FAB Partner Virginia Palmer Interviewed on "Your Legal Rights" Radio Program
On November 29, 2006 FAB Estates and Trusts Partner Virginia Palmer was a guest on the "Your Legal Rights" radio program with host Chuck Finney. Also joining Virginia on the program was Mary Twomey, the Director of the Consortium for Elder Abuse Prevention at San Francisco's Institute on Aging. The hour-long broadcast focused on preventing elder abuse though estate planning. Kristin and Mary fielded questions from callers with a variety of concerns regarding protecting older family members. The weekly program is broadcast on KALW, 91.7 FM in San Francisco.

Fisher & Phillips Elects 10 New Partners
Fisher & Phillips LLP has announced the election to Partner of 10 attorneys at the national labor and employment law firm. The promotion from associate or of counsel to partner takes place January 1, 2007.

Chadbourne Represented EBRD in a Deal to Acquire 20% of Russia's First Low
Chadbourne & Parke LLP represented the European Bank for Reconstruction and Development (EBRD) in a deal to acquire a 20% stake in Russia's first low-cost airline, Sky Express.

The stake was acquired through an investment of $10 million. The deal was signed on December 18.

The bank's investment in Sky Express is expected to rise in several stages and could go up to $20 million, EBRD said. The airline's start-up capitalization is $48 million.

Working on the deal for Chadbourne were Moscow office managing partner Laura Brank, London partner Jennifer Handz and Moscow associate Dmitry Gubarev.

Sky Express' other shareholders include Boris Abramovich, general director and a key shareholder of Russia's Krasnoyarsk Airlines, who owns a blocking stake in the new airline.

Sky Express, which will be based at Moscow's Vnukovo airport, is to have a fleet of 18 Boeing-737s by late 2007. The company projects its passenger traffic at about 600,000 people in January-June 2007 and at 3.5 million people by late 2008.

Sky Express will operate only in the Russian market, with flights to St. Petersburg, Rostov-on-Don, Yekaterinburg, Volgograd, Kaliningrad, Samara and other cities.

Phyllis Katz Will Be Faculty for Session Detailing Workplace Issues for Cancer Survivors
Phyllis C. Katz, a partner at the law firm of Sands Anderson Marks & Miller, will be among the featured faculty for a free seminar hosted by the VCU Massey Cancer Center and the Greater Richmond Affiliate of the Susan G. Komen Breast Cancer Foundation on January 18 at 7:00 p.m. at the Science Museum of Virginia, Lynne Penberthy, MD, co-director of the Survivorship Symposia Series, announced recently.

Working people who are diagnosed with cancer have a complex set of legal, financial and professional issues to deal with regarding work, income, health insurance, sick time, medical leave and employer accommodations, among other issues, Penberthy said. The symposium is aimed at giving cancer patients strategies to succeed in the workplace.

The hosts are encouraging patients, family members, employers, human resource professionals, patient advocates and healthcare professionals to attend. Ms. Katz specializes in employment law. A two-time cancer survivor with extensive personal and professional experience in battling its effects, Ms. Katz co-founded the Legal Information Network for Cancer (LINC), a non-profit organization that provides legal assistance to cancer patients. She was appointed by three Virginia governors to oversee employee relations for the Commonwealth, and she is also on the faculty of the University of Richmond’s School of Law.

Lommen Abdo Heads Into 2007 with Three New Shareholders and Three New Attorneys
Lommen, Abdo, Cole, King & Stageberg, P.A. has elected three new shareholders and hired three additional attorneys, as it expands to serve its clients growing needs. The three new shareholders are Tim Matson, entertainment and intellectual property law; Valerie Sims, litigation; and Deb Swenson, bankruptcy litigation. The new hires include Paul Bezilla, entertainment and intellectual property law; Brett Clark, litigation; and Bryan Feldhaus, entertainment and business-related law and litigation.

Tim Matson

Tim Matson practices in the areas of entertainment law, commercial litigation, intellectual property and corporate law. His clients include individuals, small and mid-sized businesses, musicians and entertainers. Tim served as Chair of the Minnesota State Bar Association Arts & Entertainment Law Section in 2003-04. He has authored articles on entertainment issues for the Minnesota State Bar Association Arts & Entertainment Law Section and the Minnesota Music Academy. Tim has been selected as a "Rising Star" by Minnesota Law & Politics. He is AV-rated by Martindale Hubbell.

Valerie Sims

Valerie Sims practices in the area of litigation, with an emphasis on class actions, construction litigation and insurance defense matters. Valerie litigates cases involving personal injury, employment disputes, manufactured housing communities, antitrust, property damage, and other claims involving homeowners, businesses, and professional liability. She has been selected as a "Rising Star" in the area of litigation by Minnesota Law & Politics. Valerie also maintains a strong commitment to pro bono work by assisting low income housing residents and litigating landlord tenant disputes.

Ohio Supreme Court Ruling Brings Clarity To Personal Injury Cases, HHM member Says
Today's Ohio Supreme Court ruling in the closely watched Robinson v. Bates case will bring unprecedented clarity to the way the courts decide personal injury cases, a leading Ohio medical malpractice defense lawyer says.

Shirley J. Christian, a member with Harrington Hoppe & Mitchell Ltd., based in Youngstown, says the landmark ruling will clear defendants in personal injury cases to show juries whether medical bills cited as evidence by plaintiffs were discounted. In the past, such information was not admissible.

"This ruling will blow away the 'smoke' from a lot of personal injury cases," Atty. Christian said. "Plaintiff’s counsel will no longer be able to wave huge bills that were never paid by anyone in front of a jury and ask to be compensated for them without the defense being able to show that no one paid those amounts."

Today's ruling focuses on whether a defendant can introduce evidence that a plaintiff's medical carriers accepted less than the amount on their bills as full payment. In the Robinson v. Bates case, less than $600 separated the total medical bills cited and the amount the medical coverage actually paid. But in some cases involving more extensive injuries, the gap between the amount cited and the amount paid is much larger.

"One of the favorite practices of plaintiff's attorneys is to tally up all of a victim's medical bills and use that number to build damages," Atty. Christian said. "In the past, even when defendants knew a much lower amount was actually paid, they were forbidden to introduce this fact into Ohio cases.

"Now, that provision is gone, and Ohio juries can finally hear the truth. Juries will be able to decide the value of injuries based on the true costs incurred by those injured, not exaggerated numbers. The impact of this ruling will extend to every Ohio personal injury case that involves medical coverage.
