Venture Capital 2.0
Samuel Angus, corporate partner with Fenwick & West, was recently quoted in an American Lawyer Media blog entry entitled, "Venture Capital 2.0."

During the recent Web 2.0 Summit, Angus explained that VC investment is not as crucial a funding component as it was during the first Internet boom, because it costs a lot less to launch a site today. Web 2.0 start-ups, often self-sustained through online advertising, can more easily get off the ground through bootstrapping by using angel investors, family and friends.

Bootstrapping offers two clear advantages: increased control and a higher percentage of profits when a start-up is sold. On the flip side, because the Web sites may grow slower without venture capitalist funds, the overall selling price may not be as high.

"It's a harder swing at the ball, hoping that it'll grow into a really big business," Angus said.

Fenwick & West Represents Good Technology in Acquisition by Motorola
Fenwick & West LLP represented its long-time client Good Technology, Inc. in its recently announced acquisition by Motorola, Inc. (NYSE: MOT). Good Technology is a leader in enterprise wireless handheld computing software and services. The acquisition will extend Motorola's mobile computing capabilities and increase the company’s enterprise client base. Financial terms of the transaction were not disclosed. The transaction is subject to regulatory approvals and other customary conditions and is expected to close in early 2007.

The Fenwick & West transaction team included corporate attorneys Gordy Davidson, Sayre Stevick, Craig Menden, Brian Hicks and Coleman Cannon; executive compensation and employee benefits attorneys Scott Spector and William Herochik; technology transactions attorneys Lisa Kenkel, Darren Hutchins and Christa Gaines; and litigation attorney David Hadden.

Forty-Eight Butzel Long attorneys named to Michigan Super Lawyers
Forty-eight Butzel Long attorneys have been chosen by their peers for inclusion in Michigan Super Lawyers edition. Michigan Super Lawyers 2006 is a new magazine designed to empower and inform consumers of legal services. More than 30,000 active Michigan lawyers were surveyed to nominate the best lawyers they've personally observed in action. Attorneys may not vote for themselves, and in-firm nominations may not exceed out-of-firm nominations. Candidates are divided into more than 55 practice areas and are evaluated by a blue ribbon panel of preeminent peers in their practice area.

Attorney Voted President-Elect of Asian American Bar Association
Associate Christopher C. Javillonar was voted president-elect of the Asian American Bar Association of Kansas City for 2007.

Javillonar is a member of the Commercial Litigation and Securities Enforcement, Compliance Client Service Groups. His practice focuses on complex litigation, and his experience encompasses all aspects of the litigation process, including case strategy, pre-trial briefing, depositions, hearings, trial preparation and trial. He represents regional and national clients in a broad range of business disputes, including breach of contract, fiduciary duty claims, product liability and complex class action defense.

Javillonar is licensed to practice in Missouri, Illinois, Kansas and The United States District Courts for the Eastern and Western Districts of Missouri and the District of Kansas. He received a J.D. from Washington University in 2003 and a B.S. from Rockhurst University in 1997.

He also serves on the Rockhurst University Alumni Board of Directors, is the co-chair of the Kansas City Metropolitan Bar Association Bar Leadership Academy and was appointed to serve on the KCMBA Membership Services Committee.

Bryan Cave Gets $28 Million Settlement For Higginsville, Mo.
The city of Higginsville, Mo., has reached a settlement with Kansas City Power and Light (KCP&L) for $28 million as a result of the utility's failure to honor a 20-year power supply contract.

The settlement, which was obtained for the city by Bryan Cave Partner Steven Mauer, requires KCP&L to pay an additional $220,000 for withholding six monthly payments and to compensate the city for its legal fees and other expenses.

“The settlement not only provides Higginsville with the compensation it is owed for the remaining 10 years of the contract, but it protects the city from falling into financial ruin,” Mauer said.

KCP&L had agreed to purchase the excess power capacity from the city’s 40-megawatt plant, built in 1994. As part of its contract with KCP&L, the city issued $16 million in bonds to finance construction of the electricity-generation facility.

When KCP&L reneged on the contract, which stated that the utility would help with the bond underwriting, it left the city with a large amount of debt it could not repay.

"The international law firm Bryan Cave LLP has added seven lawyers to its Kansas City office. Their areas of emphasis include banking and public finance, commercial litigation, labor and employment law, securities enforcement and transactional work. New attorneys are:

Jenny E. Deters is a member of the firm’s Banking, Business & Public Finance and Transactions Client Service Groups. She started her law career with a firm in Kansas and is also a certified public accountant. Deters received her J.D. from the University of Kansas in 2005 and a B.S. from the University of Minnesota in 1999.

Joshua C. Rowland is a member of the firm’s Securities Enforcement, Compliance & Litigation, Class & Derivative Actions and Commercial Litigation Client Service Groups. After a clerkship with U.S. District Court Judge Douglas P. Woodlock in Massachusetts, he began private practice with the Boston office of a national law firm. Rowland received his J.D., magna cum laude, from Boston College Law School in 2002, a Ph.D. from Yale University in 1999 and a B.A., with distinction, from Stanford University in 1990.

Amy D. Cline is a member of the firm’s Transactions Client Service Group. After a clerkship with the Missouri Western District Court of Appeals Judge Robert G. Ulrich, she moved to a telecommunications corporation as counsel in marketing and sales.
