Sanford to Receive Harold Hitz Burton Award
partner Bruce Sanford, will be honored on January 23, 2007, by the Cleveland Club of Washington, D.C., with its Harold Hitz Burton Award, given to a Clevelander who has made an outstanding contribution to the nation while working in Washington. The most recent recipient of this award prior to Sanford was U.S. Senator George Voinovich, former Mayor of Cleveland and Governor of Ohio.

Sanford has been described by American Journalism Review as one of the most accomplished press lawyers in the nation. The National Law Journal mentioned him in its 1991 list of the 100 most influential lawyers in America, and The Washingtonian’s 1997 article on "The 50 Best Lawyers in Washington" noted he was "without peer" in First Amendment Law.

The Cleveland Club is an association of Washington men and women who share a keen interest in Cleveland, and participants include United States Representatives, judges, prominent federal officials, journalists and others of diverse background and occupation. The Club continues to learn of and promote progress in Cleveland and to invite speakers who offer insights to its members on current affairs both in Cleveland and the nation’s capital.

Appleton Named to BTI "Client Service All-Star Team"
Cincinnati partner William Appleton, who has extensive experience in advising public and private companies on a broad range of corporate and securities laws matters, has been named to the BTI Consulting Group’s (BTI) "Client Service All-Star Team for Law Firms," based on one of his clients singling him out for delivering exceptional client service.

Appleton is only one of 113 lawyers in the country to be named to the list, which was compiled by interviewing more than 250 individual corporate counsel at FORTUNE 1000 companies. The only way a lawyer is named to this prestigious group is to be nominated—unprompted—by a client for superior client service.

New York Law Journal: Proposed Evidence Rule 502: Monitor’s Privilege Created?
New York partner Lauren Resnick and associate Anjula Garg co-authored an article for the December 20 edition of the New York Law Journal titled, "Proposed Evidence Rule 502: Monitor’s Privilege Created?"

The article focuses on the Federal Rules of Evidence Proposed Rule 502 which would expressly permit selective disclosure of privileged and work product material to the government, without waiver as to third parties.

According to the authors, "While [the proposed rule] has generated debate as to whether the selective waiver provisions of the rule strike an appropriate balance between the promotion of good corporate behavior and the continuing vitality of a corporate privilege, its enactment would for the first time provide an evidentiary basis for a so-called ’monitor’s privilege’ to insulate from third-party discovery information disclosed to independent monitors who serve as conduits for government agencies," typically appointed as part of a nonprosecution or deferred prosecution agreements.

Resnick and Garg go on to discuss the details of the proposed rule and the related issues of nonprosecution and deferred prosecution agreements and the impact on monitorships.

The authors conclude: "As monitorships are increasingly favored by the government to resolve federal corporate criminal liability, Proposed Rule 502(c) provides an opportunity to codify by extension a monitor’s privilege which will promote remediation and protect corporations from subsequent disclosure of their protected information in litigation.

Rogers Towers Announces Newly Elected Board Of Directors & Re-Elected Managing Director Jacksonville
Rogers Towers has re-elected Douglas A. Ward as its Managing Director. Ward will serve another term with newly elected Board members Adam G. “Lep” Adams, III; E. Allen Hieb, Jr.; Gregory F. Lunny; G. Kenneth Norrie; and Michael A. Wodrich.

Ward has been with Rogers Towers for 35 years. He attended Duke University for undergraduate studies, prior to earning his Juris Doctor (J.D.) from the University of Florida School of Law in 1971. In addition to his duties as the firm’s Managing Director, Ward assists clients with real estate matters, including representation of both lenders and borrowers in real estate loans, owners and contractors in the development of real estate, and buyers and sellers of real estate. He also serves as a member of the Board of Directors for Hope Haven Children’s Clinic.

Adams, a shareholder in the firm’s construction law group, is Board Certified in Construction Law by The Florida Bar. His practice is concentrated in complex commercial litigation with particular emphasis on construction and real estate disputes. Adams earned his undergraduate and law degrees from the University of Florida. He is also a member of The Florida Supreme Court Commission on Professionalism.

Hieb is a shareholder with the firm and a member of the firm’s business and tax department. He begins his fourth term serving on the firm’s board of directors. He practices in the areas of federal and state taxation and the creation, operation, reorganization and disposition of partnerships, corporations and other business and professional entities. Hieb earned his undergraduate degree and J.D. from Mercer University. He is a member of the Rotary Club of Jacksonville and Leadership Jacksonville Class of 2005.

Lunny is a shareholder with the firm and is serving his fourth term as a member of the firm’s board of directors. He practices in the area of business litigation, including intellectual property litigation, business torts, antitrust, products liability litigation, regulatory compliance litigation, lender liability defense and construction litigation. He received his B.A. from Vanderbilt University and his J.D. from the University of Florida School of Law.

Norrie is Board Certified in Construction Law by The Florida Bar. His practice is in the area of commercial litigation and involves a number of types of cases, primarily construction matters. Norrie is a construction litigator and has represented owners, contractors, architects and engineers in a range of litigated matters from contract disputes to building failures and personal injury claims. He earned his B.A. from the University of Florida and his J.D. from Harvard University. Norrie is also a former Captain in the U.S. Army.

Wodrich is a shareholder and member of the firm’s business and tax department. His practice consists of general business, including acquisitions and sales of business firms and major real estate transactions. Wodrich earned both his B.A. and J.D. from the University of Florida. He has an “AV Rating” by Martindale-Hubbell, which is the highest rating one can receive from peers in the legal profession.

PHILLIPS LYTLE ATTORNEYS SHARON PRISE AZURIN AND ANGELA ZWIRECKI MILLER PRESENT TO BAR ASSOCIATION OF ERIE COUNTY
Sharon Prise Azurin and Angela Zwirecki Miller, attorneys with the law firm of Phillips Lytle LLP, one of the region’s largest full service law firms, recently made a presentation to the Bar Association of Erie County, Banking Law Committee. The presentation focused on “The Perishable Agricultural Commodities Act and New York Agriculture and Markets Law.”

At Phillips Lytle, Ms. Azurin concentrates her practice in the area of general commercial law and general corporate law. A member of the American, New York, Erie County and Women’s Bar Associations, she received her J.D., cum laude, from University at Buffalo School of Law, her M.B.A., with distinction, from University at Buffalo School of Management and her B.S. from Cornell University School of Hotel Administration. In addition Ms. Azurin serves as Treasurer for The Buffalo Seminary Alumnae Association and on the Advisory Board of Directors for Maple Leaf Foods.

Ms. Miller focuses in the area of commercial law. She holds a J.D. from University at Buffalo School of Law, her M.B.A. from University at Buffalo School of Management and her B.A. from University at Buffalo. Ms. Miller is a member of the American, New York, Erie County and Women’s Bar Association, as well as the Turnaround Management Association.
