CHESTER WILLCOX & SAXBE ATTORNEY RECEIVES OSU MORITZ COLLEGE OF LAW DISTINGUISHED ALUMNUS AWARD
The law firm of Chester Willcox & Saxbe, LLP (CWS) today announced that Frank A. Ray has been chosen to receive the Distinguished Alumnus Award for 2006-07 from The Ohio State University Moritz College of Law. The award presentation will be at the College's Barrister Club tailgate party on September 23rd.

Given annually to a Moritz Law graduate for exceptional achievement or outstanding service to the college or community, the Distinguished Alumnus award is presented by the Moritz College of Law Alumni Society. For the last four years, Ray has served as an Adjunct Professor of Law at the Moritz College, where he teaches the Trial Practice course.

Ray is a partner at CWS, practicing in the areas of civil trial and appellate litigation. Prior to joining the firm, Ray maintained a successful litigation practice with a reputation for taking on large complex cases on a contingent or non-traditional fee basis. His civil trial and appellate practice has concentrated on commercial claims under the UCC; insurance coverages; business disputes; catastrophic personal injury and wrongful death arising from vehicular collisions, workplace injury, and products liability; and representation of professional baseball franchises and leagues.

HILL WALLACK LLP TO MERGE WITH SANDSON & DELUCRY LLC AND ESTABLISH GAMING LAW PRACTICE GROUP IN ATLANTIC CITY
Hill Wallack LLP has announced that it will merge with Sandson & DeLucry LLC, one of Atlantic City’s leading law firms. Sandson & DeLucry senior partner Mark Sandson has been nominated and confirmed as a Judge of the Superior Court of New Jersey and will be sworn in January 2, 2007. Hill Wallack LLP will merge with the Sandson & DeLucry practice effective January 1, 2007.

Hill Wallack LLP is a 60-attorney, Princeton-based law firm with significant casino, regulatory, real estate and litigation experience. Hill Wallack LLP also announced the formation of a Gaming Law Practice Group to advise casinos, other gaming-related companies and those that do business with them.

Sandson & DeLucry attorneys Richard DeLucry and Timothy Lowry will remain with the continuing firm at the same location. Rounding out the Atlantic City office, former Atlantic City Deputy Solicitor Joseph Dougherty will be joining the Hill Wallack LLP firm effective December 18, 2006. All will become Hill Wallack LLP partners. The firm expects to announce additional new attorney affiliations that will expand the breadth and depth of services provided to clients.

Announcing the move, Hill Wallack LLP Managing Partner Robert W. Bacso said, “This is a continuation of our strategy to expand our reach across the region and place lawyers and offices closer to the clients we serve. In addition to opening new offices in Doylestown and Langhorne, Pennsylvania earlier this year, we are now making a significant long term commitment in Atlantic City to serve and grow our South Jersey clientele.”

“As a firm based in Princeton, we already represent many clients south of Interstate 195. We have also served as counsel to the Casino Reinvestment Development Authority for the past several years. We know this region well and know its potential.”

“As our regulatory practice has grown over recent years, we are now adding to our already significant government procurement practice industry-specific practice groups focused on the gaming, banking and insurance sectors,” Bacso said.

Paul P. Josephson, Hill Wallack LLP’s partner-in-charge of the Regulatory & Government Affairs Practice Group will head the Gaming Law Practice Group and the Atlantic City office. Mr. Josephson is a former Chief Counsel to the Governor with over 15 years experience in casino, gaming and other regulatory law matters. He spearheaded casino regulatory streamlining legislation in 2002, and also served as Director of the Division of Law within the Attorney General’s office.

“We’re bullish on Atlantic City and South Jersey,” said Josephson. “There is no doubt the casino industry is one of New Jersey’s critical economic engines. We’ve watched this industry establish itself and mature into a steady contributor to the State’s economy over the past two decades.

“The region’s continued growth depends on sound regulatory and tax policy that encourages more private investment, while retaining the high standard for integrity that attracts capital and allowed the industry to flourish here. We intend to use our skills in brokering innovative regulatory solutions in Trenton to advocate for the industry and its leaders.” The firm and its attorneys led successful efforts to fix the State’s EZPass and motor vehicle inspection systems, and to merge the New Jersey Turnpike and Garden State Parkway.

Hill Wallack LLP’s Gaming Law Practice Group consists of a team of attorneys with a history of successfully representing major casinos and companies involved in the lottery, horse racing, Indian gaming, and Internet wagering sectors, as well as their executives, investors, institutional financial sources, banks, and vendors.

“The highly regulated and multi-jurisdictional nature of the gaming industry requires counsel well-versed in the operation of gaming venues as well as direct experience in New Jersey’s regulatory environment. Likewise, companies that do business with casinos and others in the gaming industry require special counsel who understand the unique regulatory and business environment surrounding their business partners. Our team has that experience.” Josephson said.

Hill Wallack LLP attorneys have handled the gamut of matters that confront gaming interests including licensing and enforcement issues, internal and special investigations, real estate development, land use and environmental projects, corporate financing, litigation and tax matters, as well as commercial, employment, collections and personal injury and workers compensation litigation.

This move is also about more than casinos, according to Josephson. “The South Jersey region is poised for a new wave of growth emanating from several new casino proposals and other exciting prospects. Judge Sandson’s nomination created the perfect opportunity for us to acquire this platform and fully engage in this critical market,” Josephson said.

MOTLEY RICE FILES SUIT AGAINST MANUFACTURER OF FAILED HERNIA REPAIR PATCH
Motley Rice LLC, one of the nation's largest plaintiffs' litigation firms, together with co-counsel Wexler Toriseva Wallace LLP, today announced that it has filed suit against Davol, Inc., a Rhode Island-based manufacturer of the Composix Kugel Mesh Patch, a medical device used in hernia repair surgeries. The suit was filed in Superior Court in the State of Rhode Island on behalf of plaintiff Jimmy Warren of St. Charles County, Missouri, whose inserted Kugel Mesh Patch failed following a product recall, causing severe abdominal pain and resulting in necessary bowel dissection surgery to remove the failed patch. Additional defendants in the case include New Jersey-based C.R. Bard, Inc., the parent company of Davol, Inc.

On January 6, 2004, Mr. Warren underwent hernia repair surgery, during which he received a Kugel Mesh Patch developed by Davol, Inc. The following year, Davol recalled many of the Kugel Mesh Patches under an FDA Class I recall - a recall issued for medical devices that are potentially life-threatening or could cause a serious risk to a patient's health. In 2006, this recall was expanded to include the patch inserted in Mr. Warren. Following his surgery, Mr. Warren developed abdominal tenderness, and according to the complaint, another hernia had developed in Mr. Warren in April 2006.

During surgery to repair the second hernia, a piece of the failed Kugel Mesh patch was discovered adhered to Mr. Warren's bowel. Mr. Warren was subjected to a prolonged bowel dissection to release the mesh from his bowel, leaving him with chronically inflamed bowels, as well as ongoing physical pain and mental anguish. It is alleged that the manufacturers of the Kugel Mesh Patch were aware of the high degree of complication and failure rate of the product.

"It is tragic that medical device manufacturers rush their products to market without adequately testing their safety," stated Motley Rice attorney Rhett Klok. "Our client, Mr. Warren, is one of many who will now spend the rest of their life in pain because of the Kugel Mesh patch. We hope, with this lawsuit, that we will raise awareness of this issue and help bring justice to those harmed.

Holland & Hart Announces New Managing Partner
Holland & Hart is pleased to announce that Lawrence J. Wolfe will be the firm's next Managing Partner effective January 1, 2007. Holland & Hart is a Rocky Mountain regional law firm headquartered in Denver, Colo. with 350 lawyers and 13 offices in seven Western states and Washington, D.C.

Mr. Wolfe has been with Holland & Hart for 21 years and has extensive experience in natural resources and energy law. He most recently served the firm for five years as chairman of the Natural Resources Department. “Larry brings significant management experience to his new position, as well as a deep understanding of the natural resources industry, which is one of our core practice areas” said Firm Chairman, Paul Phillips.

"I have been fortunate to have worked closely with great leaders and lawyers at Holland & Hart," said Mr. Wolfe. "I am enthusiastic about serving the firm and continuing our traditions of providing a full range of legal services to our clients.”

As Managing Partner he will report to the firm’s five-member Management Committee. He will be responsible for the day-to-day management of Holland & Hart and for implementing its strategic objectives.

Mr. Wolfe succeeds Edward H. Flitton, who has held the position since 2000. Mr. Flitton will retire as a partner of the firm and begin a mediation practice in 2007 from Holland & Hart’s Colorado Springs office. "Under Ed's leadership Holland & Hart grew from just over 200 lawyers to more than 350. During this time, revenues doubled. Ed is a nationally recognized law firm leader, and we thank him for his years of extraordinary service to the firm." said Firm Chair, Paul Phillips.

Holland & Hart has grown rapidly, opening offices in Washington, D.C. and Las Vegas, Nev. in 2006.

Mr. Wolfe is currently a Partner in the firm's Cheyenne, Wyo. office. His legal practice involves administrative law, litigation, and legislative matters for natural resources and energy clients. Mr. Wolfe joined Holland & Hart in 1985 after serving as Chief of the Natural Resources Division in the Wyoming Attorney General's Office, where he represented the State in water and environmental issues and served as the State's chief water lawyer.

Jane Michaels Named Among Top 500 Attorneys in America
