Real Estate Investment Partner Joins Orrick in Paris
Orrick, Herrington & Sutcliffe LLP announced today that Hervé Kensicher, a leading global finance and real estate attorney, has joined Orrick as a partner in the firm’s Global Real Estate practice in Paris. Kensicher joins Orrick from Freshfields, where he was a partner.

“Real estate investment activity in Europe continues to be robust, and Orrick has been continually increasing the size and quality of its real estate groups in Paris and London, ” said William Murray, chair of Orrick’s real estate practice. “Hervé’s addition to the group will bring considerable depth of experience to the practice, and puts the firm in a better position than ever to handle major transactions for clients.”

Kensicher specializes in French domestic and cross-border commercial real estate finance and securitization. He has a wide range of experience in finance and banking, including project finance, public utilities finance and debt restructuring. Stéphane Salou said: “Hervé brings a great deal of real estate finance experience to the Paris office and the firm generally. His broad background and sophisticated view of the real estate markets in Europe are highly respected.”

Kensicher is actively involved in real estate finance work on the borrower side for various property owners and investors and on the lender side for major financial institutions, as well as pan-European CMBS transactions and the formation and representation of REITs and private equity funds. He also represents on financing matters several investment firms that are market leaders in real estate investments, including DB/RREEF, to which Orrick served as counsel in a property acquisition believed to be Silicon Valley's largest commercial real estate transaction ever, and Hines.

Kensicher, who has been a partner since 1991, has extensive international experience, with over six years spent in Freshfields’s London, New York and Moscow offices, the latter of which he founded and managed from 1992 to 1994. Kensicher received his baccalaureate from the French Military Academy in Aix-en-Provence in 1978, a Certificate in Public Management from the University of Indiana School of Public and Environmental Affairs in 1982, and a masters degree in private international law from the Law School of Paris XI University at Sceaux in 1983.

Ken Berman files class action against state Registry on behalf of legal immigrants Boston Globe
Ken Berman, partner in the firm's Litigation Department, is the lead attorney in a class action suit filed yesterday against the Massachusetts Registry of Motor Vehicles on behalf of legal immigrants who were denied driver's licenses. Ken is working with the American Civil Liberties Union of Massachusetts and the Massachusetts Law Reform Institute on the suit.

In a front page article on the suit in the December 15 Boston Globe, Ken notes that the Registry has unlawfully asked legal immigrants to produce justification for their presence in the United States. The suit charges that the plaintiffs are legally entitled to driver's license but cannot get them because of unlawful ways that the Registry handles applications from legal immigrants. Ken also notes that the denial of a driver's license places undue hardship on the plaintiffs, given how dependent people are on the right to drive an automobile.

The SHRM Wall of Fame award is the culmination of a number of honors this year for Nixon Peabody for its work in employee relations and diversity:

Nixon Peabody Expands Its Intellectual Property and Life Sciences Practices; Firm Attracts Highly Regarded IP and Life Sciences Attorney to San Francisco Office
Ms. Millauer is an established biotechnology and life sciences patent attorney. She joins one of the most highly ranked intellectual property practices in the country. In 2005, Nixon Peabody was ranked among the top 25 IP litigation firms. The addition of Ms. Millauer further solidifies Nixon Peabody’s position as a national leader and innovator in the areas of intellectual property and life sciences law, and strengthens the firm’s reach on the West Coast. The arrival of Ms. Millauer follows Nixon Peabody’s announcements over the past year of the addition of four new attorneys to its overall intellectual property practice in Washington, DC, as well as of the arrival of J. Jeffrey Hawley, former vice president and director of patent legal staff at Eastman Kodak Company, to its intellectual property practice. Mayer, Brown, Rowe & Maw files amicus brief in al-Marri v. Wright on behalf of former senior Justice Department officials, including former U.S. Attorney General Janet Reno
Mayer, Brown, Rowe & Maw LLP attorneys James Schroeder, Gary Isaac, and Heather Lewis filed an amicus brief in the Fourth Circuit in Al-Marri v. Wright on behalf of eight former Justice Department officials, including former U.S. Attorney General Janet Reno and Mayer, Brown senior counsel and former U.S. Deputy Solicitor General Philip Lacovara, advocating against the government's indefinite detention of terrorism suspects arrested and held in the United States. Amici also include former U.S. Attorneys W. Thomas Dillard and Anton R. Valukas, both of whom served under President Reagan.

Ali Saleh Kahlah al-Marri, a Qatara national, was a legal alien when he was arrested at his home in Peoria, Illinois in December 2001 and indicted on federal criminal charges. Shortly before his criminal trial was scheduled to begin in 2003, and right after his lawyers filed a motion to suppress evidence allegedly obtained in violation of the Fourth Amendment, the government designated al-Marri as an "enemy combatant," dismissing all the criminal charges against him with prejudice. Since then, al-Marri has been held in a military prison in South Carolina without charge and without any indication of when his detention will end.

In their brief, amici expressed grave concern about the government's decision to hold al-Marri indefinitely as an "enemy combatant" rather than prosecuting him criminally. Providing a list of successful criminal prosecutions of suspected terrorists, amici argued that "the existing criminal justice system is more than up to the task of prosecuting and bringing to justice those who plan or attempt acts within in the United States-without sacrificing any of the rights and protections that have been the hallmarks of the American legal system for more than 200 years." Amici also contended that, contrary to the government's claims, the Military Commissions Act of 2006 does not strip al-Marri of his right to challenge his indefinite detention in court.

Three Minnesota Attorneys Named as "Rising Stars"
Three Hinshaw & Culbertson LLP attorneys, Douglas A. Johns, Jennifer S. Kenney and Holly J. Tchida have been honored as 2007 Minnesota "Rising Stars," by Minnesota Law & Politics. All three focus their practices primarily in the area of commercial insurance coverage matters, and are associates in Hinshaw's Minneapolis, Minnesota office.

Mr. Johns focuses his practice primarily in the area of commercial insurance coverage matters. He provides coverage opinions for insurer clients and litigates coverage disputes, and has represented clients in multimillion-dollar coverage cases involving professional liability, construction defect, environmental, directors and officers, and legal malpractice issues.

Ms. Kenney devotes her practice exclusively to representing insurance companies in coverage matters. She is experienced in analyzing and interpreting insurance policy language, and has participated in all aspects of discovery and trial preparation.

Ms. Tchida focuses her practice on insurance law matters, with a particular emphasis on insurance coverage litigation. She is experienced in personal injury defense, insurance law, corporate defense and employment litigation, and has sourced and worked with experts in the areas of premises liability and construction defects. This is her third time as a "Rising Star." She has received this honor in 2005, 2006 and again in 2007.

The "Rising Star" designation denotes the top 2.5 percent of all attorneys in Minnesota. Recipients of this honor have practiced law for less than 10 years or are 40 years old or younger.
