HUMAN RESOURCES ASSOCIATION OF GREATER CONCORD ANNUAL EMPLOYMENT LAW UPDATE
The Human Resources Association of Greater Concord held its annual update, which was presented by Jim Reidy and Diana Wieland of Sheehan Phinney Bass + Green’s Labor Employment Group. They did a legal update on recent developments in employment law – 2006: A Year in Review.

In addition, they also unveiled our latest interactive presentation: “Employment Disputes: Deal or No Deal”. The game takes contestants through a series of common workplace problems and complaints. The cases have several twists and turns with letters, memos, e-mails and phone calls revealing new developing facts or issues. The game uses actual cases from around the country. Contestants have to weigh the facts, recognize a problem, dismiss irrelevant information and decide how and when to conclude the matter.

The Human Resources Association-Greater Concord, NH (HRA-GC) is Concord’s local association for human resource professionals and other professionals concerned with knowing and using the best methods to manage their people and organization effectively.

Pierce Atwood LLP Wins Landmark Case Affecting Future Regulation of Nation’s Electricity Industry
In a landmark decision affecting the future of the nation’s $270 billion electricity industry, the Ninth Circuit Court of Appeals in California decided in favor of The California Electricity Oversight Board and the California Public Utility Commission, represented by Pierce Atwood LLP, in their case seeking rate relief from unfairly priced long term energy contracts the state of California entered during its energy crisis. The court’s ruling was issued on December 19.

“This is the first decision in the nation making clear how and to what extent federal regulators must scrutinize the consumer impact of wholesale energy contracts entered into in the newly deregulated energy markets,” said Pierce Atwood LLP partner William J. Kayatta, Jr., who argued the case for California.

In 2001, California entered into $41 billion worth of long-term electricity contracts in an effort to manage the energy crisis of 2001. Market abuses, which included actions such as intentionally shutting down generating capacity, were presented to the Court as key elements in creating a crisis atmosphere where California believed it had no other alternative than to lock in high prices.

“As a result of this ruling, the Federal Energy Regulatory Commission must ensure that deregulated energy markets are functioning properly and fairly before assuming contracts entered into in those markets are just and reasonable,” commented Mr. Kayatta.

The unanimous decision by the Ninth Circuit overrules an earlier ruling by FERC that found against the interests of California consumers. The Ninth Circuit ordered FERC to reopen its proceedings and apply legal rules that could result in California consumers having future rate relief of more than $1 billion.

“The significance of this ruling is that it protects consumers from market abuses and ensures continued public support for the economic benefits of deregulated energy markets,” said Mr. Kayatta.

BEST OF LONG ISLAND 2007
The Long Island Press just released it's Best of Long Island 2007. The publication is based on the reader's picks for the best of what Long Island has to offer covering the best lawyer, TV personality, restaurant, health spa, salon, parks, diners, clubs, beaches and much more.

Congratulations to Lois Carter Schlissel for being voted one of the three best lawyers on Long Island.

The Long Island Press began running its first-ever Best of Long Island readers poll back in January of 2006. It was a resounding success that lost no momentum throughout the year—so much so that since the voting began for 2007, the reaction has been overwhelming. Many hours were spent counting (and deciphering) the ballots. The poll was conducted by the readers, plus a few Editor’s choices by the Press staff.

Bridgeport Schools Receive Holiday Technology Gift
The holidays came a little bit early this year for the Bridgeport School System, and in particular, the seventh grade students at Winthrop School.

The law firm of Koskoff, Koskoff & Bieder has donated 15 laptop computers to the Bridgeport school system. The computers will be given to the Winthrop School for use by the seventh grade students.

“We are really excited about this opportunity,” said Coretta K. Dean, Director of Educational Technology, Bridgeport Public Schools. “This is a new adventure for us, to be able to extend learning beyond the classroom and into the home. The school day can now be extended, allowing the students to become more efficient in the technology that encompasses our daily lives.”

The 15 laptops will be a part of a lending library -- students will be able to sign out the laptops and take them home at night to do their assignments, returning the computers the next day.

“We are proud to be able to make this donation to the Bridgeport school system,” said Atty. Richard Bieder of Koskoff, Koskoff & Bieder. “The gift of these laptops goes far beyond the initial exchange. They will provide a new learning experience for the children and enable them to compete with other students who already have access to this technology in their own homes.”

“This contribution follows a line of community projects initiated by Koskoff, Koskoff & Bieder in Bridgeport. Those projects include:

Attorneys and Businesses for a Better Connecticut, which offers an opportunity for part-time employment in law firms and professional businesses to Bridgeport young adults who would otherwise not have access to such employment. The results of that pilot project exceeded all expectations - employing 25 applicants over a two-year period, each of whom received hourly pay exceeding typical wages offered to such applicants. That program now has none business and law firm sponsors, including: Koskoff, Koskoff & Bieder, Pullman & Comley LLC, Cohen & Wolff P.C., Durant, Nichols, Houston, Hodgson & Cortese-Costa, P.C., Green & Gross P.C., Costello & McCormack P.C., Peoples Bank and Innovative Display and Designs.

The KKB Scholarship Fund through the Housatonic Community College Foundation provides scholarships for young adults holding part time jobs, helping to enable them to attend and succeed at college.

KK&B also is coordinating a pilot project in Bridgeport to bring fuller arts programs to the elementary schools in Bridgeport.


“Learning can no longer end at the close of the school day,” said Dean. “Not all of our students have a computer at home, but with the lending library, teachers can give computer-based assignments and the young people now will have an equal opportunity to complete them. This is an important step in closing the technology gap between the urban students and suburban students.”

Goldberg Kohn Represents Home Products International in Bankruptcy Reorganization Cases
A leading designer, manufacturer, and marketer of a broad range of high-quality, consumer products – received all relief requested in the first-day hearing of the Chapter 11 cases filed in the U.S Bankruptcy Court for the District of Delaware. The global manufacturer is represented by the Chicago-based law firm, Goldberg Kohn.

On the first day of the cases, the companies also filed their plan of reorganization, the hallmark of which is that general unsecured creditors would be unimpaired and paid in the ordinary course of business. In addition, $116 million in senior subordinated high yield debt would be converted to equity, with the noteholders receiving 95 percent of the new HPI stock and the old HPI stockholders receiving 5 percent of such stock. The approach has the support of a majority of the HPI noteholders and HPI's majority shareholder. The companies will seek approval of the restructuring plan as soon as permitted under the Bankruptcy Code.

Ronald Barliant, a former bankruptcy judge and a current partner in Goldberg Kohn’s Bankruptcy & Creditors’ Rights Group, and Kathryn Pamenter, counsel for Goldberg Kohn’s Bankruptcy & Creditors’ Rights Group, are leading the representation. Ms. Pamenter conducted the first-day hearing, during which HPI obtained court authorization to obtain $60 million in debtor-in-possession financing and to pay trade creditors' pre-petition claims if they offer favorable terms, and other orders necessary to allow HPI to continue business as usual.

Mr. Barliant stated, "We are confident that this bankruptcy restructuring will be completed quickly. We are especially pleased that Judge Sontchi set the confirmation hearing in these cases for March 8, 2007, and we expect to go forward on that date."

"By filing a plan of reorganization in a timely fashion, along with our request to pay our vendors immediately, we are sending a clear message that we are taking positive steps that will ensure the continued and improved operation of HPI,” said Douglas Ramsdale, HPI chief executive officer. “HPI will operate normally throughout the process, continuing to manufacture and deliver the high quality products our customers demand. We remain committed to maintaining our excellent relationships with customers, suppliers and employees as we create an even stronger HPI.

Davis Wright Tremaine’s Carol Bernick Named In the Top 25 Women Oregon Super Lawyers
Carol Bernick, a partner at Davis Wright Tremaine LLP, has been named in the Top 25 Oregon Women Super Lawyers. Twenty-one other attorneys in the Portland office have been named by Law & Politics as Oregon Super Lawyers 2006, in practices ranging from bankruptcy to environment to real estate.

Bernick, an employment and litigation attorney, represents clients such as Bank of America, Dollar Tree Stores, Legacy Health System, KGW News, Pitney Bowes and U.S. Bank. She is the principal editor and co-author of The Oregon Employment Law Deskbook and formerly served as Editor-in-chief of the Oregon Labor Letter for seven years.
