Robb Joins National Leaders on Environmental Law Institute Board
Paul Hagen, Chair of the Board of the Environmental Law Institute (ELI), has announced the election of five new members to the Institute's Board of Directors. Hagen, who heads the international environmental law practice at the firm of Beveridge & Diamond, described the five as "distinguished environmental leaders in the Congress, private law practice, a major corporation, and a philanthropic investment firm." Hagen observed that "ELI continues to draw national leaders to its Board who bring diverse perspectives on environmental law, policy and management and who are well positioned to guide the Institute's work and future success."

Joining ELI's Board are:

The Honorable Jim Saxton, Republican of New Jersey, has served in leadership positions in the House of Representatives, including senior positions on the Fisheries and Oceans Subcommittee of the House Resources Committee. He has also chaired a subcommittee of the House Armed Services Committee dealing with anti-terrorism activities. His district includes nearly half of the Pinelands National Reserve, and his interests include working for clean air and water, coastal protection, wildlife protection and open space.

The Honorable Mark Udall, Democrat representing Colorado's Second Congressional District, has served on the House Armed Services, Science, and Resources Committees and is co-chair of the House Renewable Energy and Energy Efficiency Caucus. He comes from a line of conservation leaders, including his father, Congressman Morris Udall and his Uncle, Stewart Udall, Secretary of the Interior in the Kennedy Administration. His environmental priorities in the U.S. Congress include: forests and public lands, including preservation of roadless areas; clean, renewable energy; development of the West's energy resources in ways that protect vital water resources; and cleanup of the Rocky Flats former nuclear weapons production facility and its transformation to a wildlife refuge.

Sara Kendall is Vice President, Environment, Health, and Safety at the Weyerhaeuser Company, a forest products company headquartered in Tacoma, Washington. From 1985-88, she served as Legislative Counsel to Washington Senators Daniel Evans and Slade Gordon. She holds degrees in both law and forestry science and chairs the Environment Resource Committee of the American Forest and Paper Association.

Kathy Robb is a partner at the law firm of Hunton & Williams and is co-head of the firm's Resources, Regulatory, and Environmental Law Team. Her practice involves all phases of administrative litigation, particularly matters involving the Clean Water Act and the Superfund site cleanup program. She has been active in the American Bar Association and is co-founder and President (2006) of the Women's Network for a Sustainable Future.

Brian Trelstad is Chief Investment officer of the Acumen Fund in New York, New York, a philanthropic venture capital fund dedicated to investing in companies that help the poor such as a group producing an inexpensive drip irrigation system for farmers. With business and city planning degrees, Trelstad has worked in the public and private sectors including a stint at McKinsey & Company before joining Acumen.

"We are delighted to have such a talented and accomplished group of people from all sectors joining ELI's Board" said ELI's President, Leslie Carothers. "I know they will each bring new insight and ideas to ELI's work to advance environmental protection by improving law, policy, and management.

Connolly Bove Wins Key Proceeding In New York Federal Court for Pfizer Inc's Exubera®
The sales and distribution of Exubera®, a groundbreaking system for administering insulin by inhalation to patients suffering from Diabetes, will continue according to Pfizer Inc’s original plan. Today, the United States District Court for the Southern District of New York rejected a hotly-contested request by Novo Nordisk A/S to preliminarily enjoin Pfizer’s launch of Exubera®. Connolly Bove Lodge & Hutz’s successful defense included an argument that Exubera® operates by traditional breathing, something that cannot be patented. This special drug delivery system, the first of its kind ever approved by the FDA, provides an alternative method of administering insulin, an important feature to over twenty million people that have the disease.

Connolly Bove attorneys, Rudolf E. Hutz and R. Eric Hutz, both partners in the Firm’s Intellectual Property Group, represented Pfizer in this matter. This is the second critical patent success that Connolly Bove has provided to Pfizer in the past year. Earlier this year, the Firm sustained Pfizer’s rights to the basic patent covering Lipitor®, the largest selling drug in the world. The Exubera® case will now return to the Court for further proceedings.

CULLEN WINS LANDMARK ABDUCTION CASE
Miles and Stockbridge P.C. announced yesterday that Stephen J. Cullen won a case with national implications. An Anne Arundel County Circuit Court jury ruled in favor of his client, Michael Shannon, whose two sons were kidnapped in 2001 and taken to Egypt by his ex-wife and mother-in-law.

The jury awarded Mr. Shannon $3 million in punitive and compensatory damages in the three-day trial that concluded Dec. 14. Mr. Shannon's former wife and mother-in-law are from Egypt.

“What the jury was doing is sending a clear message to people who abduct children,” said Mr. Cullen. “It is not going to be tolerated. This has been a long time coming.

Schwartz Cooper attorney Richard Himelhoch was quoted by TheStreet.com in an article reporting on the NTP-Palm patent infringement dispute. According to the article, the U.S. Patent and Trademark office issued a ruling rejecting the re-examiniation of one of NTP's patents that Palm had allegedly infringed upon. The article notes that the decision could provide Palm with the additional leverage it needs in a separate court case filed by NTP against Palm in November 2006.

According to Himelhoch, “Palm may seek, if it has not already done so, to stay the litigation pending the final outcome of any appeals. Palm may also attempt to settle the matter on terms more favorable than previously proposed by NTP.

LeBoeuf Lamb Promotes Five Associates to Partner
LeBoeuf, Lamb, Greene & MacRae LLP Chairman, Steven H. Davis announced today that the firm has named five new partners effective January 1, 2007. The firm has also promoted two attorneys to counsel.

The new partners are:

Paul P. Chen - Mr. Chen is a corporate transactions attorney with extensive experience representing issuers and financial institutions on financing and merger and acquisition transactions, primarily in the life insurance and financial services industries. He received his JD from New York University and is resident in the firm's New York office.

Damian Cleary - Mr. Cleary advises on insurance and reinsurance matters, conducting litigation in the High Court of England and Wales and in international arbitration. He received his degree from Oxford University and is resident in the firm's London office.

Peter Crowther - Dr. Crowther is an experienced EU/competition lawyer who advises on competition, regulatory, and corporate matters across a range of industries. He received his Masters from Oxford University and his Ph. D from Copenhagen Business School and is resident in the firm's London office.

Frederick J. Lark - Mr. Lark advises clients in the energy and insurance industries on a variety of transactions, including mergers and acquisitions, and public and private securities offerings, as well as disclosure filings. He received his JD from Rutgers University and is resident in the firm's New York office.

Francis R. Monaco - Mr. Monaco focuses on corporate and regulatory matters for U.S. and overseas insurers and reinsurers. He has also been extensively involved in the insurance, regulatory, and corporate aspects of the demutualizations of several large U.S. mutual insurers. He received his JD from Fordham University and is resident in the firm's New York office.
