parties accountable, we will see this disaster repeated by encouraging loophole international passenger service," said Motley Rice attorney Mary Schiavo. "Here we have Nevada corporations with agents and offices in Florida, Texas and California, buying and leasing old aircraft, to an airline which because of safety lapses was grounded. It even lost its insurance. Despite these dangerous conditions, two U.S. companies contracted with that grounded uninsured carrier to fly passengers in other countries. We seek to hold them accountable under the very same U.S. laws we believe they used and abused to run this deadly loophole airline."

"With the number of U.S. aircraft retiring from service, we must hold these companies accountable for their actions, or the carnage will continue," said Motley Rice aviation attorney and former commercial airline captain, Don McCune. "I have flown old aircraft, which under U.S. regulation, were meticulously inspected and maintained. Without accountability, companies like these will continue to take our oldest aircraft from our scrap heaps, farm them out to marginal carriers, and reap huge profits."

This case was filed in U.S. District Court, Southern District of Florida and included the following defendants: West Caribbean Airways, The Aeronautics of Astronautics Services, USA, Inc., MK Aviation, MK Leasing, MKA Capital, Mordechay Kraselnick, also known as Mory Kraselnick, also known as Mordechai Kraselnick, Globe Trotters de Riviere Salee Travel, Samir Cvrk, Valerie Cvrk, Newvac Corporation, Go 2 Galaxy, Inc., Jacques Cimetier, Asegeuradoro Colseguros, S.A., and Sancom Resources Recovery, Inc.

A team of lawyers from the Newark office of McCarter & English LLP represented Prudential Real Estate Investors, the real estate investment management and advisory business of Prudential Financial, Inc., in a $4 billion acquisition of the retail assets of Pan Pacific Retail Properties, Inc., in a joint venture with Kimco Realty Corporation.
