In Memory of Eric W. Schwartz, partner
November 10, 2006 With great sadness, Troutman Sanders announces the death of our partner, Eric W. Schwartz, on October 29, 2006, at his home in Virginia Beach from heart complications. This is a very sad loss for our partnership and our firm. Eric was a native of Petersburg, Virginia, and a 1981 graduate of the University of Virginia, with distinction. He received his law degree from the University of Richmond in 1987. Following a clerkship with U. S. District Court Judge Claude M. Hilton in Alexandria, Virginia, Eric joined the Hampton Roads office of Mays & Valentine as a litigation associate and the third lawyer in that office. Eric became a partner at Mays in 1996 and joined Troutman Sanders as part of the merger with Mays & Valentine in 2001.

A member of the Products Liability and Employee Benefits practice groups, Eric will be remembered as a tenacious advocate who always put his clients' interests first and maintained their loyalty by obtaining consistently good results on their behalf.

Eric is survived by his sister of Arlington, Virginia, and his mother, who lives in Petersburg. A memorial service was held on Thursday, November 2, at Christ & Grace Episcopal Church in Petersburg, Virginia. In lieu of flowers, the family requests that any donations be sent in memory of Eric to the church at 1545 S. Sycamore Street, Petersburg, Virginia 23805.

Schwartz Cooper Announces Addition of Two New Associates
Schwartz Cooper Chartered, a leading Chicago-based full service law firm, announced today that Megan Danko and Ati Khatri have joined the firm as first-year associates.

Danko, who was a summer associate at the firm in 2005, received her J.D., magna cum laude, from Loyola University of Chicago School of Law in 2006. She received her B.A. from the University of Michigan in 2000.

Khatri received his J.D. from the University of Southern California in 2006 after completing a semester as a visiting student at Northwestern University School of Law. He received his B.A. from the University of Illinois Urbana-Champaign in 2003.

H&L honored by J.L. Turner for diversity work
Hughes & Luce LLP received a President’s Recognition award from the J.L. Turner Legal Association at the organization’s annual gala. The award honors the firm’s efforts on the pipeline issue and the firm’s support of JLTLA’s planned career and resource center.

“Diversity is an area that is bigger than just one firm so we are always pleased to have the opportunity to partner with similarly minded organizations to expand opportunities for people of varying backgrounds,” said Cindy Ohlenforst, chair of the H&L diversity committee.

Accepting the award on behalf of the firm were partner David Luther and senior trial attorney Paul Stafford, a former president of the JLTLA. Both are members of the firm’s diversity committee.

Hughes & Luce was the first major firm to pledge support to the funding campaign for the JLTLA Foundation Career and Legal Resource Center. The center will include space for events, education, mock trials and offices to further the foundation’s mission to offer legal workshops and educational programs as well as scholarship assistance.

Hughes & Luce and JLTLA are both working to address pipeline issues, which revolve around how to increase the overall pool of diverse law students and lawyers. Hughes & Luce has led in this area with innovative educational and mentoring programs with students from elementary school to law school.

Founded in 1952, J.L. Turner Legal Association is the African-American bar association in Dallas, Texas. JLTLA is an organization whose mission is to improve the quality of life in our community through education, service and scholarship. JLTLA members provide legal assistance to indigent residents in the North Texas area, provide scholarships to law students demonstrating financial or other needs, provide attorney mentors for law students, perform educational and other community outreach projects for North Texas area residents, and assist both its members and the community in seeking African-American attorneys who practice in the various areas of law.

Steve Ornstein Quoted Regarding Anti-Predatory Lending Bill Preemptions
Steve Ornstein was quoted in an article, "Lender Rift May Be Real Block to Federal PL Law," discussing preemptions to a federal anti-predatory lending bill. Excerpt: “It would seem to me that if you had one federal standard, the HOEPA standard, that could make life easier for everyone.”;

Steve said that the current myriad of state and local laws – many with provisions that differ sharply from the federal Home Ownership and Equity Protection Act – has complicated compliance. “It’s very hard to do the point and fee calculations for each and every state. I don’t know how the smaller shops are able to automate this and comply with the patchwork. It would seem to me that if you had one federal standard, the HOEPA standard, that could make life easier for everyone.”

Regarding whether states will be given the chance to opt out of any preemptive predatory lending law, Steve said there is precedence for such a move: states in the past have been given an opt-out of federal usury laws, For the mortgage industry, such a decision likely would pose problems. “You can’t have states opting out of a federal predatory lending law because no matter what we do, there’s always going to be some horror story – for reasons that can’t be helped by the lender; the borrower has been put in a product that wasn’t suitable or just changed circumstances. And bad facts make bad law. So, you can’t have this law and have states voting to override and have their own replicas of it.

TERRANCE ASHANTA-BARKER AND JAMES ZIMMERMAN OF TAFT, STETTINIUS & HOLLISTER SELECTED FOR C-CHANGE
Terrance Ashanta-Barker and James M. Zimmerman have been selected for C-Change, the leadership development program for young professionals developed by the Cincinnati USA Regional Chamber.

Ashanta-Barker is an associate in the Business and Finance Department. He received his undergraduate degree from Tuskegee University and law degree from the Florida State University College of Law, where he was a Virgil Hawkins Fellow and CLEO Fellow. Ashanta-Barker focuses his practice on corporate, transactional, and intellectual property matters. More specifically, he concentrates on general corporate matters, corporate governance, mergers and acquisitions, corporate finance (including venture capital matters), securities market regulation, intellectual property (with an emphasis on copyright matters) and entertainment law matters. Prior to joining Taft, Ashanta-Barker served as chief operations officer and general counsel for Small and Carter Investments Company (S&CI). Prior to S&CI, he worked with law firms in Florida and worked as a process engineer with Chevron U.S.A. Products Company, PepsiCo, Inc., and the Procter and Gamble Company. He is a board member of the Cincinnati Business Incubator, the Cincinnati Scholarship Foundation, and FreedomYP. Ashanta-Barker is also a graduate of the United States Presidential Classroom and the Grass Roots Leadership Academy, where he was awarded the Best-In-Class Award. He is a volunteer for the Special Olympics and various other community service initiatives. Ashanta-Barker is licensed to practice law in the states of Georgia, Florida, and Ohio.

Zimmerman also is an associate in the Business and Finance Department. He received his undergraduate degree, cum laude, with honors, from Vanderbilt University and law degree from Vanderbilt University Law School, where he served as Senior Notes Editor of the Vanderbilt Law Review and received Order of the Coif honors. Zimmerman focuses his practice on corporate and transactional matters. He has significant experience in the areas of corporate finance (including venture capital), mergers and acquisitions, corporate governance, and securities markets regulation. He has also represented numerous start-up and emerging businesses on a broad range of matters. Zimmerman is a member of the Advisory Board of Give Back Cincinnati, a nonprofit organization that organizes charitable events and other community activities for young professionals in Cincinnati. He is licensed to practice law in the state of Ohio and is a member of the Cincinnati Bar Association, and the Ohio State Bar Association. Zimmerman was selected by Cincinnati Magazine as a 2005 and 2006 Super Lawyers Rising Star.

IP litigation team wins jury verdict for hospital client
On Monday, November 5, a federal jury in Boston issued a verdict in favor of the Massachusetts Eye and Ear Infirmary (MEEI), a client of Ropes & Gray. The jury found that QLT, a Canadian biopharmaceutical company, was unjustly enriched by the contributions of MEEI researchers to the development of Visudyne®, a treatment for age-related macular degeneration. The jury also found that QLT had engaged in unfair trade practices under Massachusetts state law.

The jury awarded MEEI a 3.01% royalty on net sales worldwide, which now exceed $2.2 billion dollars. The jury also awarded MEEI its attorneys' fees.

MEEI, a non-profit teaching hospital of Harvard Medical School, is internationally renowned for its commitment to research and its success in treating diseases of the eye, ear, nose, throat, head and neck.

The successful Ropes & Gray team included Herb Schwartz, Ken Herman, Jim Haley, Chris Harnett, Bob Goldman, Ching-Lee Fukuda, Paddy Chinta, Bill Baker, Jim Canfield, Karen Mangasarian, Brian Biddinger, David Chun, Carla Sereny, Brynn Metzger-Hare, Andrew Bradt, Derek Kato, and Olivia Choe.

DLA Piper client Lyme Properties wins 2006 U.S. EPA Phoenix Award
Lyme Properties, a client of DLA Piper US LLP, has won the Environmental Protection Agency’s 2006 Phoenix Award for excellence in brownfield redevelopment, for its Kendall Square redevelopment project. DLA Piper advised Lyme Properties on its redevelopment strategy for Kendall Square.

The Phoenix Award was created by the EPA in 1997 to honor individuals and groups working to solve the critical environmental challenge of transforming blighted and contaminated areas into productive new uses. It is widely recognized as the premier acknowledgement of excellence in brownfield redevelopment.

The 2006 Phoenix Award winners represent outstanding brownfield projects from each of the 10 US Environmental Protection Agency (EPA) regions.

“I am proud we were able to assist Lyme Properties in this unique and valuable initiative,” said Greg Peterson, Real Estate partner in DLA Piper’s Boston office. “Our combined efforts have turned Kendall Square into a world-class center for life science research and innovation in Cambridge.”

Lyme Properties is the largest life sciences property developer in New England, and the third largest in the United States. Lyme Properties specializes in the acquisition, development, and leasing of first-quality life science and mixed-used properties located in prime educational, research, and medical centers.

In 1998, when Lyme Properties purchased the Kendall Square property, approximately 10 acres next to the Massachusetts Institute of Technology in Cambridge, it was the polluted site of a former manufactured gas plant. Lyme’s systematic cleanup of the site used an innovative method of solidifying tars and other pollutants in a giant concrete matrix (a method first used to construct the whitewater kayak venue at the 1996 Atlanta Olympics). This technique permanently "freezes" the pollutants, eliminating any risk to the Charles River or to future occupants of the site.

Already occupying the Kendall Square site are the new world headquarters of Genzyme Corporation (a building that itself won a LEEDS Gold award for green design and construction); another biotech lab and office building; and new apartments housing several hundred people. In the future Kendall Square will also house one additional biotech and lab building, a large performing arts center, a public skating rink and garden and a public boat ramp giving access to the Charles River Basin

Lyme Properties and their Kendall Square redevelopment will be honored at an awards ceremony along with the other Phoenix Award recipients during the Brownfields 2006 Conference in Boston in November. At the conference, all award winners will showcase their projects with case study presentations and exhibits.
