Foley Expands Litigation Department With Addition of Jeffrey R. Blease
Foley & Lardner LLP announced today that Jeffrey R. Blease has joined its San Diego office as a partner and member of the Litigation Department and the General Commercial Litigation and Construction Practices.

“The national trial experience that Jeff brings to the firm will enhance the litigation services we provide both nationally and on the West Coast,” said Jon Wilson, chair of the firm's Litigation Department. “His intimate involvement and depth of experience with the construction community also will prove to be a great resource for our clients.”

Blease joins Foley from his former firm of Blease & Zuccaro, LLP, where he was a founder and managing partner. He has extensive jury trial experience in multiple jurisdictions and enjoys distilling complex matters into concepts and themes a jury can understand. Blease has tried cases spanning a number of issues from business disputes to construction cases with tens of thousands of documents.

Over the last 18 years, Blease has focused his practice on general business litigation and construction issues including contracts and litigation representing owners, developers, contractors and subcontractors. He concentrates on “shovel to gavel” representation, meaning he oversees all legal aspects of a construction project, including permitting, zoning, licensing, environmental issues and contract disputes with consultants, subcontractors, suppliers and others. Blease has handled construction matters across the nation as well as eminent domain cases for landowners.

Prior to joining Foley, he served on the Sartell, MN, City Council for 10 years, chaired the Public Works Commission, served on the Economic Development Commission, and on the Area Planning Organization, the intergovernmental planning group, in St. Cloud, MN.

Sudha Shetty Receives Equal Justice Works Award
Dorsey diversity consultant Sudha Shetty was recently honored with a national Equal Justice Works Award, the Puget Sound Business Journal reported. Shetty, a native of India, has focused her efforts at providing legal services for underserved residents of Seattle, including immigrant populations and victims of domestic violence.

"When I think back about ten years ago, I couldn't see the light at the end of the tunnel," said Shetty, who lost custody of her young children after her arranged marriage ended in divorce ten years ago. "But now here are my kids, graduating from college, and I have an incredible job at a law firm that believes in diversity and in pro bono work - I feel very blessed.

Covington’s Peter Nickles Named General Counsel to DC Mayor-Elect Adrian Fenty
Peter Nickles, highly regarded partner and now senior counsel at Covington & Burling LLP, has been appointed General Counsel and Senior Advisor to newly elected DC Mayor Adrian Fenty. Mr. Nickles will assume his new position in early 2007.

At Covington, Mr. Nickles’ practice emphasizes major class actions involving securities fraud and toxic torts; jury and non-jury trials; defensive takeover litigation and other high-profile litigation; international arbitrations; as well as antitrust and trade law and federal regulatory practice. Over the last four and one-half decades, he has also represented numerous Fortune 500 companies against insurance carriers in complex insurance coverage disputes.

Mr. Nickles has fought for the rights of poor and disadvantaged persons through social, institutional, and political reform throughout his career. His commitment to public service dates back to his early days as a lawyer, when he was counsel to the Jackson State Task Force and the Kent State Task Force, reporting to the Scranton Commission on Campus Unrest. From 1970 to 1975, he chaired Covington’s program at Neighborhood Legal Services Program (NLSP) in Washington, DC. He was an adjunct professor at Howard Law School from 1980 to 1992.

Mr. Nickles has litigated important cases to protect the rights of the District’s most marginalized citizens. As class counsel in Dixon v. Barry, filed in 1974, he helped secure significant relief for thousands of homeless and mentally retarded residents of the District of Columbia. This case, which required nearly 30 years of litigation, resulted in the creation of community-based services for persons with mental illness.

Mr. Nickles has also been involved in several cases that have been instrumental in reducing violence, alleviating overcrowding, and improving Medicaid and mental health services for prisoners in the District of Columbia. In Twelve John Does v. District of Columbia and in John Doe v. District of Columbia, he was appointed by the United States District Court to represent all of the prisoners confined to the District of Columbia’s Central and Maximum Security Facilities regarding a plethora of unconstitutional conditions. In Inmates of the Modular Facility v. District of Columbia, he skillfully negotiated an effective Consent Decree designed to cure constitutional deficiencies in security, health care, sanitation, and fire safety. In Woman Prisoners v. District of Columbia, class-action litigation brought on behalf of the District’s women prisoners, he won an injunction requiring the District of Columbia to provide adequate reproductive health care, to take steps to prevent sexual abuse, harassment, and other relief.

In May 1998, he received the District of Columbia Bar Association’s Pro Bono Service Award for his years of public service in connection with a number of cases affecting the citizens of the District of Columbia.

Birk Appointed Colorado Bar Fellow/Honored as Children's Advocate
Denver partner Mary Birk has been invited to become a Fellow of the Colorado Bar Foundation. Selection as a fellow is limited to no more than five percent of the lawyers in Colorado and "is recognition of a lawyer as one whose professional, public, and private career has demonstrated outstanding dedication to the welfare of the community, the traditions of the profession and the maintenance and advancement of the objectives of the Colorado Bar Association."

The Colorado Bar Foundation promotes the advancement of jurisprudence, the administration of justice and the dissemination of educational information to practicing attorneys and to members of the general public through grants and contributions.

Birk was also honored by the Rocky Mountain Children's Law Center for her volunteer efforts with its "Denver Prevention Partnership" program which, in partnership with the Denver Department of Human Services (DDHS), pairs volunteer attorneys with at-risk children to strengthen and preserve their families without court intervention. Volunteer attorneys are assigned to a family and asked to meet with them regularly, help develop a services plan, monitor their progress and participate in Team Development Meetings at DDHS.

Sanford Addresses Practising Law Institute: "Communications Law
Washington, D.C., partner Bruce Sanford, who has been described by American Journalism Review as one of the most accomplished press lawyers in the nation, was invited to be a speaker at the Practising Law Institute's "Communications Law" program held November 9-10 in New York City.

Sanford was a speaker on a panel which addressed libel issues, including: Are courts increasingly hostile to libel defendants who refuse to disclose confidential sources?; How should courts rule when libel plaintiffs seek to unmask anonymous web posters?; Do disclaimers of defamatory meaning count for anything?; Does a university professor become a limited purpose public figure when he makes anti-war statements during class discussion?

FSA Fines Foresters Friendly Society for Misleading Commercials
Foresters Friendly Society has been fined by the Financial Services Authority (FSA) for promoting financial products to elderly consumers in "substandard" commercials. Dechert LLP lawyer, Richard Heffner, says the level of fine does not appear to be out of line with fines in other financial promotion cases but because Foresters is a mutual fund, the fine in this case would have been primarily borne by Foresters' customers. The FSA says it imposed the fine on the Ancient Order of Foresters Friendly Society because the firm failed to promote financial products to consumers in a way that was clear, fair and not misleading.

Aaron Benjamin, an attorney in the Capital Markets Department in Charlotte, focuses on structured finance, derivative products, other innovative limited-recourse lending transactions, secured transaction law and the federal securities laws. He received his J.D. from the University of Toronto Law School and his undergraduate degree, with high honors, from Carleton University. He is admitted to practice in the State of New York.

Resident in the New York Litigation Department, Jeffrey S. Burman concentrates in the resolution of reinsurance disputes, including litigation, arbitration and mediation, and the representation of insurers, reinsurers, banks, investment banks, hedge funds, and private equity funds in insurance and reinsurance based transactions. He received his undergraduate degree from the University of Delaware, and his law degree from Rutgers University School of Law, where he was an editor of the Rutgers Law Journal.

Michelle R.
