$2.7 Million Awarded In Malpractice Suit
A young Windsor boy and his mother have secured what is believed to be the largest medical malpractice verdict ever in Connecticut for the type of injury he suffered during childbirth.

A Superior Court jury in Hartford Tuesday awarded $2.69 million to Tamar Earlington and her 4-year-old son, Omar Earlington Jr., after finding now-retired obstetrician Anthony Anastasi and F.A.L. Medical Associates liable for Omar's disabilities.

Superior Court Judge Lois Tanzer added $800,000 in interest to the award, because Anastasi two years ago rejected a $1 million settlement offer proposed by the Earlingtons' lawyer, Kathleen Nastri, of the Bridgeport law firm of Koskoff, Koskoff & Bieder. That brought the total award to $3.49 million.

The lawsuit claimed that Anastasi failed to diagnose that Tamar Earlington had a small pelvis, failed to properly evaluate the pre-birth size of the fetus and used a vacuum extractor and excessive pressure to extract the baby, rather than performing a Caesarean section when the baby became lodged.

As a result, Omar suffered serious nerve damage to his right shoulder that severely impairs his arm movement.

"He has some movement in his right arm, because there was some slight recovery of the nerves," Nastri said after the verdict. "He cannot put his hand over his head. And he has contractures at the elbow and shoulder joint. His arm never fully straightens." His condition is known as Erb's Palsy.

Omar did not testify during the trial, but did make a brief appearance when his neurologist did a brief examination of him in front of the jury to detail his physical deficiencies.

The jury deliberated nearly three full days, after a 2 1/2 week trial, before returning its verdict at about 3:15 p.m. Tuesday.

Nastri said the verdict is significant to the family "because it allows them to make sure this baby is taken care of, that he gets the treatment and education he needs to overcome the disability." She said the family also was upset that Anastasi at no time acknowledged doing anything wrong during the delivery.

HASKELL SLAUGHTER'S COHEN AND WINDLE CONTRIBUTE CHAPTER ON ALABAMA CORPORATE LAW TO NEW BOOK
Haskell Slaughter Young & Rediker, LLC attorneys Ross N. Cohen and Gwen L. Windle have co-authored the chapter on Alabama corporate law in the new book "Doing Business in States Other Than the State of Incorporation." This two-volume book is Portfolio No. 84 in the Corporate Practice Series published by The Bureau of National Affairs (BNA), a leading publisher of information and analysis products for professionals in law, tax, business and government.

Ross Cohen chairs Haskell Slaughter's Transactional Practice Group and represents clients in the areas of taxation and tax planning, representation before the Internal Revenue Service and the Alabama Department of Revenue, executive compensation, wealth-transfer planning, corporate law and mergers and acquisitions. Mr. Cohen's work has involved clients in a variety of industries, including real estate, banking, healthcare, personnel services and manufacturing, among others. In addition, he is frequently consulted on tax matters involved in public finance transactions, and has been involved in the establishment of nonprofit corporations and charitable organizations.

Gwen Windle's practice focuses on asset acquisitions, corporate finance, real estate law, banking law and commercial law. She has extensive experience in representing borrowers and lenders in financing transactions, purchasers and sellers in complex asset acquisitions, and principals, lenders and developers in leasing and commercial real estate transactions. Her practice has involved transactions throughout the United States.

Ms. Windle has served as an adjunct professor on the Uniform Commercial Code at the University of Alabama School of Law and as a member of the Alabama Board of Bar Examiners on the subject of the Uniform Commercial Code. She was recognized for expertise in real estate law in the Birmingham Business Journal's inaugural "Best of the Bar" poll in 2005 and for expertise in banking law in the 2006 poll.

BINGHAM MCCUTCHEN OPENS HONG KONG OFFICE
Bingham McCutchen LLP announces the opening of its Hong Kong office, effective January 1, 2007.

The decision to launch a Hong Kong office is driven by client needs, said Bingham Chairman Jay S. Zimmerman, adding that the growth strategy will mirror the successful approach applied to Bingham’s London office, known globally for its financial restructuring and financial regulatory practices.

“Our strategy has always been to build upon our strengths,” said Zimmerman. “Following the lead of our highly successful London office, the Hong Kong office will advise existing financial institution clients on investments in Asia.”

The Hong Kong office is Bingham’s second in Asia, in addition to Tokyo. Bingham’s leading Japanese Practice, with its attorneys in U.S. and Tokyo offices, advises and represents major US and European companies in Japan and Asia, as well as nearly 500 Japanese-affiliated companies.

London Managing Partner James Roome noted that the Hong Kong office would initially concentrate on counseling hedge fund and investment banking clients in their distressed and special situations investments, a major strength of Bingham’s London office.

“The globalization of distressed investing by hedge funds and investment banks is leading us to Hong Kong,” said Roome, who practiced in Hong Kong from 1984 to 1988. “This is an exceptional opportunity to establish our practice in Hong Kong, which has emerged as a principal financial centre in Asia.”

Roome, co-head of Bingham’s Financial Restructuring Group, added that Bingham’s growth in Hong Kong will follow the London office strategy. Launched in September 2000, Bingham’s English law practice now has more than 40 leading finance, litigation and corporate lawyers involved in advising on complex, high-profile deals and disputes for financial institution clients. Bingham’s London office capabilities have been carefully shaped to meet the complex needs of a demanding client segment: international financial institutions and capital markets participants.

Roome will oversee the Hong Kong operation. London finance partner Kate Walters will move to Hong Kong to head up the three-lawyer office. Joining Walters will be London corporate associate Angeli Arora and associate Charlie Rogers, who joins Bingham from Jones Day’s Hong Kong office. Rogers is a former Bingham associate in London.
