Lowenstein Sandler PC Bolsters Tech and Corporate Practices with Arrival of Three New Members
Lowenstein Sandler PC announced today that three new Members have joined the Tech Group and Corporate Department in New York and New Jersey. Michael J. Lerner joins the Lowenstein Sandler Tech Group and will focus on the representation of pharmaceutical, life science and other entities in the healthcare industry. Lowell A. Citron and Lawrence Cohen join the Corporate Department, focusing on Specialty Finance and Investment Management, respectively.

Lowell A. Citron
Corporate, Specialty Finance - New York
Lowell A. Citron returns to Lowenstein Sandler from Loeb & Loeb LLP in New York, where he served as partner in the Commercial Finance and Bankruptcy & Restructuring Groups. Mr. Citron brings to Lowenstein Sandler’s Equity Finance and M&A practices several years of experience representing money center financial institutions, hedge funds, private equity funds, REITS, major investment banks and commercial finance companies. He has strategically advised some of the largest funds and financial institutions in connection with leveraged transactions and business restructuring.

Mr. Citron is a member of the Association for Corporate Growth and the Association of Commercial Finance Attorneys. Additionally, he is a member of the New York State Trooper Foundation and sits on the Board of Directors for the Birchwood Civic Association of Jericho, New York. Mr. Citron received his J.D. from Fordham University School of Law and is admitted to practice in New York.

Lawrence Cohen
Corporate, Investment Management - New York
Lawrence Cohen has nearly two decades of experience in securities regulatory matters. He was most recently a Corporate Partner at Fox Rothschild’s Princeton office and, earlier in his career, served at Guardian Life and Lehman Brothers as compliance director and as secretary of a family of retail and institutional mutual funds. Mr. Cohen’s securities practice covers both transactional and regulatory matters, with a focus on investment company, capital markets, and corporate governance matters. Mr. Cohen has counseled both issuers and underwriters/placement agents in public and private offerings, and has advised clients on franchise and distribution arrangements. Mr. Cohen’s client base has an international scope.

Mr. Cohen is a member of the New Jersey State Bar Association, the Business Law division of the American Bar Association, and the Compliance and Legal Division of the Securities Industry Association. Additionally, he is has been a Board Member of the Children’s Home Society of New Jersey for five years. Mr. Cohen received his J.D. from the University at Buffalo School of Law, State University of NY, and is admitted to practice in New York and New Jersey.

Michael J. Lerner joins Lowenstein Sandler following a six-year tenure serving as Vice President, Legal Affairs & Secretary at Reliant Pharmaceuticals, Inc., one of the country’s largest privately held pharmaceutical companies. He holds over twenty years’ experience providing legal counsel to the pharmaceutical, life science and healthcare industries with significant expertise in product acquisitions and divestitures, technology licensing, pharmaceutical sales and marketing practices and other matters relevant to the pharmaceutical industry.

Previously, Mr. Lerner practiced law at the law firm of Gibbons, Del Deo, Dolan, Griffinger & Vecchione, where he served as associate and later as partner in the firm’s Corporate and Finance Department where he was Chairman of the Firm’s Pharmaceutical and Life Science practice. He received his J.D. from Hofstra University School of Law, and is admitted to practice in New Jersey and the District of Columbia.

Karen Kaczmarski Appointed as Adjunct Faculty Member at Hilbert College
Karen R. Kaczmarski, a litigation attorney in the Buffalo office of Harter Secrest & Emery LLP, was recently named as an adjunct faculty member for Hilbert College. She is teaching civil litigation classes in the College’s Legal Studies Department.

Kaczmarski has more than 15 years' experience litigating and trying complex commercial cases in federal and state courts throughout the country. Her practice includes complex breach of contract and business-related tort litigation, including employment contract, trademark infringement, unfair competition, and securities fraud matters. In addition, she handles professional liability cases, including the defense of attorneys in negligence and breach of contract matters and the prosecution of actions against attorneys and ccountants for professional negligence in contract and related business matters.

She received her J.D. from the State University of New York at Buffalo Law School and
her B.A. from the State University of New York at Buffalo.

Labaton Sucharow & Rudoff LLP Settles Securities Class Action Against Transaction Systems Architects for $24.5 million
Labaton Sucharow & Rudoff LLP announces that it has signed a Stipulation of Settlement, on behalf of its client the Genesee County Employees’ Retirement System, to settle the securities class action titled Desert Orchid Partners, L.L.C. v. Transaction Systems Architects, Inc., No. 02 CV 553 (D. Neb.), for $24.5 million in cash.

The proposed Settlement is subject to Court approval. The proposed Settlement will resolve claims brought by Genesee County, as Lead Plaintiff, on behalf of a class of persons and entities that purchased the common stock of Transaction Systems Architects, Inc. between January 21, 1999 and November 19, 2002 (the "Class Period"). Labaton Sucharow is the Court-appointed Lead Counsel for Lead Plaintiff Genesee County. Labaton Sucharow and Genesee County believe the proposed Settlement represents an excellent result for the Class given the stage of the litigation, the ranges of possible recovery, and the myriad risks of continued litigation.

In the litigation, Genesee County generally alleged that TSA and certain of its former executives, during the Class Period, prematurely recognized millions of dollars of revenue from certain software licensing arrangements and issued annual and quarterly financial statements that did not conform with generally accepted accounting principles (GAAP), in violation of the Securities Exchange Act of 1934.

According to Warren Vyvyan, Chairman of the Board of the Genesee County Employees’ Retirement Commission, "We are satisfied that this settlement will serve as a deterrent to corporate fraud and are pleased to present the proposed Settlement to the Court for approval." George Martini, Controller of Genesee County and Plan Administrator of the Genesee County Employees’ Retirement System, stated: "We believe the result achieved by our counsel, Labaton Sucharow & Rudoff LLP, is indeed a good one for our beneficiaries, and shareholders will benefit from the substantial sum recovered." Emily C. Komlossy, Esq. a partner with Labaton Sucharow and lead counsel for Genesee County in this action, noted "From the outset, it was our goal to achieve a positive outcome in this case, and we are, as well, very pleased with the result."

The parties expect to file the Settlement Agreement and exhibits with the Court and seek preliminary approval of the Settlement shortly. This press release is not a Court-approved notice to Class members. If the Court grants preliminary approval to the Settlement, a Court-approved notice will be mailed to Class members within the next several weeks.

Samuel C. Kauffman and Robert C. Weaver, Jr. Honored with Judge Learned Hand Award
Garvey Schubert Barer's Samuel C. Kauffman and Robert C. Weaver, Jr. were among the 13 Oregon attorneys honored today by the Portland Chapter of the American Jewish Committee with the Judge Learned Hand Award, given annually for representation in the "finest tradition of the legal profession." This year's recipients were presented the award for their commitment to defending those held in illegal detention at the Guantanamo Bay Naval Station.

Mr. Kauffman, Of Counsel in GSB's Portland office, practices in the areas of litigation and white-collar criminal defense. He has extensive experience representing individuals and organizations in complex criminal and regulatory matters. He also has experience conducting and coordinating internal corporate investigations. He earned his J.D. (1994) from Willamette University College of Law and his B.S. (1989) from Colorado State University.

Mr. Weaver, an Owner in GSB's Portland office, focuses his practice on complex business and tax litigation and white-collar criminal defense. His criminal defense practice is broad and includes representation of clients subject to government regulatory investigations which have potential civil and criminal penalties, performing protected, internal corporate investigations, and all aspects of trial and appeal.

Garvey Schubert Barer Adds Five Attorneys to Seattle and Portland Offices
Garvey Schubert Barer is pleased to announce that it has added five new attorneys to two of its five offices. Mark G. Jackson and Richard S. Wyde have joined the Seattle office as Owners. Mark G. Jackson, an Owner in GSB's Seattle office, practices in the areas of government contracts, construction litigation and alternative dispute resolution. Mr. Jackson represents companies doing business with the government (federal, state and local), resolving disputes arising from the award and performance of government contracts and defending against government audits, investigations and defective pricing claims. An experienced construction litigator, Mr. Jackson represents subcontractors, contractors, and sureties in public and private construction disputes. He earned his J.D. from Southern Methodist University School of Law in 1988, where he was named Outstanding Graduate in Trial Advocacy, and his B.S. from the United States Air Force Academy in 1983, where he was named Outstanding Graduate in Law. He is admitted to practice in Washington; before the U.S. Court of Appeals, Ninth Circuit and Federal Circuit; and before the U.S. District Courts for the Western District of Washington and the Court of Federal Claims.

Richard S. Wyde, an Owner in GSB's Seattle office, practices in the areas of information technology, telecommunications and intellectual property. Mr. Wyde brings more than 28 years of legal and industry experience. He represents a broad range of private and public organizations on technology and intellectual property-related matters, including users, purchasers, licensors, licensees, manufacturers, resellers, and developers of computer software, equipment and systems, and other technology. He drafts, negotiates, and revises agreements for software development, enterprise licenses, implementation services, purchase, sale, outsourcing, website development, Internet and e-commerce services, telecommunications and media products and services, and other types of technology-related activities. He also has experience in federal and state regulation of satellite communications, telephones, cable television, and broadcasting. He earned his J.D. from the University of California, Los Angeles in 1977 and his B.A. in English Literature from Tulane University, magna cum laude, in 1974, where he was also Phi Beta Kappa. He is admitted to practice in Washington, California, and the District of Columbia (inactive).

Huyen-Lam Q. Nguyen-Bull, an Associate in GSB's Seattle office, practices in the area of litigation. She earned her J.D. from Yale Law School in 2003, where she was Editor-in-chief of Yale Journal of Law & Technology and Senior Editor of Yale Law Journal. She earned her A.B. in East Asian Studies from Harvard University, magna cum laude, in 1999. Ms. Nguyen-Bull served as a Law Clerk to the Honorable John C. Coughenour, U.S. District Judge, from 2003 to 2006. She is admitted to practice in Washington, Montana and before the U.S. District Court in the Districts of Montana and Washington.

Jared Van Kirk, an Associate in GSB's Seattle office, practices in the area of litigation. He earned his J.D. from Harvard Law School, cum laude, in 2005, where he was Managing Editor of Harvard International Law Journal He earned his B.A. in Human Biology from Stanford University, with distinction, in 2000, where he was also Phi Beta Kappa. From 2005 to 2006, he served as a law clerk to the Honorable Jerome Farris of the United States Court of Appeals for the Ninth Circuit. He is admitted to practice in Washington and before the U.S. Court of Appeals, Ninth Circuit.

Steven D. Nofziger, an Associate in GSB's Portland office, practices in the areas of business, taxation, and estate planning. He earned his J.D. from the University of Oregon School of Law in 2006, graduating Order of the Coif. While at the University of Oregon, Mr. Nofziger was a Managing Board Member of the Oregon Law Review and worked as an extern in the Oregon Tax Court. He earned his B.S. in Economics from Linfield College, summa cum laude, in 1996. He is admitted to practice in Oregon. ALLEN MATKINS LITIGATION TEAM'S KEY WIN FOR BOB MCKEE IN WILLIAMSON ACT CASE IN HUMBOLDT COUNTY
Allen Matkins Leck Gamble Mallory & Natsis trial lawyer Bob Moore and land use awyers Mike Durkee and David Blackwell recently obtained a key decision in County of Humboldt v. McKee et al. On November 2, 2006, after nearly four years of hard-fought litigation, Superior Court Judge W. Bruce Watson ruled that firm client Bob McKee did not violate the Williamson Act when he sold approximately 38 parcels of land following his purchase of the 13,000-acre Tooby Ranch in 2000.

The Allen Matkins trial team moved the Court for judgment before presenting its defense, successfully arguing that the County had failed to provide any evidence in its case against McKee even after five days of plaintiff's witnesses testimony.

Additionally, McKee's cross-complaint against the County prevailed, which asked the Court to compel the County Assessor's Office to recognize the record owners of the parcels (also defendants in the litigation), which the Assessor had refused to do since 2000 due to the alleged Williamson Act violations. McKee is also seeking to recover attorneys' fees and court costs from the County.

The lawsuit was originally filed by the County in December 2002, alleging that McKee violated the state’s Williamson Act and Subdivision Map Act after he purchased the Tooby Ranch and began selling some of the parcels in 2000 through 2002.

Allen Matkins partner Bob Moore, no stranger to controversial trials, headed up the litigation team of partners Mike Durkee and David Blackwell, along with local Eureka counsel William Bertain. Moore, chief litigator at Allen Matkins' San Francisco office, stated, "I am extremely pleased with Judge Watson's decision. He held that the County failed to prove its Williamson Act allegations against Bob McKee. It is time to move on."

McKee hired the Allen Matkins team after attending a Subdivision Map Act class taught by partner Mike Durkee, a recognized Subdivision Map Act and Williamson Act expert "I have taught Subdivision Map Act and Williamson Act courses all over the state and this is the first time I have ever seen a county go after one of its citizens," said Durkee. "Our client did not violate the Map Act nor the Williamson Act. This is a great win for Bob McKee."
"I am very happy for Bob McKee," said Blackwell. "He and his family have been through a lot during the four years of this litigation, and now he can get on with his life."
