Matthew Woods Wins Important Supreme Court Decision
The Connecticut Supreme Court's recent decision in OCI Mortgage Corporation v. Carole Marchese, 255 Conn. 448 (2001), was the culmination of years of strategic legal work by Attorney Woods and resulted in a substantial recovery to his client. Seeking to foreclose a mortgage originally owned by a failed bank and acquired through the FDIC, OCI had to contend with a powerful defense by the borrower - the setoff of a much larger debt which the failed bank owed to the borrower. Utilizing the "D'Oench, Duhme" doctrine (pronounced "dench doom"), a federal statutory and judicial doctrine named after a seminal United States Supreme Court decision, Attorney Woods argued that the setoff defense was invalid. The Attorney Trial Referee disagreed and ruled in favor of the borrower. The Superior Court reversed and ordered a foreclosure of the mortgage. The Appellate Court, in turn, reversed and decided in favor of the borrower on four separate grounds. Finally, after granting certification to appeal the Connecticut Supreme Court rejected all four of these grounds and reinstated the judgment of foreclosure in favor of OCI. The client was "quite happy" with the final decision.
