Howrey Makes Geradin Partner
Damien Geradin has been named a partner in Howrey’s Brussels office, according to a Global Competition Review report. Geradin stated that his promotion suits him well because of the firm’s flexibility. “Howrey is very diverse, and it’s not a one-size-fits-all kind of partnership. Brussels managing partner Trevor Soames added: “Howrey applies itself as being a thought-leader in the antitrust market and promoting Damien to the partnership recognizes this.

HOWREY SCORES FOR CLIENT PROCTER & GAMBLE IN AIR FRESHENER DESIGN BATTLE
The European IP team from Howrey LLP has secured a major victory for its client, The Procter & Gamble Company, in an important designs dispute against Reckitt Benckiser. The High Court in London ruled that Reckitt Benckiser's Air Wick Odour Stop product infringes one of P&G's Registered Community Designs, which it also found to be valid.

This is one of the first cases of its kind under the Community Designs Regulation that introduced EU-wide, unitary design rights as of April 2003. The finding of infringement indicates that Community Designs (and national designs registered under harmonized EU design law) may be afforded a somewhat broader scope of protection in appropriate circumstances, than was the case under pre-harmonised law, making them potentially more valuable to rights holders. The decision also gives guidance on the approach to a number of aspects of the new law that have been debated since its introduction.

The London court's determination in substantive proceedings follows successful results in several other member states of the EU in preliminary relief proceedings. Howrey’s London office represented the client in the substantive proceedings and was also responsible for overall co-ordination of the dispute across Europe. Howrey’s Paris, Amsterdam and Brussels office represented the client in proceedings in France, the Netherlands and Belgium respectively.

Neil Duke Named Principal
Ober|Kaler is pleased to announce that Neil E. Duke will become a principal of the firm, effective January 1, 2007.

Driven by a strong social conscience, Mr. Duke, 42, presently sits on the boards of the Baltimore Homeless Services, Inc., Govans Ecumenical Development Corp., and the Baltimore City Civilian Review Board. Past president of the Monumental City Bar Association and graduate of the Maryland State Bar Association Leadership Academy, he is an active member of numerous professional organizations including the Maryland State Bar Association Committee on Judicial Appointments.

A long-time adjunct faculty member of the University of Baltimore School of Law, Mr. Duke is a mentor for aspiring and young lawyers.

Mr. Duke practices employment law from Ober|Kaler's Baltimore headquarters. He has been recognized with numerous awards and honoraries including the Baltimore Business Journal's 40 Under 40 award. Before joining the firm, Mr. Duke served as a Staff Investigator in the Office of the Federal Public Defender, District of Maryland. As a Special Agent and active-duty Air Force Captain stationed at Andrews Air Force Base, he managed anti-fraud efforts in the Metropolitan Washington, DC area.

Mr. Duke received his BA from The Citadel, The Military College of South Carolina in 1986 and his JD, cum laude, from the University of Baltimore School of Law in 1998, where he served as Executive Editor of the Law Review and Captain of the National Moot Court and Student Trial Lawyer's Trial Teams.

Mr. Duke is a resident of Baltimore City.

Partner Alan Friedman Quoted in The New York Times on Regan's Lawsuit Against News Corp.
Alan R. Friedman, a partner in the Firm's Litigation and Dispute Resolution Practice and its Entertainment and Media Practice, was quoted in The New York Times on book publisher Judith Regan's imminent lawsuit against News Corporation for libel and wrongful termination due to allegations that she was fired after making anti-Semitic remarks during a phone conversation with a company lawyer (Murdoch vs. Regan: Hollywood Girds for Latest Boldface Battle of Egos, December 21, 2006).

Cleary Gottlieb Scoops IFR’s Global Restructuring Deal of the Year Award
Cleary Gottlieb received International Financing Review's Global and EMEA Restructuring Deal of the Year for its restructuring of Iraq's $20 billion of commercial creditor debt. The award was announced on December 17.

IFR praised the "speed and efficiency" with which the restructuring had been handled. At the end of the process, 96 percent of eligible creditors had received payouts and 11,776 smaller, individual Saddam-era claims, which had a total value of $19.7 billion, were cancelled. The restructuring was completed in July 2006.

Richard K. Tavani Successfully Defends Employer in Grievance Hearing
Richard K. Tavani, a partner in the Firm's Cherry Hill office, successfully defended the Voorhees Fire District in a grievance hearing before the New Jersey Public Employment Relations Commission filed by a firefighter over the alleged failure of the District to give injury leave to employee for a one-month period for injuries he sustained in the course and scope of employment.

The employee also filed a workers' compensation for the injury at issue. The workers' compensation matter was settled without a provision maintaining the employee’s claim for injury leave would be maintained. If the worker had been placed on injury leave, additional temporary benefits under the workers compensation statute would have been due.

Mr. Tavani defended the claim, in part, by maintaining under the principle of estoppel that the employee waived his injury leave claim when he failed to preserve in the Order Approving Settlement in the workers compensation case the injury leave claim.
