Attorney Daniel W. Walker Joins Preti Flaherty's Legislative Practice
Today Preti Flaherty announced that Daniel W. Walker has joined the firm as a partner in the Legislative, Regulatory and Governmental Services Practice Group. He will focus his practice primarily on bringing client interests before the Maine Legislature and other state and federal governmental agencies. Dan will practice from the firm’s Augusta and Portland, Maine offices.

Prior to joining Preti Flaherty, Daniel practiced legislative and regulatory affairs with a large Maine-based firm. He also served as Legal Counsel to the Speaker of the Maine House of Representatives, advising on constitutional, procedural and policy issues. He has also served as counsel in several state election campaigns.

Dan completed two clerkships with Judges Gregory K. Orme and James Z. Davis of the Utah Court of Appeals. He also practiced as an associate with the litigation group of a Utah-based firm, where he represented Microsoft for two years in Caldera v. Microsoft, a private antitrust case.

Daniel is a graduate of the University of Maine School of Law, where he served as editor-in-chief of the Ocean and Coastal Law Journal. He is also a graduate of Dartmouth College and George Stevens Academy in Blue Hill. He is admitted to practice in Maine and Utah.

Firm Names New Partner and Counsel

Hercules Incorporated Pension Plan Settlement
Two lawsuits were filed in Federal District Court in Philadelphia challenging an amendment to the Pension Plan of Hercules Incorporated, effective as of January 1, 2002, that changed the interest rate used to compute lump sum pension payments. For a copy of one of the complaints, click here. The defendants denied the allegations in both complaints and asserted defenses to each claim for relief.

A proposed settlement has been reached on behalf of a class of certain former and present employees of Hercules Incorporated who are participants in the Hercules Pension Plan. The formal class definition is:

All participants in the Pension Plan of Hercules Incorporated (the “Plan”) who: (i) have accrued credited service under Schedule A or Schedule B of the Plan as of December 31, 2004; (ii) were covered by the 51% Partial Cash Payment provision of the Plan as of December 31, 2001; (iii) have retired or will retire on or after January 1, 2002; and (iv) have received or will elect to receive a 51% Partial Cash Payment under the Plan. Participants who accrued credited service under Schedule C of the Plan (i.e., employees at locations previously covered by the BetzDearborn Inc. Employees’ Retirement Plan) as of December 31, 2004 are not included in the class to the extent of their Schedule C credited service.

This agreement, to be effective, must be approved by the Federal District Court at a hearing. The Court has scheduled that hearing for Monday, April 16, 2007, at 2 p.m. in Courtroom 15A, United States Courthouse, 601 Market St., Philadelphia, PA. Any class member may (but is not required to) attend that hearing and state reasons in support of or in opposition to the proposed settlement. If you would like to do so, there are procedures that class members must follow, which are explained in the documents linked below.

On December 4, 2006, the Federal District Court granted preliminary approval to this settlement, and ordered that a formal notice of the terms of the settlement agreement be mailed by first class mail to every class member. For a copy of that Order, click here.

At the April 16, 2007 hearing, plaintiffs’ counsel will also request the Court to award counsel fees, reimbursement of costs, and incentive awards to the named plaintiffs. Those are explained in more detail in the class notice, and in plaintiffs’ legal brief, above. Every class member has the right to either support or oppose that request, by following procedures outlined in the class notice and in the December 4, 2006 Order.

Counsel will file additional briefs by March 16, 2007 supporting final approval of the settlement agreement, and the request for fees, costs and incentive awards. Those will be posted on this website as soon as they have been filed.

Craig L. Hymowitz Appointed to Federalist Society’s Financial Services & E-Commerce Executive Committee

The Federalist Society Financial Services and Electronic Commerce Practice Group Executive Committee works to spark a level of debate and discussion on important topics in today’s legal community. Mr. Hymowitz has been actively involved in the Federalist Society for a number of years and serves as treasurer of the Philadelphia chapter. He recently co-authored an editorial on judicial activism in conjunction with Bill of Rights Day for the Philadelphia Inquirer (www.philly.com/mld/inquirer/news/editorial/16243382.htm).

At Blank Rome, Mr. Hymowitz is an eighth year associate in Blank Rome’s white collar and commercial litigation groups specializing in anti-money laundering and economic sanctions compliance under the Bank Secrecy Act, USA PATRIOT Act, and OFAC; complex commercial litigation; internal and governmental investigations, and government contract disputes.

Mr. Hymowitz has been published on the editorial page of the Washington Post, Chicago Tribune, Los Angeles Daily Journal, San Diego Union-Tribune and Philadelphia Inquirer. In addition, Mr. Hymowitz has also provided commentary on numerous radio and television programs.

Duane Morris Sets Sail with Its Chicago Office Expansion
Duane Morris LLP proudly announces the substantial expansion of its lawyer strength in Chicago with the addition of nine experienced attorneys.
