Chapter 11 Trustee for The Institute for Cancer Prevention Wins
Young Conaway Stargatt & Taylor, LLP, acting as lead counsel, gained conditional approval from the United States Bankruptcy Court for the Southern District of New York of the Chapter 11 Plan of Liquidation filed by Hobart G. Truesdell of Walker Truesdell & Associates, Inc. The Order confirming the Plan is subject to receiving final signoff from the Federal Government on a global settlement, which should be forthcoming in the near future.

After the chapter 11 filing on September 21, 2004, the 35-year-old, world-renowned, Institute for Cancer Prevention captured headlines as it was forced to shutter the doors of its Manhattan office and upstate research labs after federal investigators alleged that it had misspent $5.7 million in federal grants. Soon after, Hobart “Hobie” Truesdell was appointed as the chapter 11 trustee in the troubled case and was charged with cleaning up the mess and trying to provide a recovery to creditors in a case where a recovery looked unlikely. Young Conaway has represented the chapter 11 trustee since his appointment.

The Plan was accepted by all voting creditors and provides for a full distribution to all administrative and priority claims and a modest distribution to general unsecured claimholders.

Belo Interactive Wins Patent Infringement Case
The Federal Court of Appeals for the Federal Circuit has ruled in favor of Greenberg Traurig, LLP client Belo Interactive, Inc., a subsidiary of Belo Corp., in a patent infringement case brought by QuickView.

QuickView sued Belo Interactive and other companies for patent infringement in 2004, claiming that its patent covered Belo Interactive’s method of displaying information on its news and information Web sites, including dallasnews.com. In 2005, a Dallas federal district court granted Belo Interactive summary judgment, ruling that Belo Interactive did not infringe the QuickView patent as a matter of law. Earlier this month, the Federal Circuit Court of Appeals affirmed the district court’s decision, granting summary judgment of noninfringement of the QuickView patent in all respects.

The Federal Circuit’s decision confirmed that the QuickView patent did not cover display methods performed by a computer network comprising two or more computers. David Starr, Deputy General Counsel of Belo Corp., said "Although others settled with QuickView by agreeing to pay a license fee, we knew our internet news technology was not infringing and decided that it was important to challenge this lawsuit. We do not intend to pay companies license fees when they assert patent claims that lack merit."

Belo Interactive was represented by Eric W. Buether and Christopher M. Joe of the Dallas office of Greenberg Traurig, LLP.
