Lauren Snyder Joins Business Services Group
Lauren Snyder has joined the Business Services Department at Hodes, Ulman, Pessin & Katz, P.A., as an Associate, and will concentrate her practice in corporate transactions, tax and real estate.

Prior to joining HUP&K, Snyder was an Summer Associate at DLA Piper and the New York Law School Securities Arbitration Clinic.

Snyder received her J.D. from New York Law School, magna cum laude, and her B.B.A. with honors, from Emory University, Goizueta Business School.

GUNSTER YOAKLEY HOLIDAY PARTY GATHERS GIFTS FOR JACK & JILL CHILDREN’S CENTER
Tis the season for giving and the attorneys and guests at the Gunster Yoakley holiday party made it a reality this year as the firm gathered gifts for Jack & Jill Children’s Center. Several hundred toys and games were donated upon arrival at the Ft. Lauderdale Antique Car Museum, where the Fort Lauderdale office of Gunster Yoakley held its annual holiday festivities.

“We strongly believe in giving back to the community, and we’ve made it an annual tradition to encourage donations at our holiday party,” said Daniel Mackler, an attorney with Gunster Yoakley in Fort Lauderdale. “Jack & Jill Children’s Center does such important and valuable work, and it is right in our own backyard, so this was the perfect recipient for our collection.” Mackler noted that the firm collected and donated gifts to the Jack and Jill Children’s Center last year, as well.

More than 200 people attended the party and brought items ranging from classic books and games such as Madeline and Scrabble to model cars, Play-Doh, yo-yos, tops, coloring books and crayons, puzzles and cards.

In addition to the gift donation, attendees learned a great deal about classic cars as they toured the unique museum that houses an extensive and remarkable collection of Packards, other cars and memorabilia.

MARTIN PRESS, GUNSTER YOAKLEY SHAREHOLDER, BECOMES SENATE CLUB MEMBER OF AIPAC
Gunster Yoakley equity shareholder Martin Press has become a Senate Club Member for the American Israel Public Affairs Committee (AIPAC). Press, former chair of AIPAC in Broward County, and former president of the Jewish Federation of Fort Lauderdale, will be integral to the governing group that lends tremendous support in American – Israeli relations.

“I am pleased to be part of this essential organization and to work with the dedicated individuals who make up the Senate Club,” said Press. He has been involved with AIPAC since 1992.

Press is an equity shareholder with Gunster Yoakley, and serves as chairman of the Board of Governors. His practice areas include federal, state and international tax law and estate planning, and he also served as an adjunct professor teaching a senior seminar on ethics. Press is the former chair of the Jewish Community Foundation of Broward and received the American Jewish Committee Outstanding Lawyer Award.

The Nebraska Concealed Handgun Permit Act Effective January 1, 2007
At our client conference on May 11, 2006, we reviewed LB 454, the Nebraska Concealed Handgun Permit Act, which becomes effective January 1, 2007. That law provides for issuance of permits making it lawful to carry a concealed handgun except under certain circumstances. One of those circumstances was removed by the Omaha City Council when it amended the Omaha Municipal Code to include, in the section making it a crime to carry a concealed weapon, the following: "On or after January 1, 2007, any person possessing a lawful permit issued by the State of Nebraska authorizing the carrying of concealed handguns shall be permitted to carry such a concealed handgun in the City of Omaha as permitted by State law."

Therefore, all Nebraska clients, whether within or outside of Omaha, must comply with certain requirements if they intend to prohibit the carrying of concealed handguns on their premises. You must provide notice that permitholders are prohibited from carrying concealed handguns into or onto property you control, either as a place open to the public or as a place of employment. Section 15(2) of the Act provides that a permitholder does not violate the law unless the person or entity in control of the property posts a conspicuous notice that carrying a concealed handgun on the premises is prohibited or requests that the permitholder remove the concealed handgun from the premises. We, therefore, recommend that clients include such notices in employee handbooks and post them in such locations used for employment law posters and other areas that are open to the public.

Prohibiting the possession of concealed weapons in vehicles that are parked in your parking lots may be more difficult. The last two sentences of section 15(2) provide as follows: "A permitholder carrying a concealed handgun in a vehicle into or onto any place or premises does not violate this section so long as the handgun is not removed from the vehicle while the vehicle is in or on the place or premises. An employer may prohibit employees or other persons who are permitholders from carrying concealed handguns in vehicles owned by the employer." Together, these sentences may imply that an employer must allow employees and visitors who are permitholders to carry concealed handguns in their personal vehicles when parked in the employer's parking lots. Clearly, a permitholder carrying a concealed weapon in that manner would not violate the Act, but an employee who violates the policy could be subject to discipline by the employer.

While the Act does not expressly prohibit such a policy, the last sentence of section 15(2) could be interpreted as such a limitation. An employee could contend that any prohibition on carrying concealed handguns in private vehicles parked in the employer's parking lots violates the purpose and intent of the Act and is invalid. While we believe good arguments support the employer's right to impose such restrictions on carrying concealed handguns, we cannot predict how a court might interpret the Act and rule on a challenge to such a policy.

This Act applies only to concealed handguns. You may continue to ban the possession of all other weapons in the workplace without limitation by this Act.
