Fox Attorneys Present at the 2006 PA University and College Metting
Kevin B. Scott, Esq. and Steven Ludwig, Esq. of Fox Rothschild LLP recently presented at the Annual Pennsylvania College and University Attorney Meeting, hosted this year by St. Joseph’s University. The presentations were focused on matters of interest to the higher education community. Ludwig spoke on recent Supreme Court cases in the labor and employment area and Scott discussed the prohibition against political campaigning imposed on most non-profits by the IRS.

The meeting was hosted by Debra Fickler, Esquire, General Counsel of St. Joseph's University, and organized by Ms. Fickler and Robert C. Clothier, Esq., also from Fox Rothschild.

Scott’s practice involves representing participants in tax-exempt financings and the general representation of charitable organizations. He has significant experience in assisting higher education and other non-profit organizations in all phases of their operations, including corporate compliance, charitable giving and finance.

Ludwig represents private and public clients in the full range of labor and employment matters. He counsels clients regarding litigation and alternative dispute resolution options as well as regulatory compliance. Ludwig also handles matters involving the Americans with Disabilities Act, Age Discrimination in Employment Act, ERISA, COBRA, FMLA, civil rights laws, wage and hour laws and contract disputes.

Fox Rothschild Litigation Department Continues to Expand Talent Base
Fox Rothschild LLP welcomes Samuel W. Cortes, Esq. as an associate in the Litigation Department, resident in its Chester County office.

Cortes is a member of the firm’s Litigation Department. His practice focuses on complex commercial/contractual disputes. He has successfully represented clients in state and federal courts, as well as in arbitration proceedings.

In addition to general contract litigation, Cortes has experience representing both plaintiffs and defendants in trade secret and restrictive covenant litigation. He also handles construction litigation matters on behalf of professional service providers, public and private owners, architects, developers, contractors, subcontractors, manufacturers and lenders.

Fox Rothschild Attorney Elected to Education Association Post
Jeffrey T. Sultanik, Esquire, a partner in the Montgomery County office of Fox Rothschild LLP , was recently elected as Secretary of the Pennsylvania School Board Solicitors Association for 2007.

Sultanik serves as Chair of Fox Rothschild’s Education Law Group. His practice focuses on personnel and labor relations relating to school entities. Sultanik acquired national media attention as the result of negotiating one of the most sophisticated performance-based teachers’ contracts in the nation for a suburban Philadelphia school district.

Fox Rothschild Attorney Appointed to Co-Chair Tax Assessment Appeals Group
Wendy G. Rothstein, Esq. , a Partner in the Montgomery County office of Fox Rothschild LLP , was recently appointed as Co-Chair of the Tax Assessment Appeals Group.

Rothstein’s practice consists of general litigation with particular concentration on commercial litigation, real estate, zoning and land use, labor and employment, and tax assessment matters. She also serves as the Administrative Chair of the Montgomery County office’s Litigation Department.

Drinker Biddle & Reath and Gardner Carton & Douglas to Merge
In a move that creates significant new opportunities for service to clients, Drinker Biddle & Reath LLP and Gardner Carton & Douglas LLP announced today their plans to combine. The combined firm would have more than 650 lawyers in 12 offices nationwide, making it one of the 70 largest law firms in the United States. The combination would also expand the reach of the organization and strengthen a number of key practice areas while providing deeper resources to its clients.

“Standing still is not an option in today’s marketplace,” said Alfred W. Putnam, Jr., who will be chairman of the merged organization, to be known as Drinker Biddle & Reath LLP with operations headquartered in Philadelphia. In Illinois and Wisconsin, the merged organization would do business as Drinker Biddle Gardner Carton LLP during a transition period. Partners from each firm have voted to approve the merger, which would become official on Jan. 1, 2007.

“To best serve clients involved in complex transactions or litigation, you need to have a critical mass of top-notch lawyers spread across the country,” said Putnam. “The combination of these two storied firms – with more than 250 years of combined history – now provides clients with a major presence in the Philadelphia, Chicago, Washington, D.C., and New Jersey markets, each with more than 100 professionals.

“That depth of skill and strength of knowledge – combined with our other offices on the West Coast, in New York and in Delaware – gives us more tools to provide the highest quality legal services for our clients,” Putnam added. “This merger makes sense on every level,” said Gardner Carton chairman Harold L. Kaplan. “Our clients will now have a much greater depth of resources available to them. Our core practice areas will complement one another. And, from day one, this combination brings together two extremely talented and distinguished groups of lawyers committed to the profession, our communities and, most importantly, to our clients.”

Drinker Biddle would bring to the merger nationally recognized experience in a wide range of traditional legal services provided to its clients, including antitrust, bankruptcy, class actions, products liability, securities, corporate, intellectual property, insurance, environmental, investment management, real estate, and mergers and acquisitions. In addition to its highly regarded corporate and securities practice and its extensive litigation experience, Gardner Carton would bring to the new firm its nationally known practices in healthcare, bankruptcy, human resources, real estate, intellectual property, investment management and government relations.

Negotiations to merge the firms began in earnest earlier this year. From the beginning, the management teams recognized the firms’ shared values of the highest standards in client service, legal work and professional ethics.

“We see the cultures of each firm coming together quite nicely,” said Andrew C. Kassner, the executive partner of the merged firm. “We expect a seamless integration in our combined driver practices, and we are excited about growth in niche practices such as customs and international trade, education law, information technology and Native American tribal governments.”

One of the reasons the two firms were compatible was their dual presence in Chicago and Washington, D.C. Plans are under way to combine office space in each of those cities. In Chicago, Drinker Biddle’s lawyers would join more than 150 lawyers at Gardner Carton. In Washington, D.C., Gardner’s lawyers and government relations professionals would combine with Drinker Biddle’s offices at 15th and K streets to create an office of more than 100 professionals in the nation’s capital. The combined firm also would have offices in Philadelphia, San Francisco, Los Angeles, New York City, Milwaukee, Wilmington, Del., Florham Park, N.J., Princeton, N.J., Albany, N.Y., and Berwyn, Pa.
