RIDER BENNETT NAMES FIVE NEW PARTNERS

Rothschild and Harvey of Pepper Hamilton Speak as Part of Panel Discussion on Science, Faith & Darwin
Eric Rothschild and Stephen G. Harvey, partners with Pepper Hamilton LLP and two of the lead attorneys for the plaintiffs in the landmark “intelligent design” case of Kitzmiller v. Dover Area School District, recently spoke as part of a panel discussion on “Science, Faith & Darwin.” The discussion was held at the Franklin Institute in Philadelphia on December 12, 2006.

Mr. Rothschild and Mr. Harvey were joined by panelists Dr. Michael Shermer, executive director, Skeptics Society; Dr. Michael Weisberg, assistant professor of philosophy, University of Pennsylvania; and the Honorable John E. Jones, III, who presided over the Kitzmiller trial in fall 2005. Dr. Arthur Caplan, chair, Department of Medical Ethics and director of the Center for Bioethics, University of Pennsylvania, served as moderator.

The panel examined the faith vs. science debate, in particular, the recent controversies regarding instruction on Darwinian evolution in schools. The talk was held in connection with the Franklin Institute’s DARWIN Exhibit, which explores the life and discoveries of Charles Darwin, whose insights led to the theory of evolution. The exhibit runs through December 31, 2006.

Mr. Rothschild is a member of Pepper’s Health Effects Litigation and Commercial Litigation practice groups. He concentrates his practice in complex litigation, including product liability law, constitutional and civil rights issues, and fraud and other commercial disputes.

Mr. Harvey, also a member of Pepper’s Commercial Litigation Practice Group, concentrates his practice in complex litigation matters, including commercial disputes and consumer class actions.

Pepper, along with lawyers from the ACLU of Pennsylvania and Americans United for Separation of Church and State, successfully represented in federal court eight families who challenged the Dover policy that included “intelligent design” in the curriculum. The case was decided in Pennsylvania in December 2005.

Parker Poe Attorneys Elected to North Carolina Bar Leadership
Two partners of Parker Poe Adams & Bernstein LLP have been elected to leadership positions in the North Carolina State Bar.

Irvin “Hank” W. Hankins III was sworn in as President-Elect of the North Carolina State Bar. Following normal progression, he will serve as President in 2008. Mr. Hankins is a litigation partner in the Charlotte office. He received a JD, with honors, in 1975 and an AB in 1968 from the University of North Carolina at Chapel Hill.

David Neal Allen, a litigation partner in the Charlotte office, was elected as a State Bar Councilor from Mecklenburg County for a three-year term effective January 2007. Mr. Allen received a JD in 1980 and an AB in 1977 from the University of North Carolina at Chapel Hill.

Nicholas F. Pellitta Named Second Vice-Chairman of Board of Directors of Hunterdon County Chamber of Commerce
Nicholas F. Pellitta, a member of the Somerville law firm of Norris McLaughlin & Marcus, P.A., has been named Second Vice-Chairman of the Board of Directors of the Hunterdon County Chamber of Commerce (HCCC). The HCCC’s new Board members will be announced at the Annual Dinner Meeting of the HCCC to be held on January 26, 2007 at the Stanton Ridge County Club.

HCCC is a partnership of businesses, approximately 500 strong, dedicated to promoting a favorable business climate, supporting member companies and providing business leadership throughout the county of Hunterdon.

A resident of Flemington, Pellitta has substantial experience in a variety of legal areas in both federal and state courts. He provides a wide variety of litigation strategy and assistance in commercial matters, including contract disputes, fraud claims and insurance-related issues. Pellitta has also represented colleges and universities for more than 17 years in areas such as tort claim defense, police litigation, civil rights and student discipline.

On the individual level, Pellitta offers assistance to clients in matters involving personal injury, criminal charges, juvenile delinquency, DWI and other similar offenses, both in municipal and superior courts.

Pellitta obtained his J.D. from New York Law School in 1985 and received his B.A. from Rutgers College in 1982.

Nelson Mullins Attorneys Listed in 'Legal Elite'
Three partners in Nelson Mullins Riley & Scarborough LLP's Atlanta office have been selected by their peers as among Georgia's 2006 Legal Elite, a listing published in the December 2006 edition of Georgia Trend magazine.

The three Nelson Mullins attorneys are:

Attorney Kenneth MillwoodKenneth L. Millwood, selected for business litigation. Mr. Millwood is a senior litigation partner and managing partner of the Nelson Mullins Atlanta office and is the Firm's General Counsel. He is a member of the Firm's Executive Committee and practices in the areas of business, securities and financial litigation, and antitrust and trade regulation. He has extensive experience in litigation against corporate officers and directors surrounding financial and accounting issues.

Attorney Richard HerzogRichard B. Herzog, selected for bankruptcy and creditors' rights. Mr. Herzog leads the Firm's debt finance and restructuring practice and also chairs the Firm's Property, Government, and Finance Group. Mr. Herzog is currently president of the Atlanta Bar Association where he has served as an officer or director since 1998. He has been a trustee of the Georgia Legal History Foundation since 1988 and is a Fellow of the Atlanta Bar Foundation, the Georgia Lawyers Foundation, and the American Bar Foundation.

Attorney Wade Malone

o Mr. Malone practices in the areas of business litigation and products liability defense. Mr. Malone’s complex litigation practice has included representation of both plaintiffs and defendants in a broad range of complex litigation in both state and federal courts, including business, personal injury/product liability, antitrust, restrictive covenant and construction litigation. He serves in the House of Delegates of the American Bar Association as a representative of the Atlanta Bar Association. Mr. Malone is a Past President of the Atlanta Bar Association and Atlanta Legal Aid Society. Since its inception in 1993, he has been co-chair of the Atlanta Bar Association's Summer Law Internship Program that provides paid internships for Atlanta high school students.

Georgia's Legal Elite is compiled by Georgia Trend magazine, which mails ballots to several thousand lawyers who are members of the state bar and whose practice areas correspond to the 11 the magazine highlights. Ballots must be signed, and attorneys cannot vote for themselves.

Milbank Wins Second Patent Damages Trial For Matter Inc.’s Fisher-Price
The international law firm Milbank, Tweed, Hadley & McCLoy LLP announced today that it won a second trial for Fisher-Price Inc. in which a jury awarded an additional $1.3 million in damages against Safety 1st Inc. for sales of portable infant bassinets and bouncers that the company sold after 2003. Fisher-Price Inc. v. Safety 1st Inc., 01CV51, U.S. District Court, Delaware (Wilmington).

In the first patent infringement trial, a jury awarded Mattel Inc.’s Fisher-Price division $1.9 million in damages for infringing sales made by Safety 1st between 2000 and 2003. A federal district court judge later reduced the award to $1 million.

An appeal to the United States Court of Appeals for the Federal Circuit (CAFC) paved the way for a second jury trial during which Fisher-Price claimed Safety 1st, a division of Dorel Industries Inc., was also liable for infringing sales that occurred after the 2003 damage award. The jury determined that Safety 1st’s post-2003 sales constituted willful infringement, opening the door for the trial judge to triple damages for post-2003 sales.

Washington-based Milbank partner William E. Wallace III stated, “There was a pervasive scheme of infringement. The outcome sends a clear warning to Mattel’s competitors that the company will vigorously protect its patents.”

Fisher-Price Inc., a subsidiary of El Segundo-based Mattel, Inc., the world’s largest toy manufacturer, filed its original patent suit against Safety 1st Inc. in 2001. In 2003, a jury determined that Safety 1st’s sales of similar products, which began in 2000, willfully infringed Mattel’s patents and awarded Fisher-Price $1.9 million in damages. The award was subsequently reduced to $1 million.

That verdict was largely affirmed on appeal by the CAFC in 2004. However, the CAFC remanded the case for a determination of damages for the post-2003 period. After the remand, the district judge granted a new trial on post-2003 willfulness. In this second jury trial, Milbank lawyers proved willful infringement again, setting the stage once more for an award of treble damages and attorneys fees. The total damage award could be increased to as much as $10 million.

The Milbank trial team was led by Washington, DC-based partner William E. Wallace III, and included Of Counsel Jay Alexander, and associates Donna Mulvihill and Katie Scovin, and legal assistant Naseema Shafi. Milbank is also representing Fisher-Price, Inc. in two other suits, a patent infringement case relating to infant high chairs and infant swings and a second regarding the misappropriation of concept relating to toy action figures.

Safety 1st is a unit of Westmount, Quebec-based Dorel Industries, Inc., which designs, manufactures and markets consumer products.

Mayer, Brown, Rowe & Maw appoints leading Global Trade partner in Brussels - Firm Adds Significant Russian Capabilities to Trade Practice -
International law firm Mayer, Brown, Rowe & Maw LLP is pleased to announce the appointment of WTO and EU trade law partner Edward Borovikov from Hammonds in Brussels. Six others will also be joining the firm.

Edward advises many Russian and Eastern European companies and authorities before the European Commission in relation to trade and economic relations and integration issues. He also assists Russian authorities in relation to Russia's proposed WTO accession. Borovikov's appointment adds to the firm's growing Russian capabilities. Washington D.C. partner Catherine Novelli previously served as the Assistant U.S. Trade Representative where she led United States trade policy efforts towards Russia.

Following a period as an Economist at Moscow State University, Edward became a senior expert on trade policy relating to Russia's WTO accession and EC-Russia relations for the Committee For External Economic Relations and the Ministry of Foreign Affairs in Russia. In 1996 he became First Secretary of the Russian Mission to the European Communities (Trade Policy and Economics Section) where he worked until becoming a partner at Hammonds in 1999.

Edward's appointment continues to cement Mayer, Brown, Rowe & Maw's global trade capabilities in the US, Europe and China (through its consulting office in Beijing). The practice already includes high-level former government officials, including former U.S. Secretary of Commerce and U.S. Trade Representative Mickey Kantor, partners James Jochum, Marguerite Trossevin and Cathy Novelli, who arrived in recent years, as well as the latest arrival of the respected trade team from Miller & Chevalier including Duane Layton, Sydney Mintzer and Jeffery Lowe. In Europe former EU Ambassador to the US Günter Burghardt and partner Paulette Vander Schueren and her team provide a strong platform in Brussels along with Jean-Philippe Montfort, a leading European regulatory partner.

Edward Borovikov commented: "I am delighted to be joining a team which is making a big impact in the international trade market owing to both the level of its expertise and ongoing expansion. My practice will further complement the established team and help to develop this global practice area for the firm."
